FINDINGS AND REPORT
The application of. Mr. Anton B. Weber, Lot 12=FT, Flying Triangle
Tract, for a variance of :Side Yard Requirements. under. Article III,
Section 3.07 of Ordinance No. 33 came on for hearing on the 18th day
of April, 1972 in the Council Chambers of the Administration Building,

having submittedevidence in support of the application, the Planning
Commission, being -advised, now makes its Findings and Report as required
by the Ordinances of the City.of Rolling Hi11s, California.
I.
• he Commission finds that the applicant,. Mr. Anton.B. Weber, is
the owner of thatcertain real property describedas Lot 12-FT, Flying
Triangle Tract, located in the City of Rolling Hills, California, and
that notice of the public hearing in connection with said application
was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills, California.

The Commission. furtherfinds that no person appeared at said public,
hearing inopposition to.the application. for a variance, and that no
evidence was received by the Commission in opposition'thereto,.and
that Mr. Lloyd Mokler,.2 Ranchero Road, the neighbors nearest to Mr.
Weber statedthat he had no objection to the wall, since it would
leave the 10 foot easement intact and unobstructed. Mr. Mok1er said
he felt Mr. Weber should be permitted to improve and develop his land
to enable him to make the best: use of his property.

The Commission further finds that the applicant requests the
variance to permit construction of a retaining wall in the side yard
for -:improvement of the -property to accommodate a residence addition
and a new driveway, and that he had been unable to make the necessary
improvements until after the Flying Triangle geology study and review
were completed. The Commission. finds that a variance for construction
of a retaining wall would allow for construction.of,service yard and
provide better access to the residence, and should be granted inorder
to preserve substantial property rights possessed by other property in
the same vicinity and zone.

From the foregoing it is concluded that a variance of Side Yard
Requirements under Article III, Section 3.07 of Ordinance No. 33 should
be granted by the Planning Commission: of the City of. Rolling Hills to
Mr. Anton.B. Weber, Lot 12-FT, Flying Triangle. Tract, in .accordance
with the plot plan. marked Exhibit I on file in these proceedings, and
it is, therefore, so ordered.
