Dear Board Members -
We are very concerned about the probable consequences of flood damage from
water and particularly mud flows that may come down the canyon if we have any
substantial rain this wet season.
As you probably know, the Flying Triangle landslide pushes into the Little
Klondike Canyon for about 200 yards beginning on the west side of the Agid property,
effectively closing off the canyon and preventing all run-off from contributing properties
and drains as far up as Crest Road. The effect of this build up of water in the canyon will
have the effect of allowing nothing to pass through until the time saturation will cause
everything to flow at once.
What we feel would provide a measure of security against such a disaster would
be to provide a catch basin to pipe all the water descending from above the blockage
(adjacent to the driveway for Agid, Doak and Schaye) and pipe it the short (50 yards +/-)
distance over to Portuguese Bend Road where it would end up going down Paintbrush
Canyon, or pipe it the longer distance through the blocked area to where it can flow freely
under Pinto Road.
More than likely, either of these projects will substantially reduce future road
repairs by preventing a large amount of water from reaching the slide plane.
Additionally, it seems that the pipes placed directly in front of the drain opening
will serve only to block it as soon as any larger rocks or branches are washed down the
canyon, hopefully these can be removed or placed further up the canyon.

Enclosed herewith is the information regarding Dr. Larry Kelly's
residence. As you may recall, we toured the residence in December
1985, at which time I solicited your opinion as to possible alter-
natives for a final disposition of the matter. At that time you
requested the notice of order as prepared by the County of Los
Angeles. We received the order on December 31, 1985.
Please excuse the delay in our getting the notice of order and
copies of the November 12, 1985 and November 25, 1985 Rolling Hills
City Council minutes to you. After you have had an opportunity to
review the enclosed information, I would a-preciate your contacting
me so we can discuss the matter further.
On a completely unrelated matter, the City of Rolling Hills is
carefully evaluating the possibility of contracting one of the
private sector firms for Building and Safety, and building inspec-
tion services. I would very much like to receive from Willdan
Associates a proposal for those services to the City of Rolling
Hills. We would certainly like to consider a proposal from your
firm for Building/Safety and inspection services.

A recent inspection of the above structure found it to be substandard as
defined by the City of Rolling Mills building Code, due to extensive
dilapidation, disrepair, and/or fire damage. The structure is open and
accessible to children and others. It exists as a fire hazard and a
threat to public safety and welfare.
Section 9908 of the Code declares all such substandard buildings a public
nuisance and requires the abatement thereof.
Due to the nature and extent of the defects, it does not appear practical
to repair the structure to comply with minimum standards. Therefore, as
the owner of record, you are hereby notified to complete demolition of
the structure within 30 days after you receive this letter. Demolition
includes the removal' of all foundations, slabs, debris and the proper
abandonment of any sewer or sewage disposal system.
This notice will be posted on the property. lf, in your opinion, you
disagree or cannot comply with the above findings or order, you may
request a public hearing. The request for hearing must be within 30 days
after posting of this notice on the property and must be in writing
directed to the City Engineer, Property Rehabilitation Section, No. 2
Portuguese bend Rd., Rolling Hills, California 90274.
Permits for demolition or repair are required before starting the work
and may be obtained at the building and Safety Division office shown at
the bottom of the attached list of defects. For further information,

We recieved your letter dated 9/21 and are amazed
at the results of your inspection.
First,I want to clarify to all concerned that the dirt
that we moved was away from Little Klondike canyon. It would be
completely obvious to anyone who actually did an inspection that
no dirt was moved or disturbed within 20 or more feet of the edge
of the canyon. Any actions we took would only serve to relieve the
pressure of the slide as it pushes towards the canyon. It is ludicrous
to link the movement of dirt from where we took it to any increase
in debris in the bottom of the canyon.
Second, Little Klondike has NOT had water run down it
since BEFORE we moved the dirt! In our conversation on 9/24 you
consistently referred to a 2 inch rain in June as having plugged
the drain. It takes a heck of a lot more than 2" to get the canyon
running. There is absolutely NO WAY the drain was open before we
did the work.
Third, any time the canyon has flowed since the slide
has started, it has collected dirt and rocks in the pipe as well
as in front of it. I would assume that since the "teardrop" is
moving directly towards the canyon and is resulting in the canyon
bottom being higher year after year that the maintenance of the
drain will be increasingly costly. It is no secret that you have
a great desire to rid yourselves of that maintenance. Threatening
us is not the answer.
When we talked on 9/24 you also mentioned that extra
water came down during the winter as a result of a County drain
above that was not cleared as you had requested them to. Since
the vast majority of the water entering the canyon comes from above
the slide area an obvious solution would be to 'PIPE it THROUGH the
slide area.
In closing let me remind you that the battle for the
maintenance of the canyon was settled in court some years ago. You
have with your letter caused a great deal of stress in our family
about an issue of which we were not the cause.Let me assure you
that by all means at our disposal, we will not be your answer.

Nealis, City Manager, expressing concerns held by the Rolling Hills
Community Association about consequences that could arise due to
grading done on your property.
The concern has now become very real as an inspection of the Pinto
Drain reveals that debris from your property has blocked it. This
drain was completely open before you changed the contours of your
lot, as well as part of the Evans lot.
Please contact Mr. Roger Vink, Maintenance Foreman, before
September 30th, or the Los Angeles County Building and Safety about
measures you will take to open the drain before winter storms
arrive.

It is my understanding that Los Angeles County is investigating
recent grading done without a permit by Mr. Charles Raine.
In conjunction with the study, we will appreciate attention be
given to the drainage in the area graded that could affect the
Pinto drain located near the Raine and Dessy boundary line. Canyon
debris and loose soil wash down to Pinto Road, causing a continual
maintenance problem to keep the drain open.
We are concerned--that—the changes made in the topography ana soil -
conditions could adversely affect Pinto drain, causing more
maintenance expense or flooding to the Hartwig residence.

Landslide Area and that the plan will be ready within the week.
In our letter to you of March 10, 1993, we noted that it will be necessary for you
to provide 4 copies of a Repair Plan which will provide the least amount of earth
to be moved, and that the plan be reviewed and stamped by a registered Civil
Engineer. The 30 day deadline cited in the letter has passed. But, because you
have made a good faith effort to provide the plan, the City hereby extends the
deadline to Tuesday. April 20. 1993.

A notice to stop work was issued by Los Angeles County Building Inspector
Raphael Bernal on March 9, 1993 because you are in violation of the Rolling Hills
Municipal Code Section 15.04.010 and Los Angeles County Building Code Section
301 (a) that require permits to perform any grading.
The City of Rolling Hills has consulted with the Los Angeles County Department
of Public Works to determine what measures would be required to alleviate the
movement of earth behind your residence in the active Flying Triangle Landslide
Area in an effort to prevent future mishaps, further erosion, and control earth
or mud that might run off onto your residence or endanger adjacent properties,
as the result of illegal grading that has taken place on the site.
At this time, we have determined that it will be necessary for you to provide 4
copies of a Repair Plan which will provide the least amount of earth to be moved,
reviewed and stamped by a registered Civil Engineer, within 30 days of receipt
of this letter to the City of Rolling Hills and the Lomita Office of the County's
Building & Safety Division.
Let us remind you that the City is quite serious about this matter and will not
tolerate any illegal grading in the Flying Triangle Landslide Area. Feel free to

A recent inspection of the above structure found it to be substandard as
defined by the City of Rolling Hills Building Code, due to extensive
dilapidation, disrepair, and/or fire damage. The structure is open*and
accessible to children and others. It exists as a fire hazard and a
threat to public safety. and welfare.
Section 990E of the Code declares all such substandard buildings a public
nuisance and requires the abatement thereof.
Due to the nature and extent of the defects, it does not appear practical
to repair the structure to comply with minimum standards. Therefore, as
the owner of record, you are hereby notified to complete demolition of
the structure within .30 days after you receive this letter. Demolition
includes the removal of all foundations, slabs, debris and the proper
abandonment of any sewer or sewage disposal system.
This notice will be posted on the property. If, in your opinion, you
disagree or cannot comply with the above findings or order, you may
request a public hearing. The request for hearing must be within 30 days
after posting of this notice on the property and must be in writing
directed to the City Engineer, Property Rehabilitation Section, No. 2
Portuguese bend F,d. , Rolling Hills, California 90274.
Permits for demolition or repair are required before starting the work
and may be obtained at the building and Safety Division office shown at
the bottom of the attached list of defects. For further information,
please contact the inspector whose name and telephone number are shown
below the office name and address.

1. The dwelling is in a state of collapse,, therefore, the premises shall be vacated
forthwith.
2. The dwelling is open, accessible and exists as a fire hazard and a threat to public
safety and welfare.
3. The foundation under the dwelling is inadequate.
4. The building contains defective, deteriorated or inadequate floor supports.
5. Doors and windows are broken.
6. The roof sags and supports are inadequate.
7. The exterior stairway and landings are hazardous.
8. The floor in all rooms slope and are warped.
9. The interior walls in the dwelling are damaged, inadequate to support the ceiling
and roof loads.
10. The ceiling joists in the dwelling are damaged.
11. The ceilings in the dwelling are damaged.
12. Electrical wiring in the interior is damaged.
13. Fixtures and receptacle outlets in the dwelling are damaged and unsafe.
14. Gas and waste piping are damaged.
