Dear Ms. Miner:
As per our conversation of several weeks ago, I have
finally gotten my photographs developed and, in light
of the rainstorm of February 7, 1993, the problem
continues. As you can see from Exhibit A, there are
essentially waterfalls coming over the stone wall and on
Exhibit B, the photograph demonstrates one segment of the
backyard, directly in front of this, essentially being
flooded out, approaching and including the foundation of
the house. Exhibit C demonstrates a road, which I discussed
with you, which leads to the easement between the properties
of Dr. lalston and myself. Exhibit D demonstrates such.
Exhibit E, besides demonstrating where the road ends, also
demonstrates drainage pipes which were brought out under the
road. Exhibit F demonstrates the channel and flood zone down
to our house, including the mud and debris which we have had
to clear up from our backyard on a recurrent basis.
I am greatly concerned about this potential danger, both
in regards to property and life. We have not experienced
such heavy rains in a multiple number of years, and this has
not been a problem in the past because of the drought. I am
greatly concerned about the engineering of this road, in
regards to appropriate drainage. It appears that this road
has allowed transfer of water from eoundup through the
lston's driveway, down onto this channel, directly into my
backyard, creating a potential for life-threating mudslide
and also danger to the house, and is already causing
settlement cracks.
I would greatly appreciate if you could substantiate the
engineering for this road, and the Association's, the City's
and the County's approval of such, because obviously this
will wind up in litigation if this cannot be resolved very,
very quickly.

My family and I are actually considering having to leave this
section of the house which was affected by the flooding, due
to the risk of the potential landslide and also the fact that
new cracks have been developing on our house over the past
four to six weeks, due to the flooding of the backyard and
the foundation.
It is beyond my belief that the city, county and the
Homeowner's Association would allow someone to build roads
and divert water onto other individuals' properties. I
realize this problem might not be solely with the Homeowner's
Association, and I would greatly appreciate your transferring
copies of this letter to other individuals who might be more
responsible for correcting this problem.
