SUBJECT: ZONING CASE NO. 808. Request for a Conditional Use Permit at
7 Ringbit Road E.
Dear Mr. and Mrs. Shadden:
The Planning Commission at their November.15 meeting chose to continue the
meeting on your request for a Conditional Use Permit to authorize the use of the
two-story structure for a guest room. The Commissioners stated that the
structure is charming, unobtrusive and in character with Rolling Hills, however
the approval is complicated due to the fact that the City's ordinance prohibits
two-story structures, except for stables. Staff originally suggested that the first
story be closed off and not accessible from the outside or inside. Given that the
structure exists and was built with permissions and building permits, it would be
approvable from the use standpoint with a CUP, although it would result in a
very high one story structure, which in itself is not typical for Rolling Hills. Mr.
Roger North, your architect, requested that the Planning Commission allow the
structure to remain as is, due to the location of the water heater on the lower
level, and stated that you would like to install a heating unit there as well, both
of which need access.
The Commissioners directed staff to review the City's building and zoning codes
to determine if there is a provision that would render the lower level legal as
other than a "story". Staff and the City Attorney's office will be looking into this
and will report to the Planning Commission at their next meeting on December
20, 2011.
Please be advised that should we not be able to find a legal provision to allow
this structure to be used as a guest room, due to the two-story configuration, the
use on both levels will have to revert to a "tack room" use, which allows storage.
The other option would be to go back to the original recommendation to enclose
the entire bottom floor, and move the mechanical equipment outside. Under
such conditions, it seems that the Planning Commission could approve the upper
story as a "guest room".

Regarding the issue for a set aside area for a future stable and corral, the area as
shown on the site plan is too close to the residence. The County Health Code
requires stables and corrals to be located no less than 35 feet from residential
uses. Should you be resubmitting plans for any improvements, please show the
stable and corral a minimum of 35 feet from the residence, including the garage,
in an area that would be practical for a future stable and corral.
The Planning Commission's meeting will be held on Tuesday, December 20, 2011
beginning at 6:30 PM at Rolling Hills City Hall. The staff report will be mailed to
you and Mr. North on Friday, December 16.
