A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS DENYING A FRONT YARD SETBACK VARIANCE
IN ZONING CASE NO. 373
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
FIND AND RESOLVE AS FOLLOWS:
Section 1. An application was duly filed by Dr. and Mrs.
Samar Sircar for a minimum front yard setback variance for property
located at 58 Eastfield Drive (Lot 103-EF), Rolling Hills,
California. The application seeks a variance to allow a portion of
the garage of a residential reconstruction to be constructed in the
front setback of the property. The proposed encroachment is 12'
where a non -conforming encroachment of 12'.0" exists.
Section 2. The Planning Commission opened the public
hearing on December 20, 1988 and continued it to January 17, 1989. A
duly noticed field trip was conducted on January 14, 1989, to which
the applicant and all members of the public was invited. The
Commission has considered the evidence, both written and oral,
presented to it in connection with this application.
Section 3. In accordance with Sections 17.32.010 through
17.32.030 of the Municipal Code, the Planning Commission finds as
follows:
1. The subject property is not unique, exceptional or
extraordinary in its size, shape or topography.
2. Granting the variance would give to the applicant a
special privilege not enjoyed in other properties in
the same vicinity and zone.
3. The variance is not necessary for the applicant's
ability to enjoy his property to the same extent as
other similar properties in the same zone.
Section 4. In accordance with the foregoing
the variance sought in Zoning Case No. 373 is hereby denied.
