FINDINGS AND REPORT
The application of Dr. Michael Ishak, Lot 84-RH, Rolling
Hills Tract, for a Conditional Use Permit under Section 3.01, Para-
graph 3 (a) of Ordinance No. 170, came on for hearing on the 17th day
of February, 1981 in the Council Chambers of the Administration Build-
ing, 2 Portuguese Bend Road, Rolling Hills, California, and the
applicant, having submitted evidence in support of the application,
the Planning Commission, being advised, now makes its Findings and
Report as required by the Ordinances of the City of Rolling Hills,
California.
I.
The Commission finds that the applicant, Dr. Michael Ishak,
is the owner of that certain real property described as Lot 84-RH,
located at 8 Blackwater Canyon Road in the City of Rolling Hills, and
that notice of the public hearing in connection with said application
was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills, California. The Commission finds, further,
that the'applicant•'has requested a:Conditional Use Permit for construc-
tion of a cabana. The Commission finds that Mr. William Davisson,
7 Blackwater Canyon Road came to the office and looked at the plan,
stating that he had no objection to the proposed cabana as shown. The
Commission finds that a letter dated January 26, 1981 regarding an
easement between his property and the Ishak property is not within
the jurisdiction of the Planning Commission; that said easement was
reserved as a condition of approval of the subdivision of Dr. Ishak's
property, and the matter was resolved by the Board of Directors of
the Rolling Hills Community Association. The Commission finds that
no other communication, written or verbal, was received in favor of
or in opposition to the request for a Conditional Use Permit.

The Commission finds that the proposed cabana would.not be
visible from the portion of Upper Blackwater Canyon Road where the
public has access, nor would it be disturbing to residents of sur-
rounding properties. The Commission finds that a Conditional Use
Permit should be granted in order to preserve substantial property
rights in the same vicinity and zone, and that the granting of such
a permit would not be materially detrimental to the public welfare,
nor injurious to property in the same vicinity and zone.
III.
From the foregoing it is concluded that a Conditional Use
Permit should be granted to Dr. Michael Ishak, Lot 84-RH, 8 Blackwater
Canyon Road, subject to Conditions of Approval pertaining to Guest
Houses/Servants Quarters adopted March 18, 1980, Conditions 1 through
11, with the following revisions:
Condition No. 7: The proposed cabana facility shall not
be used as a residence or sleeping quarters, but shall• be
used strictly as a recreation room and changing room for
the pool facilities.
Condition No. 8 shall be deleted, since it does not
because existing landscaping is satisfactory.

IV.
The applicant is advised that this approval shall expire
one year from the date of grant, if not acted on. The applicant is
further advised that the time within which to seek judicial review
of this action is governed by Section 1094.6 of the Civil Procedure
of the State of California.

Dear Mrs. Cunningham:
Several years ago, I believe 1978, the City of Rolling Hills
gave permission to the Ishacks to contruct a gate preventing
traffic from continuing down Upper Blackwater Canyon Road onto
the unimproved easement between upper and lower Blackwater Roads.
The gate has been the subject of controversy between the Community
Association, myself, and the Ishacks•
After passing through the gate, within twelve feet, the
access road is completely on my property and continues on my
property for approximately 150 feet where it swings east and
becomes Ishack's property. I felt that since the Ishacks were
using my property for access to their property, I should have
access through the gate also to provide me access to my property
from Upper Blackwater Canyon Road. I specifically requested
access for brush clearing and tractor discing for weed abatement
reasons. The Ishacks demanded that if the Community Association
were to grant my request for access, the gate should be closed
down to all but emergency vehicle traffic. The Rolling Hills
Community Association took this action in the summer of 1980,
asking the Ishacks to give the gate keys to the Association.
Although this issue is not a matter for the City of Rolling
Hills, I do feel that whatever permit is granted the Ishacks for
construction or improvements of any type, the City should be
aware that access through this gate has been restricted to the
use of emergency vehicles only by the Rolling Hills Community
Association.
