The City Council of Rolling Hills has enacted Resolution Ho. 501
(see attached) which denies in part your requests for encroachments
into the front yard at #92 Saddleback Road. The tennis court variance
for placement is denied approval, although the cabana and swimming
pool remain intact as approved by the Planning Commission. The
resolution outlines the parameters under which the case was processed.

We have obtained the approval of a swimming pool, jacuzzi and
cabana in the "front yard", by the Planning Commission. However,
we are at this time, in behalf of Dr. Mirko Giaconi, appealing the
denial of the request for a tennis court.
We are appealing the denial because the Planning Commission took
a blunt stand on Code Ordinance 17.16,012 F-3 "courts shall not be
located in front yard".
We are preparing more evidence to prove that the tennis court would
not create an environmental impact on the property and surrounding
area. We are going to create a complete bowl effect where even the
fence would not be seen from the street nor the neighbors.

Confirming our telephone conversation this morning, I have
enclosed the following:•
1. Copy of a letter dated August 20, 1982 from the City
Manager to Dr. Giaconi, giving notice of the decision
of the Planning Commission.
2.. Requirements for filing an appeal, which must be done
within 20 days of the date of the notice (August 20).
3. Fee schedule (Resolution No. 494) for filing an appeal.
4. Excerpts from the minutes of the City Council on
August 23, 1982, advising the Council of the Planning
Commission's action. Since the Council did not take
any action the Planning Commission's decision will
become final unless an appeal is filed.
Please call me if you have any questions. The City Hall will be
closed on Monday, September 6 in observance of Labor Day and Thursday,
September 9, which is Admission Day.

Dear Dr. Giaconi:
This letter will serve as notice pursuant to
Section 17.32.090 of the Rolling Hills Municipal Code
relative to a decision of the Planning Commission on
Zoning Case No. 278. The Planning Commission denied
your request for a tennis court and approved a
swimming pool,-jacuzzi, and cabana in the front yard.
This letter shall serve as a copy of the decision of
the Planning Commission. The formal report of the
Planning Commission as required by Section 17.32.086
of the Municipal Code is contained within the minutes
of the proceedings before the Commission.
On Monday,August 23, 1982 the City Council of
Rolling Hills will review the decision of the Planning
Commission pursuant to Section 17.32.140 of the Municipal
Code.
