631, Construct barn in front yard, Resolutions & Approval Conditions• • RESOLUTION NO. 2002-12 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS APPROVING A MODIFICATION TO PLANNING COMMISSION RESOLUTION NO. 2001-13 AND APPROVING AN EXTENSION TO PREVIOUSLY APPROVED SITE PLAN REVIEW FOR THE CONSTRUCTION OF A STABLE WHICH REQUIRES GRADING IN ZONING CASE NO. 631, (HEINDL). THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. A request has been filed by Dr. and Mrs. Heindl with respect to real property located at 80 Saddleback Road, Rolling Hills, requesting an extension to previously approved Site Plan Review for the construction of a stable, which requires grading. Section 2. The Commission considered this item at a meeting on June 18, 2002, at which time information was presented indicating that the extension of time is necessary in order to complete grading plan check processing. Section 3. Based upon information and evidence submitted, the Planning Commission does hereby amend Paragraph A, Section 7 of Resolution No. 2001-13, dated June 19, 2001, to read as follows: "A. The Site Plan Review approval shall expire within two years from the effective date of approval as defined in Section 17.46.080(A), unless construction on the applicable structure has commenced within that time period". Section 4. Except as herein amended, the provisions of Resolution No. 2001-13 shall continue to be in full force and effect. THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. An application was duly filed by Dr. and Mrs. Heindl, with respect to real property located at 80 Saddleback Road, Rolling Hills, (Lot 67- RH), requesting a Site Plan review to construct a 2,664 square foot Ring-O-Steel barn with a loft that requires grading at an existing single family residence. Section 2. Originally the applicants filed an application for a 3,456 square foot barn to be located in the front yard area, which required a Variance. At the June 19, 2001 Planning Commission meeting the applicants withdrew the Variance request, and presented a revised Site Plan Review application. Section 3. The Planning Commission conducted duly noticed public hearings to consider the original application on April 17, 2001, May 15, 2001 and conducted a field inspection on May 5, 2001. The Planning Commission conducted a duly noticed public hearing on the REVISED SITE PLAN application on June 19, 2001. The applicants were notified of the public hearings in writing by first class mail. Evidence was heard from members of the City staff, the applicant's representative, and the Planning Commission reviewed, analyzed and studied the project. Section 4. The property is developed with a residence and an attached garage that was built in 1953, and a 300 square foot barn, which will be demolished once the new barn is constructed. Section 5. The Planning Commission finds that the project qualifies as a Class 3 Exemption [The State CEQA Guidelines, Section 15303 (New Construction or Conversion of Small Structures)] and is therefore categorically exempt from environmental review under the California Environmental Quality Act. Section 6. Section 17.46.030 requires a development plan to be submitted for site plan review and approval before any building or structure may be constructed or any expansion, addition, alteration or repair to existing buildings may be made which involve changes to grading or an increase to the size of the building or structure by at least 1,000 square feet and has the effect of increasing the size of the building by more than twenty-five percent (25%) in any thirty-six (36) month period. With respect to the Site Plan Review application, the Planning Commission makes the following findings of fact: Resolution No. 2001-13 ZC No. 631 SPR approval 1 • • 01 1755491 A. The proposed development is compatible with the General Plan, the Zoning Ordinance and surrounding uses because the proposed structure complies with the General Plan requirement of equestrian and low density residential development with sufficient open space between surrounding structures. The project conforms to Zoning Code setbacks and lot coverage requirements. The lot has a net area of 270,080 square feet. The proposed barn (2,664 sq.ft.) will be located on a new pad that requires grading of 975 cubic yards of soil, which will be balanced on site. The new pad will be 8,880 square feet, with a coverage of 30%. The existing 4,088 square foot residence and garage are located on a 23,680 square foot pad, which constitutes 17.3% of the residential building pad. The combined lot coverage will be 6,752 square feet or 20.7%. B. The proposed development preserves and integrates into the site design, to the maximum extent feasible, existing natural topographic features of the lot including surrounding native vegetation, mature trees, drainage courses, and land forms (such as hillsides and knolls). The lot is sloping in a southwesterly direction. Grading of 975 cubic yards of cut and 975 cubic yards of fill will be required, however most of the mature trees and native shrubs will not be removed. C. The development plan follows natural contours of the site to minimize grading and the natural drainage courses will continue to the rear (south and west) of this lot. D. The development plan incorporates existing large trees and native vegetation to the maximum extent feasible. Specifically, the development plan preserves several mature trees and shrubs. E. The development plan substantially preserves the natural and undeveloped state of the lot by minimizing building coverage. The structural lot coverage of the net lot area is 2.5%, and the total structural and paved areas coverage will be at 5.8%, which is within the 35% net lot coverage permitted. The project will be located on a relatively flat portion of the lot, and significant portions of the lot will be left undeveloped. F. The proposed development, as conditioned, is harmonious in scale and mass with the site, the natural terrain and surrounding residences. As indicated in Paragraph A, the maximum permitted lot coverage will not be exceeded and the proposed project is consistent with the scale of the neighborhood when compared to this irregular -shaped lot. G. The proposed development is sensitive and not detrimental to the convenience and safety of circulation for pedestrians and vehicles because the proposed project will use existing driveway. H. The project conforms to the requirements of the California Environmental Quality Act and is categorically exempt from environmental review. Based upon the foregoing findings, the Planning Commission hereby approves the REVISED Site Plan Review application for Zoning Case No. 631 for a proposed barn as indicated on the development plan dated June 6, 2001, incorporated herein as Exhibit A and subject to the following conditions: A. The Site Plan Review approvals shall expire within one year from the effective date of approval as defined in Section 17.46.080(A), unless construction on the applicable structure has commenced within that time period. B. It is declared and made a condition of the Site Plan Review approval, that if any conditions thereof are violated, the approval shall be suspended and the privileges granted thereunder shall be subject to revocation; provided that the applicant has been given written notice to cease such violation and has failed to do so for a period of thirty (30) days and has been provided additional notice and a hearing prior to the revocation of the Permit. C. All requirements of the Building and Construction Ordinance, the Zoning Ordinance, and of the zone in which the subject property is located shall be complied with unless otherwise set forth in this permit. D. The lot shall be developed and maintained in substantial conformance with the site plan dated June 6, 2001 as amended, and marked Exhibit A, except as otherwise provided in these conditions. E. The working drawings submitted to the County Department of Building and Safety for plan check review must conform to the development plan approved with this application. F. The structural lot coverage shall not exceed 2.5% of the net lot area and the total net lot coverage including all paved area and structures shall not exceed 5.8%. G. The residential building pad coverage shall not exceed 17.3%, and the barn building pad coverage shall not exceed 30%. Total building pad coverage shall not exceed 20.7%. H. The maximum disturbed area shall not exceed 17.6% of the net lot area. I. The barn shall not be located on a portion of the lot where the slope is greater than four to one. J. The barn shall be located a minimum of thirty-five feet from any residential structures, including garage, and a minimum of twenty-five feet from any property line. K. The barn shall be used for the exclusive purpose of keeping permitted domestic animals. Commercial uses are not permitted. Resolution No. 2001-13 ZC No. 631 SPR approval 3 • • 01 1755491 L. The existing topography, flora and natural features of the lot shall be retained to the greatest extent feasible. M. Landscaping shall incorporate and preserve, to the maximum extent feasible, the existing mature trees and shrubs and the natural landscape screening surrounding the proposed building pad. N. During construction, conformance with the air quality management district requirements, stormwater pollution prevention practices, county and local ordinances and engineering practices so that people or property are not exposed to undue vehicle trips, noise, dust, and objectionable odors shall be required. O. During construction, the Erosion Control Plan containing the elements set forth in Section 7010 of the 1996 County of Los Angeles Uniform Building Code shall be followed to minimize .erosion and to protect slopes and channels to control stormwater pollution as required by the County of Los Angeles. P. During and after construction, all parking shall take place on the project site and, if necessary, any overflow parking shall take place within nearby roadway easements. Q. During construction, the property owners shall be required to between the hours of 7 AM and 6 PM, Monday through Saturday only, when construction and mechanical equipment noise is permitted, so as not to interfere with the quiet residential environment of the City of Rolling Hills. R. The property owners shall be required to conform with the Regional Water Quality Control Board and County Health Department requirements for the installation and maintenance of septic tanks. S. The property owners shall be required to conform with the Regional Water Quality Control Board and County Health Department requirements for the installation and maintenance of stormwater drainage facilities. T. The property owners shall be required to conform with the Regional Water Quality Control Board and County Public Works Department Best Management Practices (BMP's) related to solid waste. U. Prior to the submittal of an applicable final grading plan to the County of Los Angeles for plan check, a detailed grading and drainage plan with related geology, soils and hydrology reports that conform to the development plan as approved by the Planning Commission shall be submitted to the Rolling Hills Planning Department staff for their review and approval. V. The project must be reviewed and approved by the Rolling Hills Community Association Architectural Review Committee prior to the issuance of any building or grading permit. The approval shall not be effective until the applicant executes and files an Affidavit of Acceptance of all conditions of the Site Plan approval. Y. All conditions of the Site Plan Review approval that apply must be complied with prior to the issuance of a building or grading permit from the County of Los Angeles.
