Building Inspector Bernal and I inspected the subject property this
date. A new chain link fence has been constructed at the west
opening at the rear of the house. Along with the steep bank to the
north and the wooden fence at the east end, the broken and cracked.

Mr. Guy Sullivan, part owner of the subject site, telephoned and
said that he is working with a detective from the District
Attorney's office regarding charges of a fraudulant real estate
deal by part owner, Mr. Jerry Marshak, and Mrs. Myrna Culbreath.
He said that they have done the same thing before. He also said
that he had a contractor look at the house and was told that the
remedial measures used to shore up the building only made it worse
and that he wants to have the building condemned. He asked about
calling Ed Acosta of County Building and Safety and the Health
Department and I told him he could do that.
I told him that 'he would probably be hearing from us soon about
fencing the pool and to keep us posted about any legal action that
occurs.

BACKGROUND
On July 27, 1992 the City Council ordered that the damaged pool at
the subject site be filled in. and any debris associated therewith
be removed from the property by August 12, 1992. In the
alternative, the property owners were to submit plans, prepared by
a certified civil engineer, for the repair or reconstruction of the
pool by August 12, 1992. In August, the property owners hired a
contractor who informed staff that plans were being prepared. The
City Council had also ordered that any remedial work required by
the plans be completed in a timely and efficient manner by November
12, 1992.
The entire file has been copied and forwarded to the City
Attorney's office for appropriate legal action. Staff has notified
the Public Works Rehab Section to check on the timing for .a
contractor to abate the nuisance.
Just this week, staff was informed by the City Attorney's office
that the next step is for us to prepare a Declaration of
Substandard Property and record it with the County Recorder. We
are proceeding with that process. .
RECOMMENDATION
It is recommended that the City Council receive and file this
report... .

BACKGROUND
On July 27, 1992, per Resolution No. 689, the City Council declared
the condition of the property located at the subject site to be a
public nuisance and ordered the following procedure and timetable
for the abatement of the damaged pool:
The damaged pool must be filled in and any associated debris must
be removed from the property by August 12, 1992. ' In the
alternative, the property owners must submit plans, prepared by a
certified ,civil engineer, for the repair or reconstruction of the
pool by August 12, 1992. If such plans are submitted, any remedial

efficient manner by November 12, 1992 (3 months).
The owners signed a contract with a certified civil engineer by
August 12, 1992, but, no plans for the repair or reconstruction of
the pool have been forthcoming. The deadline date of November 12,
1992 has passed and staff is proceeding with abatement of the
nuisance with the City Attorney.
RECOMMENDATION
This report is submitted for information only and it is recommended
that the City Council receive and file this staff report.

Note that (1) The inoperable automobile has been removed; (2) The
vegetation has only been partially trimmed and still constitutes a
fire hazard; therefore,. the matter has been forwarded to the County
Agricultural Department to complete the weed abatement; and (3) The
damaged pool on the property continues to be a. public nuisance.
Therefore, the damaged pool must be filled in and any associated
debris must be removed from the property by August 12. 1992.. In
the alternative, the property owners must submit plans, prepared by

BACKGROUND
1. On June 22, 1992, the City Council gave the property owner until Monday.
June 29, 1992 to prepare an itemized time schedule for nuisance abatement
and to clear brush and vegetative growth in conformance with Fire
Department regulations.
2. On June 26, 1992, Capt. Bob Kummelehne of Fire Station #56 mei. with Ms.
Culbreath, owners' representative, in the field and gave her directions as to
the removal 'of the vegetative growth.
3. On June 30, 1992, Ms. Culbreath called to report that 85 to 909 of the
clearance was 'completed.
On 'that same day, June 30, 1992, Capt. Dennis Colmerauer, inspected the
property and ' remarked that ' although work had begun, ' it was not near the
percentage Ms. Culbreathmentioned. Attached is the 'Official Inspection
Report from the captain. '

5. Also attached is a letter to the property owners requiring that they comply
with the two City requests by July 13. 1992. '
On July 6. 1992. ' Planning staff spoke with owner Mr. Guy Sullivan who
called to report that he met with fire. officials during the holiday weekend.
He said that work had been stopped because Ms. Myrna Culbreath did not
pay the worker. He said that he would attend the July 13. 1992 meeting.
7. We spoke with Capt. Paul Brown on July 6, 1992 and July 9. 1992 and with
Capt. Bob Kummelehne on July 7, 1992. Capt. Kummelehne described many
specific areas where cleanup of vegetation and debris is required., He also
pointed out that there was such a great amount of work to be done that it
would require a' crew of workers.
8. A letter to abate within 7 days has been sent by the City after two notices
from the Fire Department.

ALTERNATIVES
A. ' Give the property owners further time to remove the abandoned vehicle,
• repair the pool, and remove the vegetation.
B. Direct staff to prepare a Resolution declaring that the vehicle, pool and
vegetation on the property constitutes a public nuisance that should be
removed. Before entering onto the property to abate the nuisance, the City
Attorney's office will prepare a court order, based upon these proceedings,
to authorize the City's entrance on 63 Portuguese Bend Road. Once the
order is signed, the City can proceed to abate the nuisance without
interference from the property owner. The Resolution will further provide
that in the event the City can proceed to abate the nuisance, it can then.
record an assessment against the property for a lien to cover the cost of
abatement.
RECOMMENDATION
It is recommended that the City Council choose one of the above alternatives and
direct staff to prepare the appropriate documents.

BACKGROUND
1. The City had received a number of complaints regarding the condition of the
subject property in the Flying Triangle landslide area and began nuisance
abatement proceedings in this case on November 20, 1991.
2. The property was then owned by a number of people, represented by Trust
Deed Service Center.
3. Mr. Jerry Marshak became the new owner of the subject property on April
14. 1992.
4. The City had requested that the property owner secure the house on its
foundation: and remove a broken down and abandoned vehicle. a cracked
pool. and overgrown vegetation.
5. Since the City Council meeting of May 11. 1992. staff spoke to Ms. Myrna
Culbreath, who represents the property owner. and learned that the following
steps have been taken to abate the nuisance:
A. A structural engineer has been consulted and the house has been
leveled up and cleaned up so that the owners family is ready to
move in and take up residence. .
B. The broken down and abandoned vehicle has been removed.
C. The cracked pool will be repaired and fitted with a new vinyl liner to
allow for any further landslide movement in the area. The vinyl liner
has been ordered and new replacement pumps for the pool will be
installed.
D. Existing uneven concrete in the U-shaped pool area will be covered
with a low wooden deck to match existing decking.
E. The overgrown vegetation has been cut back and removed.

6. Planning staff inspected the property on June 17, 1992 and observed
that the broken down and abandoned vehicle has not been removed and
though substantial cleanup appears to have taken place inside the residence,
the property itself is largely overgrown with dried underbrush and in
need of substantial clearing work.
ALTERNATIVES
A. Direct staff to have the house and. pool inspected by the County Building
Inspector.
B. Give the property owner a fixed time period to obtain any permits required
by the building inspection.
C. Give the property owner a set time limit to remove the vehicle, repair the
pool, and remove the vegetation.
D. Direct staff to prepare a Resolution declaring that the vehicle, pool and
vegetation on the property constitutes a public nuisance that should be
removed. Before entering onto the property to abate -the nuisance, the City
Attorney's office will prepare a court order, based upon these proceedings,
to authorize the City's entrance on 63 Portuguese Bend Road. Once the

Rolling Hi11s.Municipal Code chapters 8.24 and 8.28
govern the procedures pursuant to which the City may bring
actions to abate public nuisances. Chapter 8.24 provides -that
the owners or possessors of property in the City must maintain
their property free from any nuisance, which is defined as
anything which is injurious to the public health .or safety,. is.
injurious to the stability of real property, or which interferes
with the comfort and enjoyment of life or property. Sections
8.24.010 and 8.24.020. Further, Section 8.28.090 defines any
condition on property within the City which has, in the recent
past, or may, in the future, aggravate, enlarge or accelerate an
active landslide to be a public nuisance.
The city had received a number of complaints regarding.
the condition of the property located at 63 Portuguese Bend Road.
Based upon those complaints, and upon inspections of the property
which verified the condition of the property,. the City notified
the owners of the property that the City had determined that the
inoperable vehicle stored on the property, the damaged swimming
pool, the overgrown vegetation, and the house situated thereon
constituted•a public nuisance pursuant to Chapters.8.24 and 8.28.
The notice was sent to Mr. and Mrs. Kenneth Thomas on' April 3,
1992. A copy of the notice is attached hereto as Exhibit A.
The facts relating to the existence of a nuisance at 54
Portuguese Band Road are as follows:
• The property is improved with a single family residence
and a pool. Due to thelandslide, the swimming pool has become
damaged and cracked; further the home has slid off of its
foundation and is balanced, unevenly, on steel girders. Certain
structural repairs could possibly be made to secure the house on
its foundations. However,none have been taken. Unless such
repairs are made the home will continue to slide, its structural
integrity could be compromised, and it could endanger neighboring
properties.
City inspections in 1991 demonstrated that the house
was open and vacant. Scattered throughout was junk and debris,

as well as discarded household furnishings. Further, the floors
were quite noticeably slanted due to the house's slide off of its
foundation. The site inspections also revealed a broken down and
abandoned vehicle on the premises as well as a cracked pool and
overgrown vegetation. The pool's concrete foundation was damaged
in the landslide, and it continues to suffer damage as the, ground
moves. It is not capable of being used as a pool and should be
removed. The abandoned vehicle on the property is inoperable and
unsightly and causes visual blight. Further, the overgrown
vegetation on the property is equally unsightly and must be
trimmed.
The City posted a notice of substandard property at the
site apprising the property owners of the unsafeand unsightly
conditions that exist on the property. However, no action was,
or has been, taken to remove the vehicle, or the pool or to trim
the vegetation. As stated above, the house is still off of its
foundation.
Based upon the foregoing, the Staff recommends that the.
City Council adopt the resolution declaring that the vehicle,
pool and vegetation on the property constitutes a public nuisance
that should be removed. Before entering onto the property to
abate the nuisance, the City Attorneys office will prepare a
court order, based upon these proceedings, to authorize the
City's entrance onto 63 Portuguese Bend Road. Once the order is
signed, the City can proceed to abate the nuisance without
interference from the property owners.
The resolution will further provide that in the event
the City abates the nuisance, it can then record an assessment
against the property for a lien to cover the cost of abatement.
The staff further recommends that the City Council give
the property owners time to explore the possibility of repairing
the house. The staff will reinspect the property at the
expiration of that time period to inspect the condition of the
house and to determine if it requires abatement.

in the City Council Chambers, located at 2 Portuguese Bend Road, Rolling Hills,
CA to determine if the nuisance has been abated or if there has been good faith
compliance with this order to abate. At that time, you may contest the City
Council's determination. Further, any other interested parties may present
evidence regarding the condition of the property. Based upon consideration of
the evidence adduced at that hearing, the City Council shall make a final
determination regarding the condition of the property and whether abatement is
required. The City Council's decision shall be final.

THE PROPERTY LOCATED AT 63 PORTUGUESE BEND
ROAD TO BE A PUBLIC NUISANCE AND ORDERING THE
ABATEMENT THEREOF
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, DECLARE AND ORDER As FOLLOWS:
Section 1. Pursuant to Chapters 8.24•and 8.28 of the
Rolling'Hills Municipal Code, the city of Rolling Hills notified
Lee Keratin, BLS Inc., Raymond D. Claverie and Elsie C. Claverie,
FRO Raymond D. Claverie, owners of certain real property in the
City of Rolling Hills, commonly known•:as 63 Portuguese Bend Road,
that the inoperable vehicle stored on the property, the damaged
swimming pool, the overgrown vegetation, and the house situated
thereon, have been determined to be a public nuisance and that
they must be removed within 15 days, otherwise the City would
hold a public hearing on April 27, 1992 in the City Council
Chambers of City Hall to hear any protests the owners might have
to the abatement of the nuisance. The City sent the notification
on April 3, 1992..'
Section 2. On April 27, 1992, the City'Council.held a
public hearing to allow the property owners and any other
interested parties to testify and submit evidence regarding the •
condition of the property located at 63 Portuguese Bend Road.
Section 3. Based upon the staff report, and the
evidence presented at the time of the hearing, the City Council
made the following. findings of fact:
a. The property located at 63 Portuguese Bend Road is •
located in an active landslide area known as the Flying Triangle.

down and abandoned vehicle on the promises as well as a cracked
pool and overgrown vegetation. The pool's concrete foundation
was damaged in the landslide, and it continues to suffer damage
as the ground moves. In its current condition, it cannot be
used; further it is unsightly and causes visual blight. Due to
its location in a landslide, its condition will only worsen. The
vehicle on the property is abandoned and inoperable. It, too, is
unsightly and causes visual blight. The overgrown vegetation on
the property must be trimmed. .
d. In November of 1991, the City posted a notice of
substandard property at the site apprising the property owners of
the unsafe and unsightly conditions that exist on the property.
However, no action was, or has been, taken to put the house back
on proper foundations, to remove the vehicle or the pool, or to
trim the vegetation.
n 4. Therefore, the City Council finds and
determines that the vehicle, pool, and vegetation located on the
property constitute a public nuisance pursuant to Chapters 8.24
and 8.28 of the Rolling Hills Municipal Code in that the they are
is unsightly and injurious to the public health, safety and
welfare.
Section S. The City Council orders that the abandoned
vehicle, damaged pool and overgrown vegetation, and any debris
associated therewith, be removed from the property by
Section 1. The City Council further finds that the
house, if not repaired and secured on proper foundation could
constitute a public nuisance. However, since it is now closed
and does not endanger neighboring properties, the City will allow
the property owner time to repair it. The City Council orders
that the house be inspected in months to determine
whether or not repairs have been made and whether or not it
constitutes a public nuisance.
Section 7. If the nuisance is not abated as specified
herein, then the City Manager is directed to cause the nuisance
to be abated by the City, and also is directed to notify the
property owner in writing by certified mail and regular mail of
the cost of removal of the nuisance and that payment in full for
removal of the nuisance is due to the City within 10 days of the
date of mailing of the notice. If the total cost of abating the
nuisance is not paid to the City within 10 days after the date of
the notice, the City Clerk shall record, in the Office of the
County Recorder, a statement of the total balance dueto the City
which shall constitute a lien upon the property.
Section 8. The City Clerk is hereby directed to send a
copy of this resolution by certified and regular mail to the
owners of the property located at 63 Portuguese Bend Road.
