1997, requesting an additional 83 cubic yards to be imported to 20 Buggy Whip Drive
for repair of the eroded horse trail. Previous approval dated August 22, 1997
authorized 280 cubic yards of import for this repair.
Based upon inspection of this property by myself and County District Engineering
Associate Rafael Bernal, you are authorized to import an additional 83 cubic yards of
soil for repair of the eroded horse trail. This 83 cubic yards is in addition to 240 cubic
yards that has already been imported to the site, establishing your total approved soil
import for this project at 323 cubic yards.
Please refer to our correspondence dated August 22, 1997 (attached) and August 20,
1997 and August 22, 1997 (attached) for compliance with required conditions upon
completion of this erosion repair.

53.1 yards of dirt was removed from 49 Saddleback today, Friday. The material went to a
R.H.C.A. dumpsite within the Flying Triangle. The 53.1 cubic yards together with the previous
348.1 cubic yards accounts for 401.2 cubic yards of earth that has been exported from the
property.
The remedial repair of the trail adjacent to the Jonas house at 20 Buggy Whip Drive has not been
completed.
There is an area that is approximately 13 feet wide with an average depth of 1 1/2 feet with a
length of 60 feet and an adjacent area that is 14 feet wide, an average depth of 1.75 feet and a
length of 45 feet that requires additional dirt in order to complete the tail repair.
The yardage needed to complete the task is 83 cubic yards. 240 has already been imported,
giving us a total of 323 cubic yards.

We have reviewed your letter of August 20, 1997 and viewed the site of the horse trail behind
the residence at 20 Buggy Whip Drive. You request exportation of soil from the Capifali
construction site at 49 Saddleback Road to the subject site due to the need to repair 1,750
square feet of the eroded horse trail. You state that the amount of soil material needed to
complete the job will not exceed 280 cubic yards due to the need to compact the dirt solidly.
The soil will be imported from 49 Saddleback Road where we have previously given permission
to remove up to 421 cubic yards in accordance with the Building & Construct -ion Ordinance.
The work will begin on Friday, August 22, 1997 and the estimated date of completion will be
two weeks (September 5, 1997).
Paragraph 3 of Section 15.04.150 of the Rolling Hills Municipal Code permits an exception to
the balanced cut and fill ratio requirement of up to 500 cubic yards of soil to be exported or
imported when a structure cannot be completed without the requested export or import of soil
but this project does not involve the construction of a structure. Therefore, we are making an
Administrative exception in this case in order to repair the horse trail that has been eroded.
As reported, you may import the 280 cubic yards of soil to 20 Buggy Whip Drive from 49
Saddleback Road. The soil exported may only be taken to the trail at the west side of the lot at
20 Buggy Whip Drive as required by the County of Los Angeles.
The City also requires verification by a licensed civil engineer of the quantity of soil and
bedrock imported to the site at the conclusion of final remedial repair of the horse trail.

Thank you for your correspondence dated August 18, 1997 requesting to haul dirt
from the Capifali remedial repair at 49 Saddleback Road, to the Jonas property at 20
Buggy Whip Drive to repair the eroded equestrian trail outside of the easement. We
appreciate you presenting this matter to us.
As you know, the Municipal Code provides for administrative approval for import
and export of soil under certain conditions. We have provided previous approval
(attached) for exportation of 421 cubic yards from the Capifali property. The Jonas
residence, as you know, does not fall under the construction exception for the
importation of soil.
However, after reviewing this request carefully, and viewing the site in the field, we
have determined that special circumstances exist in this case and it is appropriate to
repair this specific equestrian trail which has been damaged by erosion. Therefore,,
we will conditionally grant your request following receipt of the following:
• Submittal of written authorization from the Capifalis and/or their
representative that they approve of this soil being exported to the Jonas property.
Previous approval for soil exportation from the Capifali's property was based on
a request that soil would be taken outside of the City.
• Clarification of the quantity of soil to be imported to the Jonas property. Based
upon our review of your request, repair of a surface area of 1,750 square feet with
a depth of less than 3 feet will require less than 200 cubic yards of soil. However,
there may be compaction issues which have not been presented. Your written
clarification of the exact quantity of soil proposed for importation to the Jonas
site is necessary to approve this request. However, under no circumstances can
this importation exceed 500 cubic yards or be imported in a manner that would
necessitate a grading permit (more than 2,000 square feet of surface area or an

increase/decrease in elevation of more than 3 feet). The exportation from the
Capifali property is strictly limited to 421 cubic yards per the attached
correspondence.
• Submittal of a written schedule of when you plan to conduct this exchange of
soil. Staff will inspect the Capifali site prior to exportation, and along with the
assistance of the County, inspect the importation of soil at the Jonas site as this
job is ongoing and competed.
• At the conclusion of this job, you must provide a written report on the exact
quantity of soil that has been relocated.
Please understand, we are approving this request based upon your letter which
indicates that this soil will not be used for the development of additional building
pads. It will only be approved for repair of the equestrian trail at the northerly
portion of the Jonas property at 20 Buggy Whip Drive. If, during our inspections, it
is determined by either City staff or the County, that this soil is being imported for
purposes other than stated in your correspondence, we will immediately order the
work halted and removal of the soil and restoration of the Jonas property to its
condition prior to this request. This conditional approval should not be construed
as approval for the movement of soil in any other situations in the City.
We appreciate you placing this request in writing. Clearly, all parties are being best
served by presentation of this request and allowing the City to address this matter
before the fact.
You should also understand that the Planning Commission has approved a staff
recommendation to consider a Municipal Code amendment that would outline the
procedures for staff to use to approve these types of requests in the future.

response prior to commencement of trail restoration activities.

Laboratories. Mr. Sheller requests exportation of soil from the subject site due to the need to
drill friction piers, trench the grade beams that will connect the piers, and trim a 1.5:1 fill slope
to a 2:1 gradient as required by the County. Mr. Sheller states that 421 cubic yards of soil will
need to be exported.

Proposed Residential Addition,
Guest House and Swimming Pool

Dear Sir:
In accordance with Sections 15.04.150 through 15.04.180 of the Rolling Hills Municipal
Code, this written request for exportation of soil is submitted. Soil exportation, resulting as
a consequence of the construction procedures described in the following paragraphs, will be
required in order to bring the subject property and existing improvements into conformance
with Section 111 of the Los Angeles County Building Code.
The existing single family residence is constructed on a building pad having a cut/fill
transition, with the south foundations constructed into bedrock and the north foundations
constructed into fill soils. The fill soils exist in an inclined wedge on a colluvial layer that
was not removed prior to placement of the fill soils. The inclined nature of the fill and
colluvium make the units creep prone and the overlying structure subject to potential
settlement and horizontal movement. As a consequence of these geologic conditions, it is
necessary to underpin the portion of the residence that is supported by the fill soils and
colluvium into bedrock using friction piers and grade beams. Drilling friction piers and
trenching the grade beams that will connect the piers will generate soil and bedrock that will
have to be exported from the site.
Portions of the fill and cut slopes that exist to the north and south of the existing residence,
respectively, were constructed at a steeper gradient (portions of which are approximately 1.5
horizontal to 1 vertical) than the 2:1 gradient presently allowed by code. We have performed
a gross and surficial stability analysis on these slopes. The calculated gross factor of safety
for the fill slope is less than the accepted engineering standard of 1.5. In order to improve
the factor of safety, it will be necessary to trim the fill slope to a 2:1 gradient. Trimming the
slope will generate additional soil to be exported from the site.

South Bay Engineering is the Civil Engineering Company of Record for the proposed
project. They have calculated that approximately 331 cubic yards of soil will be generated
during the proposed site grading and trimming of the existing 1.5:1 fill slope. We estimate
that on the order of 90 yards of soil and bedrd'ck will be generated from the friction pier and
grade beam construction operation. The total estimated quantity of soil and bedrock to be
exported from the site will be 421 yards.
A representative of Western Laboratories will observe the drilling of the friction piers and
excavation of the grade beams for conformance with the approved plans. We will estimate
the quantity of soil and bedrock exported from the site based upon the number and volume
of export trucks. It shall be understood by the Project Contractor and the Homeowner that
this information is required by the City of Rolling Hills Municipal Code. Representatives
of Western Laboratories will only be able to verify the amount of soil exported from the site
at times when we are notified that trucking will be conducted and we are on -site to verify the
amount of export.
Failure to notify Western Laboratories that soil is to be exported and allowing us to measure
the number of trucks and their respective volumes will be in violation of the requirements
of the City of Rolling Hills Municipal Code. This will also be considered as a breach of our
agreement to provide this service on behalf of the homeowner and will result in a cessation
of our services.
Western Laboratories will issue a letter stating the quantity of soil that was actually
exchanged, the quantity of soil per truck, and the number of truck trips upon completion of
the exportation operation, provided we are present at the site when each truck is loaded and
ready to depart.

This letter is in response to your inquiry about the procedures to allow the construction of
a retaining wall in the rear yard at 20 Buggy Whip Drive.
From the plan that you provided and from our conversation, I am unable to determine the
entire scope of the proposed project. I hope that this letter will clarify the City's
requirements, so that you can provide us with sufficient information to determine how to
further advise you.
Pursuant to the City's Zoning Ordinance and City's policy, a wall, including a retaining
wall, not to exceed three feet in height may be constructed, provided the construction
does not trigger grading and the wall is not located in any required setbacks.
Section 15.04.120 of the City of Rolling Hills Municipal Code state "A person shall not
perform any grading without first obtaining a grading permit to do so from the Building
Official". Grading is defined as soil excavation and/or soil fill or a combination thereof,
which is more than three feet below or above the existing ground surface and/or covers
more than 2,000 square feet of existing ground surface area. Pursuant to Section
17.46.020 of the Zoning Ordinance, a Site Plan Review is required for any grading which
requires a grading permit.
In your case, a portion of the proposed wall is more than three feet in height and falls
under the "grading" requirement, and therefore, is subject to a Site Plan Review by the
Planning Commission. In addition, you need to provide us with calculations of how much
surface area will be graded and/or disturbed to create the area, which will be retained by
the wall. If the wall or the cut/fill soil is more than 3 feet in height or the grading covers
more than 2,000 square feet of surface area, a Site Plan Review approved by the Planning
Commission would be required.

Site Plan Review permits are considered and decided upon by the Planning Commission
following the submittal of appropriate application, reports, fees, public hearings and site
investigation. The Planning Commission meets once a month, and it usually takes three
to four months to have a project reviewed by the Planning Commission.
Therefore, your first step would be to calculate the disturbed or graded area for this wall.
If the surface area of grading or disturbance does not exceed 2,000 square feet and if the
wall could be reduced to not to exceed three feet along its entire length, then staff would
be able to approve such a wall administratively (over-the-counter). Prior to issuing a
building permit, staff and the Building Official would inspect the property to verify the
size of the affected area.
