I am Fritz Hartwig living at 3 Pinto Road, Flying Triangle.
I have been a resident for 20 years.
My house is completely inhabitable but it has developed a
few cracks primarily in the foundation and I am in the process of
repairing it and curing the problem. The technique I am using
was used successfully many times in Portuguese Bend, San
Francisco, Portolla Valley and on the Eastern seacoast.
If I am successful, others will follow my lead and at least
95% of the homes in the Flying Triangle can be saved. If I am
not succcessful, I doubt if anyone else will have the talent or
courage to try and the City will have a disaster area.
In order to be assured that the beauty of our area is
preserved, I submitted my repair plans to the Architectural
Committee where they were approved together with many words of
encouragement and support.
While the foundation is being repaired, we will move out.
As a convenience to allow me to more closely supervise and
expedite the work and protect my house, it seemed logical to live
on site in a house trailer, recreation vehicle or camper, etc. A
house trailer was shown on my plans.
Although it is legal to have mobile homes on foundations,
three recreation vehicles, boats and trailers, horse trailers,
etc., the fact that I would like to use a recreational vehicle on
site has caused an explosion.
I am told I must put up a $3500 bond to assure that I won't
decide that living in a 500 square foot trailer is superior to
living in my 3000 square foot house. Since the cost to remove
the trailer is only $125, I assume the other $3375 is some form
of punitive figure. :Next I am told by letter that I must hire
an;
architect
civil engineer
map maker
someone to measure my buildings
surveyor
sewage expert
geologist
and that I must build a new unneeded sewage system.
And finally, I am told I must pay the City a $500 fee
presumabably as compensation for all the trouble I am causing it.

Gentlemen, I am asking for relief since I believe this
burden is both inappropriate and unnecessary. I am merely asking
permission to occupy a recreation vehicle (trailer) for a few
months. The trailer weighs little more than my station wagon and
will not affect the environment. If I am forced to live in a
motel, I will have to hire a guard to protect my home, the repair
work will be slowed considerably, and other residents will be
discouraged further from following my example.
I hereby request that my trailer be approved under Chapter
17.16.011 and that the burdens of 17.16.010.E not be imposed.

In response to your letter dated July 11, 1984, an application
for a Specil Permit for Temporary Residential Uses is enclosed. I
believe the application is clear inits requirements, but if you
have any questions please do not hesitate to call me.
It is customary for the Planning Commission to schedule a
field trip after considering an application for Variance or Condi-
tional Use Permit before making a decision, such decision usually
being made at the meeting following the public hearing. Because
of the nature of your request and the accompanying time constraints,
a copy of your letter will be presented to the Planning Commission at
the next regular meeting on Tuesday, July 17, 1984 and the Commission
will be askedto schedule a trip to your property while making other
field trips in connection with hearings at the July meeting. In that
way your request can be considered and a decision can be made at the
August meeting to avoid delay, provided your application is filed in
accordance with the requirements specified in the application. The
decision of the Planning Commission will be reviewed by the City
Council at the next regular Council meeting, pursuant to requirements
of the Municipal Code.

In accordance with your attached letter, I am pleased to
submit this request for permission to temporarily place a house
trailer on our property.
Our home has developed a few cracks due to earth movement.
Although the house is completely functional, I believe it would
be prudent for me to make corrective repairs now before serious
damage occurs. These corrective repairs necessitate moving out
of the house for a few months, during which time it would be more
efficient and most convenient if we could occupy a house trailer
on site.
I believe we will comply with all aspects of the City code
17.16.010, except for paragraph 4b. which requires above ground
utilities. Mr. Hoffman of Hoffman and Sons who installed our
cesspool/septic tank and sewer system says that the 3" sewer line
from the trailer can be connected directly into the house sewer
system through a hole in an existing manhole cover. He is
prepared to do so with your permission. The current house sewer
system was completely refurbished 7 months ago by Mr. Hoffman and
is 100% functional today. The trailer will be approximately 20
feet from the manhole cover and about 7 feet above it, thus
providing exceptional drainage.
The trailer will be parked on the southwest corner of our
paved parking area. Since it weighs roughly the same as our
station wagon currently parked there and will have no other
influence on the environment, its presence will not aggrevate the
slide or be a safety hazard.
As a trained engineer, I believe this trailer will be
handled in a manner which fully complies with the purpose for
which City code 17.16.010 was created. As a resident, I believe
the City will benefit if this trailer is approved because it will
enable me to more efficiently and rapidly make the necessary
corrective repairs and alleviate a potential future problem.

• 17.16.010 Permitted uses. Uses. permitted in the RA-S
zone are as follows:
A. Residence, single-family;
B. Mobileho^e on a permanent foundation;
C. Tree, bush or field crops, provided that no odor or.
dust producing substance or use is permitted within one
hundred feet of any property line. Retail sales from the
premises are specifically prohibited;
D. Domestic Animals, Noncommercial. The keeping of
domestic animals other than swine is permitted provided
all shelters for the keeping of horses, cows, goats or other
farm pets are located not less than thirty-five feet from
any residence and not less than twenty-five feet from any
property line. Corrals must be located not less than thirty-
five. feet from any residential .structure.
E.. ~..A mobile::. home:.: or trailer as a temporary use, upon
approval of a special permit by the Planning Commission subject
to the following requirements:
1. A written application therefor is submitted to
the. Planning Commission by any property owner whose primary
residence.is endangered by an active landslide and who seeks
to place_�a mobile home or trailer on the same lot as the
primary residence to serve as temporary living quarters.
Such application shall be in the form and shall contain such
information as is prescribed by the City Manager, including
but not limited to site plan, an engineer or architect's
report describing the damage -to the primary residence, and a
report by a licensed geologist stating that the placement
of a mobile home or trailer on the property will not aggravate
the existing slide or cause 'a safety hazard. The application
shall be accompanied by an application fee determined by the
City Council.
2. The Commission shall consider and decide upon the
application within sixty days of filing of a completed appli-
cation, unless such time is extended by agreement of the
applicant. Prior to making its decision the Commission shall
conduct a duly noticed public hearing at which evidence may
be submitted' by. interested parties.
3. The Commission may grant approval of the special
permit if it is able to make affirmative findings as follows:
a. There is a presently occupied primary residence
on the property which has been rendered uninhabitable by an
active landslide.
b. Placement of a mobile home or trailer on the
property will not create a geologic hazard or otherwise be
detrimental to the public health, safety and welfare.

c. The applicant has presented facts demonstrat-
ing a necessity for temporary alternative living arrangements
during the pendency of an active landslide.
4. Any approval may be subject to such conditions as
will assure that the placement of a mobile home or trailer on
the property will be temporary and accomplished in accordance
with the public health, safety and welfare, including but not
limited to the following conditions:
a. The mobile home or trailer shall not be placed
on a permanent foundation.
b. All utilities shall be above -ground and adequate
above -ground storage tank facilities shall be provided for
sewerage and provisions shall be made for. the regular.pumping
of such tank facilities.
• c. The specific location of the mobile home or
trailer on the property shall be subject to approval by the
Commission. ..
d. Conditions shall be imposed to ensure that the
visual impact of the mobile home or trailer is as harmonious
as reasonably possible with the neighborhood.
e. The primary residence shall not be occupied
while the mobile home or trailer remains on the property..
Gas and electric utilities shall be disconnected from the
primary residence unless the Commission determines otherwise..
The mobile home or trailer may only be occupied by the ap--
plioant.
f. 'The owner shall enter into an agreement holding
the City harmless for any liability resulting from placement
of the mobile home on the property.
g. Assurances acceptable to the City are received
which ensure the removal of the mobile home or trailer and'
all appurtenances thereto at the expiration of the permit.
5. The approval by the Commission shall be for a
period not to exceed twelve months. The Commission may
approve an unlimited number of time extensions of up to
twelve months each; provided that it is able to make the
findings required by subdivision 4 of this subsection. Aj.
public hearing shall be required for approval of extensions.
6. Any decision of the Planning Commission pursuant
to this section may be appealed to the City Council by any
interested person in accordance with the provisions of
Sections 17.32.140 through 17.32.220 of this title.
7. The mobile home or trailer shall be removed from
the property upon the happening of any of the following:
a. The Commission or City Council on appeal
declines to approve a time extension for the approval;
b. The owner resumes occupancy of the primary
residence;.

TEMPORARY RESIDENTIAL USES -ACTIVE LANDSLIDE AREAS
AUTHORITY
Ordinance No. 187 of the City of Rolling Hills
Title 17, Section 17.16.010, Paragraph E of the Rolling
Hills Municipal Code.
REGULAR MEETINGS
Applications are considered at the regular meetings
of the Planning Commission, which are held on the third
Tuesday of each month. Applications must be submitted to
the City Clerk no later than the last Monday of the month
immediately preceding the regular meeting at which the
matter will be considered. The applicant or a representative
of the applicant must be present at the meeting.
PLAN SUBMITTAL
Seven (7) copies of a plot plan must accompany
the application and must show the following:
1. Name and address of resident and name and
address of the architect and civil engineer.
2. Vicinity map, scale 1:200 feet. Requested
improvements should be dimensioned to property line and
residences of all contiguous properties.
Easements should be shown and dimensioned
on subject property and all contiguous properties, on
property line nearest improvement.
3. North arrow and scale of plans.
4. Existing contours of the entire lot.
5. Gross square footage of pads.
6. All cut and fill.slopes must be shaded.
7. Proposed drainage pattern of pad area must
be shown.
8. Outline of residence and any additional
structures must be shown. All structures must be physically
measured and square footage of each structure must be shown
on drawing. A note must be on the drawing certifying to
those measurements.
9. A current survey, showing all structures on
the property, with their distance from property lines
delineated.
10. Location of all above ground water andutility
liens.
11. Location and description of above ground sewage
disposal system, including capacity and provisions for pumping
of tank facilities.
ADDITIONAL SUBMITTAL REQUIREMENTS
1. Engineer or architect's report describing the
damage to the primary residence.
2. A report by a licensed geologist stating that
the placement of a mobilehome or trailer on the property
will not aggravate the existing slide or cause a safety
hazard.
