Section 17.24.050 pertains to "primary residential structures". A guest house is an accessory structure, and therefore Section 17.24.050 B (All other structures) would apply in your case. Therefore, as stated in my letter to you dated May 20, 2004, you have an option to apply to the Planning Commission for a Conditional Use Permit and possibly for a Variance, (depending whether it is determined that the guest house was located in the rear setback or in the side yard) to reconstruct the guest house. This process takes approximately 3-4 months from submittal of a completed application to the City Planning Department. Dear Ms. Schwartz: I am responding to a fax of your letter of May 20t. I have lived in this home for thirty years and was not aware of any problem with the guest- house until December, 1998 when I wanted to create bedrooms for my new wife's children. I was told I was not permitted to add to the original structure until I applied for approvalto legitimize the guest- house and a small building at a lower level of the lot; Apparently, the city had no evidence of permits for these buildings. I received a letter. from the city attorney stating that these buildings were illegal and I would have to apply as if the buildings were not there. Then, I felt it was easier to use the house as it was and to forget about adding to the original structure. The fire occurred on May 29,2003 and the following Monday Mr. Nellis and yourself came to my residence and took a gander at the charred remains of the building. At that time Mr. Nellis told me to get in touch with him if I decided to rebuild it. Since then I have had numerous meetings with the insurance company to assess the value of the loss and had not decided whether or not to replace it. The insurance company had determined that the house was a total loss except for the foundation and allowed me funds for demolition and as well as some money to reconstruct the house. They recently sent me a letter indicating the final funds would be distributed to me as long as it was done by November, 2004. That is when I felt that if I were to rebuild something similar I would have to start now. I spoke to you on May I 1 th at the Rolling Hills office and you wanted to do some research before you could address the problem. After some telephone conversations with you, you told me I would receive a letter about the decision to replace the building. You sent me a copy of the Municipal Code with an arrow pointing. to 17.24.050 ,B explaining that this is the rule•governing•your decision. However, according to thecopy of the code sent to it seems that,17.24.050 A should be: applicable;; because it was a legally established structure even if it may have been non -conforming. . • . It would seem to me that as long as the building was to be built now with a permit, there should be no problem. You have informed me that after the fire you demolished the entire structure and wish to rebuilt it in the previous foot print. After the guest house was built, the City adopted setback requirements and limits on structural lot coverage. It is my understanding that the guest house, prior to the damage, did not meet these requirements and was therefore, "nonconforming" under the current codes. Although no building permit for the quest house has been located, if a building permit was issued for the guest house it would be regarded as a "legal nonconforming structure". The reconstruction of legal nonconforming structures is governed by the Municipal Code. Specifically, pursuant to Section 17.24.050 B, any nonconforming accessory structure may be restored "provided such destruction does not exceed fifty percent of the assessed value of the structure." By demolishing the entire structure, this condition cannot be met, as the new construction will be 100 percent of the value of the structure. In addition, we have researched the City's records, the Los Angeles County Building and Safety records and the Rolling Hills Community Association records and cannot determine if the guest house was constructed legally, meaning with building permits. You have yourself informed me that you think the guest house was built without permits, and that you have purchased the property as it was prior to the fire, with the guest house. Section 15.04.010 of the Rolling Hills Municipal Code and Section 106 of the Uniform Building Code, which the City of Rolling Hills adopted by reference, require that "No person shall erect, construct, enlarge, alter, repair, move, improve, remove, connect, convert, demolish or equip any building, structure or portion thereof, or automatic fire - extinguishing system regulated by Chapter 9 of the Building Code, perform any grading, or perform landscaping as regulated by Chapter 71, or cause the same to be done, without ©Printed on Recw:Ied p;ipx,i obtaining a separate permit for each such building, structure, automatic fire extinguishing system, grading or landscaping from the building official". Since we cannot establish that the guest house was built legally, pursuant to the City Codes, this structure cannot be rebuilt with an administrative approval by staff. Exemption from the permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of other laws or ordinances. 106.4 Application for Permit. 106.4.1 Application. To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished for that purpose. Every such application shall: 1. Identify and describe the work to be covered by the permit for which application is made. 2. Describe the land on which the proposed work is to be done by lot, block, tract and house and street address, or similar descrip- tion that will readily identify and definitely locate the proposed building or work. 3. Show the use or occupancy of all parts of the building. 4. Be accompanied by plans and specifications as required in Section 106.4.2. 5. State the valuation of the proposed work or, for grading, the volume of earth to be handled. 6. State the area in square feet (m2), to be landscaped and the source of water for irrigation. 7. Be signed by the permittee, or an authorized agent, who may be required to submit evidence to indicate such authority. 8.
