The County of Los Angeles has requested additional cross -sections and information regarding our
final as -graded report dated February 27, 2004.
Our responses are as follows:
Comment 1:
Provide sufficient sections through each slot of the buttress fill (A, B, C, D-1, D-2, D-
3, E) that depict construction/dimensions of the buttress and include corresponding
geologic conditions collected during excavation and mapping of the back -cut, i.e.
bedding orientation, bedrock vs. landslide debris, seepage, subdrains, etc.
Response 1: We have prepared six geologic sections, one in each slot at a one 1" = 20' scale and
they are attached.
Comment 2: The as -built geotechnical map and cross-section must have the same scale (the
geological map provided is at a 1" = 30' scale versus a 1" = 40' for the sections).
Response 2: We attempted to make the drawings a size that could be handled and stored. We have
now made plans and sections at 1" = 20' and the holder can store them as they wish.
We can see them better at 1" = 20'.
Comment 3: Three of the eight test results presented in the 2/27/04 report show shear strength
parameters that are below the designed shear strength parameters required for
surficial stability purposes. Indicate whether these lower strength materials were used
in the upper 4 feet of the slope materials. If so, then recommend mitigation as
necessary.
Response 3:
We performed numerous tests on the re -molded samples of the fill. We found that the
material was all the same for the site; the test differences were caused by the amount
of rock in the sample.

The soil in each slot was entirely excavated. A pile from 10,000 c.y. to 20,000 c.y.
was created at the top of slope, then the pile was placed in the slot to finished grade.
The soil in the pile was a mixture of soil, slide debris, topsoil and excavated rock.
The soil was moved at least three times and mixed each time. We estimated that after
compaction with the sheepsfoot, the material was 20% to 30% angular gravel up to
four inch diameter and the remainder diatomaceous silt and sand.
The laboratory testing showed that as we increase the amount of gravel, the shear
strength increased. Since the fill had gravel up to four inches diameter, we chose to
use up to '/2-inch diameter particles in the remolded shear samples. Since the sample
is only one inch thick and 2.5 inches diameter, these particles affected the strength.
For example, if there were three stones over'/z-inch diameter in a sample, the strength
was higher that one stone in a sample.
We tried to test soil with no gravel, but got only silt -type behavior, so we chose to
test with some gravel.
There is no ASTM Standard for how much gravel to allow in a sample of fill with
30% floating angular gravel, so we chose to perform many tests and use an average
strength. We could have allowed gravel up to %-inch in the sample and made a 4)
angle of 40°, but we used our judgment and experience to create a truly representative
sample.
The answer to the question is that all of the soil is the same in the buttress, the
variation observed was due to the sampling procedure.
In fact, the soil is even stronger than we measured, because it has much larger angular
gravel than tested. We considered creating a field test to measure shear strength, but
again, there was no ASTM Standard, and the test would be very costly.
No mitigation is required, the soils were much stronger than the required 4) = 30°, c =
200 p.s.f.
It appears that one set of maximum density and optimum shear moisture content
value was used in determining the relative compaction of the fill placed at this site.
However, 5 compaction curves and eight shear strength tests results are presented in
the 2/27/04 report, inferring that more than one type of fill material was used at this
site. Verify and revise Table 1 as necessary.
We performed at least one maximum density test daily on the project..Because of all
the mixing and stockpiling, the materials were so similar that we used the same
maximum density. The large stockpiles were a very efficient mixing system.
Please show the subdrain locations/outlets that were placed to drain the heavy
seepage encountered during November/December.
The subdrain outlets are shown on the plan (Figure 2). The outlets are exposed.

Comment 6: The soils engineer and geologist shall make a finding in accordance with Section
3318.1.2 and 3318.1.3, respectively, which must also include a statement in
compliance with Section 111 of the Los Angeles County Building Code, the
statement provided is inconclusive regarding finished construction of the buttress fill,
revise as appropriate.
Response 6: According to Section 7021.3 of the California Building Code:
Reports prepared by the engineering geologist retained to provide such
services in accordance with Section 7020.4 including a final description of the
geology of the site and any new information disclosed during the grading and
the effect of same on recommendations incorporated in the approved grading
plan. Engineering geologist shall submit a statement that to the best of their
knowledge, the work within their area of responsibility is in accordance with
the approved engineering geology report and applicable provision of this
code.
111 Statement
The area of the buttress fill is deep fill and subject to large settlements. We limited any future
building pads as shown on the plan. As long as the future building is confined to the outlined area,
there is no danger of settlement exceeding one inch or subsidence or landsliding. Such a statement
cannot be made for areas of 6 Sagebrush Lane which are outside the marked area or areas of 5
Sagebrush near the fill slopes. Areas within 20 feet of the top of slope are subject to lateral creep and
settlement exceeding one inch.
Comment 7: Show all recommended building restriction areas on the as -built geotechnical map.
Response 7: The limits of recommended allowable building areas are clearly shown on Figures 2
and 3.

This letter shall serve to notify you that the City Council at their April 24, 2006
meeting received and filed the resolution of approval adopted by the Planning
Commission on April 18, 2006, granting a lot line adjustment in Zoning Case No.
724.
The Planning Commission's decision in this matter shall become effective thirty
days after the adoption of the resolution or by 5/18/06 unless an appeal has been
filed or the City Council takes jurisdiction of the case within that thirty (301 day
appeal period. (Section 17.54.010(B) of the Rolling Hills Municipal Code). If no
appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's resolution, the Planning Commission's action will become final.
However, with Lot Line Adjustment application, the lot line adjustment does not
become final until legal descriptions, plot plan, new deeds to the properties and
other pertinent documents are recorded. You will also be required to record the
Resolution of Approval together with an Affidavit of Acceptance Form. I will
forward them to you together with all of the other documents that will have to be
recorded.
Meanwhile, please sign and notarize the enclosed forms and return to this office.
They will become a part of the documents to be recorded.
In addition, please submit the following information:
1. Legal descriptions (long version) for the adjusted lots,
2. Legal descriptions of the easements to RHCA,

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROLLING HILLS AUTHORIZING THE ISSUANCE OF A
CONDITIONAL CERTIFICATE OF COMPLIANCE FOR A LOT
LINE ADJUSTMENT FOR PROPERTIES AT 5 SAGEBRUSH LANE
(LOT 100-3-RH, DEVELOPED LOT) AND A VACANT LOT
NORTH THEREOF (LOT 100-4-RH) IN ZONING CASE NO. 724,
(HAO).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. James Hao with respect
to real property located at 5 Sagebrush Lane (Lot 100-3-RH) and a vacant lot
known as 6 Sagebrush Lane (Lot 100-4-RH) requesting a Certificate of
Compliance for a Lot Line Adjustment to move the common side lot lines
dividing Lot 100-3-RH (5 Sagebrush Lane) and Lot 100-4-RH (known as 6
Sagebrush Lane), where a portion of northerly Lot 100-3-RH will be transferred to
Lot 100-4-RH and a portion of north-westerly lot 100-4-RH will be transferred to
Lot 100-3-RH.
Section 2. California Government Code Subsection 66412(d) authorizes
lot line adjustments without requiring a tentative map, parcel map or final map if:
(A) The lot line adjustment involves two or more existing adjacent parcels, where
land is proposed to be taken from one parcel and added to an adjacent parcel; (B)
A greater number of parcels than originally existed is not thereby created; (C) The
lot line adjustment will create parcels that conform to local zoning and building
ordinances; and (D) The lot line adjustment is approved by the City. The City may
impose conditions on the Lot Line Adjustment in order to make the lot conform to
local zoning and building ordinances, to require the prepayment of real property
taxes prior to the approval of the Lot Line Adjustment or to facilitate the
relocation of existing infrastructure or easements.
Section 3. The Planning Commission conducted a duly noticed public
hearing to consider the application at a regular meeting on March 21, 2006. At the
March 21, 2006 meeting, the Planning commission determined that a field visit to
the site would not be necessary as all parties are very familiar with the project.
Section 4. The Planning Commission finds that the project is
categorically exempt from environmental review under the California
Environmental Quality Act pursuant to a Class 5 exemption provided by Section
15305 of the State CEQA Guidelines.
Section 5. The Planning Commission has considered the evidence, both
written and oral, presented in connection with this application and finds as
follows:

A. Section 16.16.010(B) of the Rolling Hills Subdivision Ordinance and
Section 17.16.060(A) of the Rolling Hills Zoning Ordinance requires that each lot
in any subdivision in the RA-S-2 Zone shall have a net area of not less than
eighty-seven thousand one hundred twenty square feet (2.0 acres). The proposed
lot line adjustment will result in Parcel 1, Lot 100-3-RH being 2.00 net acres and
Parcel 2, Lot 100-4-RH being 2.01 net acres, exclusive of: (a) any and all perimeter
easements measured to a minimum lineal distance of ten feet perpendicular to the
property lines; (b) any portion of the lot or parcel of land used for roadway
purposes; and (c) any private drive or driveway which provides access to any
other lot or parcel of land.
B. Section 16.16.020 of the Rolling Hills Subdivision Ordinance and
Section 17.16.060(B)(3) of the Rolling Hills Zoning Ordinance require that in all
cases where practicable, the sidelines of lots shall be at approximate right angles
or radial to the street upon which such lot fronts. Due to the location of the
"double" private street, Sagebrush Lane, which crosses Lots 100-3-RH and 100-4-
RH and culminates in a cul-de-sac on both properties, the resulting 2 lots off of
Sagebrush Lane will not meet this condition. However, this is a pre-existing
condition and the proposed lot line adjustment would not affect the angle of the
sideline to Sagebrush Lane on these two parcels.
C. Section 16.20.230 of the Rolling Hills Subdivision Ordinance
requires that easements, the width of which are to be determined by the Rolling
Hills Community Association, be dedicated for bridle trail and utility purposes
over the strips and portions of land within and abutting upon the sidelines and
rear lines of each lot. The proposed adjustment provides for 25-foot easements,
or as otherwise approved by the Association, on each side of the adjusted lot
lines and equestrian trails within the easements, and will be recorded
concurrently with the Certificate of Compliance for lot line adjustment.
D. Chapter 16.48 of the Rolling Hills Subdivision Ordinance provides
procedures for processing of certificates of compliance, which is a document that
acknowledges that subject parcels are considered by the City to be legal lots of
record. City records indicate that both parcels were created legally. The recently
remediated vacant Parcel 100-4-RH is deemed buildable by the Los Angeles
County Department of Public Works, subject to additional soil, hydrology and
geology studies.
E. Conditions have been attached to this approval which provide that
it will not impair or limit the City's application of the Site Plan Review or any
other Ordinance or Code to any future development of Lot 100-3-RH and Lot
100-4-RH, including but not be limited to further study of soils, geology,
hydrology, grading and other requirements.
Section 6. In accordance with the foregoing findings, a Conditional
Certificate of Compliance for lot line adjustment sought in Zoning Case No 724
as indicated on the map attached hereto as Exhibit "A" stamp dated March 08,
2006 is hereby approved subject to the following conditions:

A. The Lot Line Adjustment approval shall expire within two years
from the effective date of approval as defined in Section 17.46.070, unless
otherwise extended pursuant to the requirements of this section.
B. There shall be twenty-five (25) foot easements on each side of the
adjusted lot lines within the adjusted boundaries of the lots, or as otherwise
required by the Rolling Hills Community Association. The maps attached to the
Conditional Certificate of Compliance, referred hereto as Exhibit "A" shall
delineate and note the easements and trails specified in this paragraph.
C. The lot line adjustment approval shall not in any way constitute
any representation that the adjusted lots can be developed even if in compliance
with current zoning and building ordinance standards. No development shall
occur on the properties without first complying with all applicable City Building
and Zoning requirements and other applicable rules and regulations.
D. The lot line adjustment shall not in any respect limit or impair the
City's application of the Site Plan Review Ordinance (Ordinance No 221, 1988) to
Lot 100-3-RH and 100-4-RH at such time as an application is made for
development.
E. The Certificate of Lot Line Adjustment shall not be issued until a
legal description complying with the delineation of adjustment, and including
the required easements and trails as specified in Paragraph C of Section 5 are
submitted to, and approved by the City. Upon the City's approval of the legal
descriptions of the new adjusted lines, trails and easements, a Certificate of
Compliance shall be issued by the City, shall be recorded by the property owner
in the offices of the Los Angeles County Recorder, and evidence of the
recordation shall be returned to the City.
F. The applicant shall record the deeds of the properties effectuating
the transfer concurrently with the Certificate of Compliance for the Lot Line
Adjustment and shall submit proof of such recordation to the City of Rolling
Hills.
G. The applicants shall execute an Affidavit of Acceptance of all
conditions of this Resolution or the Lot Line Adjustment shall not be effective.
H. Prior to recordation of the lot line adjustment, the applicant shall
submit proof that current property taxes have been paid on both parcels.

On March 16, 2006 the RHCA Board of Directors unanimously approved the proposed
lot line adjustments for 5 and 6 Sagebrush Lane prepared by Wynn Engineering Co. for
Mr. Hao. The approval is contingent upon preservation of the existing trail and
restoration of easements.
