32, Construct barn 16 1/2 ft of N., Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING'HILLS 2 COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the matter of the Application ) ) of ) ZONING CASE NO. 32 ) FREDERICK W. HESSE ) Lot 124, Rolling Hills, M.B. 201-29/35 ) ) The application of Frederick W. Hesse, Lot 124, Rolling Hills, to establish a side yard variance, came on for hearing on the 14th day of May, 1963, at the hour of 8:00 P.M., at the City Hall of the City of Rolling Hills, California, and the applicants having submitted evidence in support of their application, and the Planning Commission being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Frederick W. Hesse, is the owner of that certain real property described as Lot 124, Rolling Hills Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II, That no person appeared at said public hearing in opposition to the application for a 'variance and that no evidence was received by the Commission in opposition thereto. III In accordance with the plot plan filed herein the Commission finds that the proposed 4-horse barn is to be located twenty-five (25) feet from the side line of said lot instead of thirty-five (35) feet as required by said Zoning Ordinance. The Commission further finds that by reason of the terraine of said Lot 124, the variance "soci0f,d, should be granted to applicant in order to preserve substantial property 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 rights possessed by other property in the same vicinity and zone and that the granting of such variance will not be materially detrimental to the public welfare or injurious to property or improvements in such vicinity and zone in which applicant's property is located and that there are exceptional and extraordinary circumstances and conditions by reason of physical location and terraine of said Lot 124 which do not apply generally to other property in the same vicinity and .zone. IV. From the foregoing it is concluded that a variance should be granted by the Planning Commission of the City of Rolling Hills to Frederick W. Hesse on Lot 124, Rolling Hills, in accordance with the Plot Plan marked Exhibit 1 on file in these proceedings, subject to the following conditions: 1, that Mr. Hesse execute a release to the City of Rolling Hills and Rolling Hills Community Association relieving them of any responsibility in case of slippage as a result of new construction; 2, that the fence be removed from the easement; 3, that the barn be constructed in accordance with the plot plan marked Exhibit A and filed in the Planning Commission's records„ and it is, therefore, so ordered.
