Dear Dr. and Mrs. Gianconi:
This is a follow-up reminder (first letter July 29, 2010) that you need to complete all
conditions/findings of approval that are a part of Resolutions 2008-09 and 2010-12,
approving a CUP and Variance for a tennis court and 10-foot tall perimeter fencing.
There are three outstanding items listed below. It is requested that you complete all
three requirements no later than November 30.2010.

2. You need to obtain a building permit for the portions of the fence (on the
ground or atop a retaining wall) that are over 6 feet in height. (Finding C. Reso.
2008-09, and RHMC Title 15-Building Regulations) Take plans to the Los Angeles
County Public Works, Building and Safety Permit Office, in Lomita (info: LACO
phone 310- 534-3760).

Dear Dr. and Mrs.Giaconi:
This letter shall serve to notify you that the City Council at their regular meeting on July 26,
2010 approved your project.
Before this case takes effect you are required to record an Affidavit of Acceptance Form
together with the subject Resolution in the Office of the County Recorder.
Please assure that the conditions of approval are met no later than SEPTEMBER 30,
2010. They include adding additional screening along the tennis court, so it is not visible from
the road and obtaining a building permit from Los Angeles County Building and Safety
Department. The Building Code requires that any fence 6' or higher has a permit.
I am enclosing two copies of RESOLUTION NO. 2010-12, specifying the conditions of
. approval set forth by the Planning Commission to keep one in your files and record the other.
Please complete the enclosed AFFIDAVIT OF ACCEPTANCE FORM, have the signature(s)

DEVELOPED WITH A SINGLE FAMILY RESIDENCE IN ZONING CASE
NO. 752-MODIFICATION, AT 92 SADDLEBACK ROAD, (LOT 73-B-RH),
(GIACONI). PROJECT HAS BEEN DETERMINED TO BE EXEMPT FROM
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Dr. Mirko Giaconi with respect to
real property located at 92 Saddleback Road, (Lot 73-B-RH), Rolling Hills, requesting a
modification of a previously approved tennis court fence to allow the retention of an as
built 10-foot fence. Pursuant to Resolution No. 2008-09 an 8-foot high tennis court fence
was approved.
Section 2. The Planning Commission conducted duly noticed public hearings
to consider the application for modification of the previously approved application on
June 15, 2010 and at a field visit to the property also on June 15, 2010.
Section 3. The applicant and neighbors were notified of the above -referenced
hearings in writing by first class mail. Evidence was heard and presented from all
persons interested in affecting said proposal, from all persons protesting the same, and
from members of the City staff at each of the hearings. The applicant's representative
was in attendance at the hearings.
Section 4. The Planning Commission finds that the project qualifies as a
Class 1 Exemption [State CEQA Guidelines, Section 15301(e)] and is therefore
categorically exempt from environmental review under the California Environmental
Quality Act.
Section 5. The previous approval, granted by Resolution No. 2008-09
consisted of a Conditional Use Permit for a 5,780 square foot tennis court and a
Variance to locate it in the front yard area of the property. One of the conditions of
approval was that the tennis court be screened from all four sides and that the fence
does not exceed 8 feet in height. The applicant's contractor constructed a 10-foot fence.
The Planning Commission also found that the tennis court is not adequately screened
on the northwestern side of the court.
Section 6. The Rolling Hills Zoning Ordinance does not specify the height of
a tennis court fences. The Planning Commission from time to time places conditions on
a development stipulating the height of a tennis court fence. The Rolling Hills
Community Association Building regulations contain a provision that a tennis court
fence not be higher than 10 feet.

that you need to complete all conditions/findings of approval that are a part of
Resolutions 2008-09 and 2010-12, approving a CUP and Variance for a tennis
court and 10-foot tall perimeter fencing. When you signed and recorded these
resolutions you have agreed to all of the conditions therein. These resolutions
are a legal document recorded on your title. There is one outstanding item listed
below that needs your attention. It is requested that you complete this task no
later than September 1, 2011.
The outstanding item is:
1. A building permit for the tennis court fence must be obtained. All fences
over 6' in height require a building permit. Please contact or visit the Los
Angeles County Building and Safety Permit Office at 24320 Narbonne
Ave, in Lomita, phone 310- 534-3760 to obtain the permit.
Failure to obtain a building permit may result in the revocation of the Variance
and the Conditional Use permit approval for the tennis court.

ZONING CASE NO. 752 Modification of tennis court.
Dear Dr. Giaconi:
The Planning Commission scheduled a public hearing and a field trip to your property to,
view the as built fence on Tuesday, June 15. 2010 at about 8:30 am.
The Planning Commission's schedule is to visit two other properties before coming to
view your project, therefore the exact time of their visit is difficult to determine.
The owner and/or representative must be present to answer any questions regarding the
project.
Please also be advised that there are several outstanding conditions from the original
approval of the tennis court, which must be addressed. They are:
1. Obtain a building permit for the tennis court fence (any fence over 6 feet tall requires a
building permit).
2. Verification from the Edison Company regarding their easements in the area of the
tennis court and if there are any restrictions.
After the field trip, the next regular meeting of the Planning Commission will take place on
the same day, Tuesday, June 15. 2010 at 6:30 PM at City Hall, at which time the
Commission will further discuss and deliberate your proposal.
