FINDINGS AND REPORT -
The application of Mr. Medard Cronin, Lot 123-RH, Rolling
Hills Tract, for conditional use permit under Article III, Section
3.06,.Front:Yard Requirements, and Article V, Section 5.06, Extension
of Non -conforming Use of Conforming Building, Ordinance No. 33, came on
for hearing on the 19th day of October, 1976 in the Council Chambers of
the Administration Building, 2 Portuguese Bend Road, Rolling Hills,
California. The Planning Commission, being advised, now makes its
Findings and Report as required by the Ordinances of the City of
Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Medard Cronin,
is the owner of that certain real property described as Lot 123-RH,
Rolling Hills Tract, located in the City of Rolling Hills, California,
and that notice of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 of the City of Rolling Hills, California. The Commission finds
further that no communication, written or verbal, had been received in
favor of or in opposition to the request.
II.
The Commission finds that the Cronin property, consisting of
five acres, is bisected by Possum Ridge Road, and the house, which was
built prior to establishment of set -back requirements, does not conform
to the 30 foot set back required by Ordinance No. 33. The Commission
finds further that a proposed five foot addition to the residence
would not project further into the fron yard, but would be part of that
portion of the residence which presently constitutes the non -conforming
use, and would not be visible from the road.

The .Commission finds that a conditional use permit should be
in order to preserve substantial property rights possessed by
other property in the same vicinity and zone, and that the granting of
such a conditional
public welfare nor
use permit would not be materially detrimental to the
injurious to property in the same vicinity and zone,
since other properties on Possum Ridge Road have similar set -backs.
IV.
From the foregoing it is conculded that a conditional use
permit should be granted under ARTICLE III, Section 3.06, Front Yard
Requirements, and Article V, Section 5.06, Extension of Non -conforming
Use of Conforming Building, Ordinance No. 33 for construction of a
residence addition which would be a. -prolongation of an existing
building line, and it is, therefore, so ordered.
