On Saturday, January 12, 1991 the Planning Commission voted to deny
a request for a Variance to the balance of cut and fill of soil;
and also to deny the request to modify the terms of a Conditional
Use Permit for a tennis court in Zoning Case No. 348. The
applicants are Mr. & Mrs. James Lu (8 Possum Ridge Road).
A Resolution is attached for your review.

SPECIFIC REQUEST: Request for a Variance to import soil,
resulting in an imbalance of cut and fill to
construct a tennis court. Request for a
modification to the previously approved
Conditional Use Permit and Variance to
construct and maintain a tennis court; to amend
the Resolution of Approval accordingly; and to
consider any other appropriate action.
DISCUSSION
This item is being continued from the October 16th Planning
Commission meeting. The case needed to be re -noticed as a Variance
due to Sec. 17.16.012 (E)(7). Grading for a tennis court, rather
than a modification only, to a previously approved Conditional Use
Permit. The matter has also been continued to allow time for
"additional research" by staff.
In reference to the letter and comments by the neighboring property
owner, a couple of points were raised regarding a modified driveway
easement over the subject site to 10 Possum Ridge Road and erection
of entry posts on 8 Possum Ridge Road, without permits.
Mr. Lu.has conveyed to his representative, Mr. Doug McHattie of
South Bay Engineering, that he would remove the pilasters to the
entry of the driveway.
Considerable progress is underway to provide for slope remediation
and erosion control, even though authorization to conduct the
emergency import of soil was to be contingent on the formal
approval of a Variance by the Commission at the November 20th
Public Hearing, according to the attached letter dated October 30,
1990 by Mr. Ray Hamada, former Principal Planner.

The Zoning Case File and Minutes do not indicate what "additional
research" is needed. Former planning staff was not able to offer
any information on what is meant by "additional research" on this
case.
It appears that if Mr. Lu would be willing to remove the pilasters
at the entry to his drive, that this would provide a short term
solution, providing a turn -around area for the property owners at
this cul-de-sac.
As a long range point of negotiation, re -alignment of the driveway
easement should be pursued.
RECOMMENDATION
It is recommended that the Planing Commission take testimony, add
conditions as necessary regarding the pilasters, driveway easement,
and grading; and grant the Variance to construct a tennis court.

DISCUSSION
This request was continued from the last adjourned meeting where the
Commission viewed the subject site and surrounding properties. The
Commission will recall that a conditional use permit and variance was
approved April 19, 1988 to construct a tennis court. The applicant
(Murray) subsequently received an extension of approval on June 20, 1989.
On February 5, 1990, the owner received a.grading permit for the tennis
court. On the permit, it was noted that 370 cubic yards would be
disturbed for the cut/fill balance. The grading work was executed, but
the project has been questioned as to the consistency with the approved
plan. An inspector from the County has viewed the site, and has reported
to the City that the project appears to be consistent with the approved
permit.
At the field meeting, a neighbor has brought to the attention of the City
that discrepancies appear to be present with previously approved plans by
the City and Association. This matter pertains to the modified driveway
easement over the subject site to 10 Possum Ridge Rd. and development of
entry posts on 8 Possum Ridge Rd. without permits. The neighbor has
subsequently submitted a letter of opposition to the project.
The additional comments has resulted in further staff research on the
subject site and surrounding properties. This further research has not
been completed, and in reviewing the application, public noticing is in
error since the request should be a variance to deviate from the
requirement of balanced cut and fill for tennis courts.
RECOMMENDATION
Staff would recommend that this matter be continued to allow for the
renoticing and additional research.

ZONING CASE NO. 348:
The applicants, Mr. and Mrs. James Murray, Lot 112-RH, 8 Possum
Ridge Road, have requested:
- A conditional use permit for the constrution of a tennis
court.
- A conditional use permit for a cabana.
- A variance of the front yard setback requirement to allow
for the construction of the tennis court, cabana and
a garage.
2. ZONING CASE NO. 349:
The applicants, Mr.and Mrs. Peyton Cramer, Lot 31-GF, 11 Georgeff
Road, have requested a conditional use permit for the construction of
a guest house.
3. ZONING CASE NO. 350:
The applicants, Mr. and Mrs. Robert Modzeleski, Lot 247-6-MS,
20 Buggywhip Drive, have requested a variance from the front yard
setback. requirement to allow for the construction of a residence
addition.
4. PROPOSED VIEW PRESERVATION ORDINANCE:
This is a public hearing to receive testimony regarding the
proposed view preservation ordinance. I recommend that the Commission
open the hearing, take public testimony and continue the matter to
the December 15th meeting. We shall be receiving an opinion
pertaining to the environmental assessment. It should be ready for
review at the December meeting.
