EXTRAORDINARY CIRCUMSTANCES As per the City Staff Report, the subject property is bisected by Portuguese Bend Road and approximately 20%of the five acre parcel is located west of the road. The net lot area available for development is therefore substantially reduced by this configuration. This reduction of useable net lot area due to the size and location of the road easement is substantially greater than that for most other properties in the RAS-2 zone. B. HARDSHIP Such variance is necessary for the preservation and enjoyment of an open and uncrowded appearance of development on the property, which is consistent with that now enjoyed by other properties in the same vicinity and zone. , • If the guesthouse is placed behind the proposed residence, it will crowd the residence and existing barn. • If the proposed residence is moved closer to Portuguese Bend Road to reduce the crowding effect, there would be a substantial increase in grading and net lot disturbance. The proposed residence has been placed at approximately the same location as the existing structure in order to reduce grading and to maintain existing landforms. • If the proposed residence is moved closer to the road, city and coastline views will be impacted and there will be an increase in traffic noise from Portuguese Bend Road. C. PUBLIC WELFARE The granting of such variance will not be materially detrimental to the public good because the guest house, for which a variance is requested, will not be seen from Portuguese Bend Road or from neighboring properties. On the other hand, if the main house were to be sited closer to Portuguese Bend Road in order to place the guest house behind it, a substantial amount of existing trees and other vegetation would probably need to be removed due to grading. The residence would then be more visable from Portuguese Bend Road and this would increase the appearance of greaterdevelopment on the property. D. SPIRIT AND INTENT Because of the special circumstances which apply here, the granting of a variance in this case will not prejudice the application of City codes and ordinances in other circumstances. Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable. Bracing should be provided where possible. Wire, twine or other suitable material should be used to delineate roof ridges and eaves.
