Thank you for your letter dated April 14, 2010 regarding the wall along the
driveway on Pine Tree. Lane. Upon further investigation of the wall, it was
determined that approximately 2/3 of the wall is a retaining wall and the remaining
is necessary for erosion control. Should you remove the wall it will be necessary to
re -grade the area behind the wall.
Please contact the City to explain the reason for the demolition and your plans to
repair the wall or re -grade. Regardless of whether the Pine Tree Lane extension is a
roadway or a driveway, construction of retaining walls or grading require
engineering plans and permits.
Please contact the City immediately upon receipt of this letter to inform us of your
planned action or submit a grading and erosion control plan for the area behind the
wall.
In addition, please contact the RHCA for their requirements for conducting work in
the easement.

This letter is to follow up on my two phone calls to your cell phone, which remain
unanswered. It has come to the City's attention that you have demolished a portion
of the retaining wall along the Pine Tree Lane Extension. This wall was constructed
as part of the required street construction and is shown on the street construction
plans as a retaining wall.
Please contact the City to explain the reason for the demolition and your plans to
repair the wall. As you know, construction of retaining walls requires engineering
plans and building permit.
Please contact the City immediately upon receipt of this letter to inform us of your
planned action.

matter at its meeting of February 4, 2010.
City staff will monitor the RHCA's progress toward resolving the situation.

This communication is the result of the letter I sent in August 2009 regarding the knowledge
1 had obtained regarding the cul de sac and road extension on Pine Tree Lane. I have not
received any response that indicates any action related to this safety issue.
To refresh your memory, the cul de sac is required of any sub divider on Pine Tree Lane. It
is spelled out clearly in all resolutions of sub dividers on Pine Tree Lane. The cul de sac was
first provided by the Hassoldt's as that was your requirement. As number 16
progressed to_file their map we were required to remove the cul de sac. Number i6
completed their project as required and they built a road extension and cul de sac. The
Hassoldt cul de sac was in place in 1998. The Cukingnan's cul de sac was approved for
recording in 2002.
The cul de sac is an important safety issue as it was required by the Resolutions of Hassoldt,
Smith, Ruth, Uiirich's and number 16 formerly Cukinynan.
The issue of concern is the Community Association will not accept the road. In June 2009
they have given exclusive use of the improvements to number 16 Pine Tree Lane. The road
extension and the cul de sac now is a private drive no longer available for community use.
It became a private drive immediately and was posted with a sign provided by our
Association. It reads "No Trespassing Private Drive". It also has created a flag lot for 16 and
18 Pine Tree Lane.Pine Tree Lane is now a dead end road! There is a potential of a
60% increase of homes. This is above and beyond what existed when the 1998
cul de sac was in place.
The hazard is now real as no one is allowed to use the cul de sac and all traffic must back
up Pine Tree Lane. They are hacking up 238o ft to Portuguese Bend Road, Trucks and cars
are forced to back up the blind curved road. They are using the center line as a focal point.
This is a 13% grade road. Since 1998 the community has had the use of this road
improvement.

The City and Association precluded any of the original four sub divisions from
development without a cul de sac in place. Hence we were required to build a cul de sac and
remove it when number 16'.s improvement were recorded only two years later. This is a
"shall build" by our resolutions. There was no option! This creates an inability for number
7 and number 5 to sub divide as they cannot fulfil their resolution... No cul de sac available.
I hope this is clear to you. It has been sometime since the 1998 cul de sac was in place and
too long since the private drive has been posted. We have included the July 1989 minutes of
the association regarding the necessity of a cul de sac being available if any sub division was
to occur. They called out Pine Tree Lane as an unsafe road. The requirements of the
association has been clear through the process.
This solution is a simple one. Our Association should accept this road and cul de sac as
"built per plan". Then the entire community will again have the use of this cul de sac
improvement.

cul de sac Pine Tree Lane is a dead end road with a 13% grade.
I hope you can resolve this issue as the property we own is impacted by Dr.
Bharadia's understanding that the road and the cal de sac are his property and liability. I
know this was not the intention of the resolution approved by both the City and the
Association. Our city is very safety minded and this road should be recorded and used by

impacted as now Dr. Bharadia has posted the extension and cul de sac as his private
property. Since our property is a part of the development in this area and he has
staked claims to our property, something needs to be done. The Board has failed to
dedicate the road and now there is no cul de sac as required by the resolution for the
sub division of 16 Pine Tree Lane. You have created a safety problem as construction
vehicles face a dead end with no turn around. Their solution is to back up Pine Tree
Lane.
The City has accepted this road extension and cul de sac. The Board's failure
to accept this project has created a property line dispute as well as genuine
road hazards.

It is very important that this problem be addressed now as new construction
begins on Pine Tree Lane, and as you review this letter there are cement trucks
and large dirt trucks moving cement and soil from 2 Pine Tree Lane. These
trucks cannot make the right hand turn up the road. They are finding a dead
end where the extention and cul de sac was developed as required by the sub
divisions -They are being forced to back up the road to Portuguese Bend Road.
We look forward to hearing this acceptance has been completed and the road
and cul de sac is available to the entire community.

We have had Cox Cable services for over ten years to 10 Pine
Tree Lane.
Not perfect but acceptable, sufficient that we enrolled in their
bundle package of TV/Phone/internet.
Since Scott Goble oversaw the under grounding of our utilities
we have had constant problems. We lose our signal and service
to the degree that we go without 911 capabilities.
We chose to return our phone service with Verizon. Just so we
could be assured we would have phone service.
Here is the problem. Cox will not allow us to speak to anyone
that understands under grounding. Instead Cox sends techs that
scratch their heads and do nothing to resolve the problem. We
have had 24 appointments with these techs that can't solve the
problem, which is"NO Consistent SIGNAL" to this residence.
Before under grounding all our services worked. Now we can not
conduct business on the Internet nor can we watch cable tv. And
frankly for a while we were without phone service as Cox didn't
provide the signal. That was very troublesome to us as our cell
phone do not work here either.
Would you please assume leadership in the resolution of "No
Signal" to 10 Pine Tree Lane. Repairing the under grounding
problem will require someone of your respected position getting

involved. We have been totally stalled by employees of Cox, as
they are not allowed to give us access to the department that
should be addressing this problem.
We should have contacted you first as I am sure you would have
corrected the phone issue immediately. But we did not.
The Internet problem and cable problem are caused by failure of
the signal generated to our home. No one will address this.
Since the city mandated the under grounding I am sure your
input will correct this frustrating and costly problem. Basically we
paid a huge amount of money for under grounding all our
services and the agencies do not know how to handle the
problems they created. Beware of under grounding!

As a result of a visit by Wayne Chapman, Building Inspector, to 14 Pine Tree Lane
(actually to 10 Pine Tree, because under same ownership), Mr. Hassoldt, property
owner called to explain what he is dong on the property.
Mr. Hassoldt explained that he is weeding the lot by scraping the weeds. No contractor
would do disking any more, so he hired a contractor with a skip loader to remove weeds
and turn over the dirt. He said he is not grading or changing the grade.
The dirt looks loose, but is not a new dirt. He is going to place chips on the dirt to
absorb water during rains.

Roy, thanks again for checking 14 Pine Tree and stopping by the office.
Per my voice mail to you, I called Fire Station 56 to ask if they had a
brush clearance notice since that is the reason why they justified the
tractor work. The Capt said "no." As you know, we thought that they had
cleared the property of brush sometime before so this was a surprise. And,
for them to be saying they were removing roots is suspicious.
Our concern, of course, is unauthorized grading. Anytime someone has a
tractor out and is moving or upgrading dirt, we run the risk of grading. A
permit is needed under most circumstances, as you know.
We'd like to make sure they aren't doing anything further without notifying
and explaining it to the City. I'd like to ask that an inspector make sure
of it. As we hear or see anything, we'll let you know. And/or your office
can make it known to them if they don't have that understanding from your
visit today.
