Pursuant to the authority and criteria contained in the California Environmental
Quality Act (CEQA), and the CEQA Guidelines of the City of Rolling Hills, staff has
prepared an Initial Environmental Study for the subject project. Staff has
determined that although the project could have significant effect on the
environment, mitigation measures have been added to this project and will be
implemented, which will render the effect on the environment insignificant.
Enclosed please find the Notice of Intent to Adopt A Mitigated Negative
Declaration together with the Initial Study and the Mitigation Measures for subject
case. Please review and direct all comments in writing to Yolanta Schwartz,

PROJECT ADDRESS: 5 Sagebrush Lane, (Lot 100-3-RH), and adjacent vacant
lot, (Lot 100-4-RH) Rolling Hills, CA 90274 (A.P.N 7569-011-
013,014). A 1,200 square foot area of a vacant lot, consisting of 9.2
acres will also be affected by this project. Subject lot is located west
of 5 Sagebrush Lane and is known as 3 Appaloosa Lane, (LOT
246-MS, A.P.N 7569-026-011).
PROJECT DESCRIPTION: Zoning Case No. 657, Site Plan Review and
Variances - Request for a site plan review to permit substantial grading; and
request for variances to exceed the maximum permitted disturbed area of the lots
and to exceed the maximum permitted slope gradient for the purpose of repairing
slope failure.
Subject project encompasses two single-family residential lots. One of the lots is
vacant and the other lot, 5 Sagebrush Lane is developed with a single-family
residence and accessory structures. Both lots are experiencing extensive earth
movement. A third lot located at 3 Appaloosa Lane, (A.P.N. 7569-026-011),
which is undeveloped, will be affected by this project. 1,200 square feet of that
portion of said lot adjacent to 5 Sagebrush Lane, (to the northeast), will be
graded in order to construct a buttress for 5 Sagebrush Lane. Subject lot is not
experiencing slope failure.
The applicant proposes to conduct substantial grading and excavation,
approximately 160,000 cubic yards of cut and fill, in order to repair slope failure
on subject properties and restore stability of the residential site. The gross lot
area of both lots is 4.9 acres. The area affected by the slope failure is
approximately 3.3 acres in size. 46% of lot 3 will be disturbed and 90% of lot 4
will be disturbed. The applicant is proposing to excavate the slope failure area

and replace it with a buttress fill keyed through the ancient slope failure mass. A
buttress fill is proposed along the westerly sides of both properties and along the
easterly and northerly sides of the vacant lot. A buttress is a tightly compacted fill
that acts like a retaining wall and is designed to hold the soil movement. The
grading will be done in slots to avoid stockpiling of soil. An installation of a storm
drain pipe through a portion of the buttress may be required. There is an existing
single family residential development on lot 3, 5 Sagebrush Lane, which is
endangered by the continually moving soil.
Pursuant to the requirements of the California Environmental Quality Act,
(CEQA), an Initial Environmental Study was prepared for the proposed project.
The study identifies environmental factors, which would be potentially affected by
the proposed project. Those factors that would be impacted include air quality;
biological resources due to habitat modification; geology and soils due to the
extensive grading; hydrology due to substantially altering existing drainage
pattern; land use and planning due to the project being in conflict with the Zoning
Ordinance; noise generated during construction; and traffic generated during
construction. Although the impacts will be temporary in nature, mitigation
measures will be included with the project, which will lessen the impacts to level
of insignificance.
FINDINGS OF NO SIGNIFICANT EFFECT:
BASED ON. THE INITIAL STUDY, AND RELEVANT DOCUMENTS IT HAS
BEEN DETERMINED THAT WITH IMPLEMENTATION OF MITIGATION
MEASURES THE PROJECT WILL NOT HAVE A SIGNIFICANT EFFECT ON
THE ENVIRONMENT.
Public comments on the Mitigated Negative Declaration will be received by the
City of Rolling Hills from January 27, 2003 to February 17, 2003. Copies of all
relevant materials including the project specifications are on file in the offices of
The City of Rolling Hills. 2 Portuguese Bend Road, Rolling Hills. CA 90274 and
any person is welcome to review the proposed project. Please forward any

The Planning Commission is scheduled to consider this item at their adjourned

The Planning Commission of the City of Rolling Hills will conduct a field
inspection to view two properties where substantial grading is proposed to
correct slope failure. Said field trip will take place on Saturday, January 11, 2003
at approximately 8:20 AM at 5 Sagebrush Lane.
The Commission's time schedule is to visit another property at 8:00 AM.

of the proposal. The purpose of the field trip is to familiarize the Commission
and interested parties with the location, topography, size and extent of the
proposed grading. Although plans will be available at the site, detailed review of
the project is not anticipated.
Any person is welcome to attend this field trip. However, due to time constraint
during the field visit, extensive testimony and comments will be considered at
the regular Planning Commission public hearing, described below. You are
urged to review the application, plans and minutes of the 12/17/02 Planning
Commission meeting on subject application prior to the site visit. These and
other pertinent documents are available at the City Hall Administration Building

involve changes or additions to the existing single family
residence, located at 5 Sagebrush Lane.
An Environmental Review for the proposed project is
being prepared and will be circulated to the appropriate
agencies for their review and comment. A separate
notice for the availability of the Negative Declaration will
be published and the Environmental documents will be
available for review by the public prior to the Planning
Commission taking any action in this case.

those issues you or someone else raised at the public
hearing described in this notice, or in written correspon-
, dence delivered to the Planning Commission at, or prior
