This letter shall serve to notify you that the City Council at their regular meeting on
April 25, 2005, received and filed the Planning Commission's resolution granting your
request in Zoning Case No. 701.
The decision shall become effective thirty days after the adoption of the resolution by
the Planning Commission, (adopted 4/19/05) unless an appeal has been filed or the City
Council takes jurisdiction of the case within that thirty-(30) day appeal period. (Section
17.54.010(B) of the Rolling Hills Municipal Code). Should there be an appeal, the
Commission's decision will be stayed until the Council completes its proceedings in
accordance with the provisions of the Municipal Code. Before this case takes effect you
are required to cause to be recorded an Affidavit of Acceptance Form together with the
subject resolution in the Office of the County Recorder.
I have enclosed a copy of RESOLUTION NO. 2005-12, specifying the conditions of
.approval set forth by the Planning Commission and the approved Development Plan to
keep for your files. Please complete the enclosed AFFIDAVIT OF ACCEPTANCE
FORM, have the signature(s) notarized, and forward, (or hand deliver), the completed
form and a copy of the Resolution to:

regular meeting beginning at 7:30 PM. You or your representative should be
present to answer any questions the Council may have., •
The Planning Commission's decision in this matter shall become effective thirty

ROLLING HILLS APPROVING MODIFICATION TO PLANNING
COMMISSION RESOLUTION NO. 2005-12 A RESOLUTION GRANTING
APPROVAL OF A SITE PLAN REVIEW FOR GRADING AND
CONSTRUCTION OF A NEW SINGLE FAMILY RESIDENCE TO
REPLACE AN EXISTING RESIDENCE, GRANTING A CONDITIONAL
USE PERMIT TO CONSTRUCT A GUEST HOUSE AND GRANTING A
VARIANCE TO CONSTRUCT THE GUEST HOUSE IN THE FRONT
YARD IN ZONING CASE NO. 701 AT 44 PORTUGUESE BEND ROAD,
(LOT 124-RH), MILLS.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. George Sweeney, Architect, on
behalf of the property owner, with respect to real property located at 44 Portuguese Bend
Road, (Lot 124 -RH), Rolling Hills, CA requesting a two-year time extension for a previously
approved Site Plan Review, Variance and Conditional Use Permit to construct a new 8,402
square foot single family residence with 1,605 square foot garage, 805 square foot swimming
pool with 36 square foot pool equipment area, 738 square foot guest house in the front yard
area, service yard, 1,385 square feet covered porches/entryway and 1,048 square foot
basement, in Zoning Case No. 701.
Section 2. The Commission considered this item at a meeting on April 17, 2007 at
which time information was presented indicating that additional time is needed to process the
development application.
Section 3. Based upon information and evidence submitted, the Planning
Commission does hereby amend Paragraph A, Section 10 of Resolution No. 2005-12, dated
April 19, 2005, to read as follows:
"A. The Site Plan Review, Conditional Use Permit and Variance approvals shall
expire within four years from the effective date of approval if construction pursuant to
this approval has not commenced within that time period, as required by Sections
17.46.080(A), 17.37.070(A) and 17.42.070(A) of the Rolling Hills Municipal Code".
Section 4. Except as herein amended, the provisions and conditions of Resolution
No. 2005-12 shall continue to be in full force and effect.

VARIANCE REQUIRED FINDINGS
A. EXTRAORDINARY CIRCUMSTANCES
As per the City Staff Report, the subject property is bisected by Portuguese Bend Road and
approximately 20%of the five acre parcel is located west of the road. The net lot area available
for development is therefore substantially reduced by this configuration. This reduction of
useable net lot area due to the size and location of the road easement is substantially greater than
that for most other properties in the RAS-2 zone.
B. HARDSHIP
Such variance is necessary for the preservation and enjoyment of an open and uncrowded
appearance of development on the property, which is consistent with that now enjoyed by other
properties in the same vicinity and zone. ,
• If the guesthouse is placed behind the proposed residence, it will crowd the residence and
existing barn.
• If the proposed residence is moved closer to Portuguese Bend Road to reduce the crowding
effect, there would be a substantial increase in grading and net lot disturbance. The proposed
residence has been placed at approximately the same location as the existing structure in
order to reduce grading and to maintain existing landforms.
• If the proposed residence is moved closer to the road, city and coastline views will be
impacted and there will be an increase in traffic noise from Portuguese Bend Road.
C. PUBLIC WELFARE
The granting of such variance will not be materially detrimental to the public good because the
guest house, for which a variance is requested, will not be seen from Portuguese Bend Road or
from neighboring properties.
On the other hand, if the main house were to be sited closer to Portuguese Bend Road in order to
place the guest house behind it, a substantial amount of existing trees and other vegetation would
probably need to be removed due to grading. The residence would then be more visable from
Portuguese Bend Road and this would increase the appearance of greaterdevelopment on the
property.
D. SPIRIT AND INTENT
Because of the special circumstances which apply here, the granting of a variance in this case will
not prejudice the application of City codes and ordinances in other circumstances. In fact the
avoidance of the appearance of overcrowding on the site is within the spirit and intent of
development codes.

the proposed project on March 15, 2005.
The Planning Commission will visit two otherproperties before visiting your project.
The field trip public hearing will start at 4:00 p.m. on that day on another property. It
is anticipated that the Commission 'will arrive at your property shortly before 5:00
p.m. •

SILHOUETTE CONSTRUCTION GUIDELINES
When required by the Planning Commission or City Council, a silhouette of
proposed construction should be erected for the week preceding the
designated Planning Commission or City Council meeting.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not
acceptable.
Bracing should be provided where possible.
Wire, twine or other suitable material should be used to delineate roof ridges
and eaves.
Small pieces of cloth or flags should be attached to the wire or twine to aid i n
the visualization of the proposed construction.
• The application may be•delayed if inaccurate or incomplete silhouettes are
constructed.
