However, we are at this time, in behalf of Dr. Mirko Giaconi, appealing the denial of the request for a tennis court. We are appealing the denial because the Planning Commission took a blunt stand on Code Ordinance 17.16,012 F-3 "courts shall not be located in front yard". We are preparing more evidence to prove that the tennis court would not create an environmental impact on the property and surrounding area. The Planning Commission denied your request for a tennis court and approved a swimming pool,-jacuzzi, and cabana in the front yard. This letter shall serve as a copy of the decision of the Planning Commission. The formal report of the Planning Commission as required by Section 17.32.086 of the Municipal Code is contained within the minutes of the proceedings before the Commission.
