ORDINANCE NO. 187
AN ORDINANCE OF THE CITY OF ROLLING HILLS
PROVIDING FOR TEMPORARY RESIDENTIAL.USES
IN ACTIVE LANDSLIDE AREAS AND AMENDING THE
ROLLING HILLS MUNICIPAL' CODE
The City Council of the City of Rolling Hills does
ordain as follows:
Section 1. Title 17, Chapter 17.16 of the Rolling
Hills Municipal Code is amended by adding a new paragraph E
to Section 17.16.010 to read:
"E. A mobilehome or trailer as a temporary use,
upon approval of a special permit by the Planning Commission
subject to the following requirements:
1. • A written application therefore is submitted to the
Planning Commission by any property owner whose primary
residence is endangered by an active landslide and who
seeks to place a mobilehome or trailer on the same lot
as the primary residence to serve as temporary living
quarters. Such application shall be in the form and
shall contain such information as is prescribed by the
City Manager, including but not limited to site plan, an
engineer or architect's report describing the damage to
the primary residence, and a report by a licensed geologist
stating that the placement of a mobilehome or trailer on
the property will not aggravate the existing slide or cause
a safety hazard. The application shall be..accompanied by
an application fee determined by the City Council.
2. The Commission shall consider and decide upon the . -
application within sixty (60) days of filing of a completed
application, unless such time is extended by agreement of
the applicant. Prior to taking its decision the Commission
stall conduct a duly noticed public hearing at which evidence
may be submitted by interested parties.
3. The Commission may grant approval of the special permit
if 1.-t.:is .able to make'affirmative findings as follows:
(a) There is a presently occupied primary residence
on the property which has been rendered uninhabitable
by an active landslide;
(b) Placement of a mobilehome or trailer on the
property will not create a geologic hazard or other-
wise be detrimental to the public health, safety and
welfare.
(c) The applicant has presented facts demonstrating
a necessity for temporary alternative living arrange-
ments during the pendency of an active landslide.
4. Any approval may be subject to such conditions as will
assure that the placement of a mobilehome or trailer on the
property will be temporary and accomplished in accordance
with the public health, safety and welfare, including but
not limited to the following conditions:
(a) The mobilehome or trailer shall not be placed on
a permanent foundation.
(b) All utilities shall be above -ground and adequate
above -ground storage tank facilities shall be provided
for sewerage and provisions shall be made for the
regular pumping of such tank facilities.
(c) The specific location of the mobilehome or trailer
on the property shall be subject to approval by the
Commission.

(d) Conditions shall be imposed to ensure that the
visual impact of the mobilehome or trailer is as
harmonious as reasonably possible with the neighborhood.
(e) The primary residence shall not be occupied while
.the mobilehome or trailer remains on the property.
Gas and electric utilities'shall•be disconnected from
the primary residence unless the Commission determines
otherwise. The mobilehome or trailer may only be
occupied by the applicant.
(f) The owner shall enter into an agreement holding
the City harmless for any liability resulting from
placement of the mobilehome on the property.
(g) Assurances acceptable to the City are received
which ensure the removal of the mobilehome or trailer
and all appurtenances thereto at the expiration of
the permit. -
5. The approval by the Commission shall be for a period
not_•to exceed twelve (12) months. The Commission may approve
an unlimited number of time extensions of up to twelve (12)
months each provided that it is able to make the findings
required by paragraph (4) hereinabove. A public hearing.
shall be required for approval of extensions.

6. Any decision of the Planning Commission pursuant to this
section may be appealed to the City Council by any interested
person in accordance with the provisions ofSections 17.32.140-
17.32.220 of this Title.
7. The mobilehome or trailer shall be removed from the.
property upon the happening of any of the following:
(a) The Commission or City Council on appeal declines
to approve a time extension for the approval;
(b) The owner resumes occupancy of the primary residence;
•(c) The property is sold, rented or leased; or
(d) The Commission or the City Council finds that the
primary residence is no longer endangered'by a landslide.

"DUTIES AND GOALS OF COMMISSIONS
In the discussion that followed formation of the Commissions, the
following duties and goals of the Commissions were outlined: 1)Immediate
Disaster Relief, 2) Review of Fire Department and Sheriff Department
responsibilities, and evaluation of criticism, 3) Contact with County
agencies regarding re -seeding and re -planting of fire damaged areas, and
4) Education Of residents regarding plans for evacuation in future emer-
gencies.
INFORMATION SHEET
Members of the Council reviewed an information sheet prepared for
residents whose homes were destroyed in the fire, advising as follows:
1) The Rolling Hills City Engineer will issue a permit for a period
not to exceed 12 months to use or occupy a trailer as a residence of the
owner of the premises on which an existing residence was damaged or des-
troyed by a major disaster within the previous six months.
(,gip 2) Plan Check and Building Permit fees for reconstruction will be
e-{ waived by the Association and City for owners of record at the time the
home was destroyed. The City Attorney was requested to prepare a reso-
= lution of the City Council authorizing the County Engineer to waive
City charges. Fees for modifications, variances or conditional use
permits granted by the Planning Commission were also waived.
3) Members of the Planning Commission, Architectural Committee
and Landscape Committee will meet as often as necessary in order to
expedite building plans.
4) The City Council and Board of Directors directed that all swim-
ming pools on properties where homes have been destroyed must be drained
and cleaned at City expense. Pools on properties which will not be in-
habited (trailer or motor homes) must be fenced with a six foot high
chain link fence as soon as possible.
5) A geologist from the Los Angeles County Engineering Geology
Department will inspect all destroyed homesites during the week of
July 3rd, and make recommendations to the City Manager relative to
requirements based on the following three conditions:
1) Reconstruction on existing foundation (no change)
2) Reconstruction on a part of existing foundation (partial
change in house pla
3) Complete new house plan with no utilization of existing
foundation.

6) Property Tax information necessary to get relief for 1973-74
tax bill was furnished.
7) Copies of Publication 547, Internal Revenue Service re: TAX
INFORMATION ON DISASTER, CASUALTY LOSSES &HEFTS is available at the
City Office.
8) Slope planting, trimming of damaged trees and seeding of
burned slopes is being reviewed by scientists from the Los Angeles
County Arboretum.
9) Allwaiving of fees and other emergency actions apply only to
owners of record at the time the home was destroyed.
The City Manager advised that a Supplemental Information Sheet
had been prepared containing the following items of information:

1) Fire retardant roof materials which have been approved by the
Architectural Committee
2) Names of persons who may be contacted for demolition work
3) Names of fence contractors who have road use permits who can
give estimates on chain -link fencing for swimmimg pools
4) The name of the engineering geologist most familiar with the
Rolling Hills area
WAIVING OF COUNTY FEES
Mayor Bear requested that the City Attorney contact the County
Counsel to.'determine whether County fees can be waived as well as
City fees, and report to the Council.
FIRE RETARDANT ROOFS -MORATORIUM ON ISSUING BUILDING PERMITS
Councilman Pearson moved that a moratorium be placed on all con-
struction requiring roofs, and that no building permits be issued
until a review has been made of requirements for fire -retardant roof-
ing. The motion was seconded by Councilman Heinsheimer and carried
by the following roll call vote:
AYES: Councilmen Battaglia, Heinsheimer, Hesse, Pearson

ABSENT: None
Mayor Bear directed the City Attorney to prepare an ordinance
requiring fire retardant roofing for Council review.

heimer, seconded by Councilman Pearson and carried by the following
roll call vote:

RESOLUTION NO. 297
A RESOLUTION Of THE CITY COUNCIL OF THE CITY OF ROLLING
HILLS, CALIFORNIA, PROCLAIMING A LOCAL EMERGENCY IN THE
Gill?. OF ROLLIN HILLS
WH.EE. AS, an extensive brush fire occured in the City of
Roiling Hills on 3.1;22, 1973., resulting from sources outside the
City limirs of said City; and
WHEREAS, said fire did, in due course, consume and burn to
the ground ten residential structures belonging to residents of the
City of Rolling Hills, and partially damage other structures; and
WHEREAS, much of the area in which said residences and
structures were located was made unusable;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Roiling Hills does proclaim that a local emergency
exists in said City as a local emergency is defined in Section 8558
of the Government Code, in the areas known as "Flying Triangle" and
"Southfield", which may cause extreme peril to the safety of persons
and property within the above defined areas;
BE IT FURTHER RESOLVED that this Resolution be spread
upon the minutes of the meeting of the City Council of June 25, 1973,
and certified copies thereof be forwarded as required to the agencies
requesting the same.
