Gentlemen:
I need your help in granting me permission to build a retain-
ing wall, not more than five feet (5') high, which will be
located ten feet in from the property line. This wall will
be along a portion of our property on the West side.
At the Architectural Committee meeting held on March 20, 1972
I presented plans for an addition to our home. The Committee
complimented the plans and "Togo" map; however they told my
architect and me we would have to make the following changes:
(1) Modify the roof plan, (2) Eliminate the shutter from the
garageand eliminate the bird house, (3) Provide for a ser-
vice yard, and (4) that we could not put any "fill" in the
easement, which I had requested along with the request for a
five foot retaining wall.
While the Architectural Committee definitely stated "No fill".
in the. easement, they had no objection to the five foot re-
taining wall that I need and recommended that I appear before
you for permission to build such a wall which I must have in
order to proceed with the planned addition to our home. With-
out this permission we could not have an access walk to the
front of our home where it is most needed.'
ti
As.I explained to you at the last meeting, the easement on
this side of our property is very seldom used by anyone as
it is not the main trail and is steep. I have talked with
my two neighbors on this side of the property: Mr. Lloyd
.Mokler had no objection to the five foot wall or to improving
the easement with a slight fill; however Dr,. Henze told me
he had no objection to the five foot wall, but would prefer
no fill in the easement which would spill over on his side of
the easement.
I have decided to compromise in order not to irritate anyone,
therefore I limit my request to you for your permission for
me to build a five foot retaining wall which I must have to
proceed.
Please accept my thanks for your time and consideration.
Very truly yours,
Anton B. Weber

Resubmit, with the following:

2)• Remove shutter on garage window.
3) No grading in easements as discussed with owner and Architect.
If retaining«aall is desired in side yard, Committee recommends
to the Board of Directors that a 5' maximum height wall be
approved. Owner should also apply to City of Rolling Hills
if retaining wall is to be requested in the side yard.
4). 8' x 12' service yard is required or an approved shape not
less than 96 square feet.
