12/23/19911 l i MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA December 23, 1991 A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Pernell at 7:33 p.m. on Monday, December 23, 1991 in the City Council Chambers at the City Hall/ Administration Building, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL PRESENT: ABSENT: ALSO PRESENT: CONSENT CALENDAR Councilmembers Heinsheimer, Murdock, Mayor Pro Tem Swanson, Mayor Pernell Councilmember Leeuwenburgh (excused) Craig Nealis Michael Jenkins Lola Ungar Lucile Rogers City Manager City Attorney Principal Planner Minutes Secretary Mayor Pro Tem Swanson moved approval of the Consent Calendar, Councilmember Murdock seconded and the motion passed without objection. a. Minutes - Meeting of November 25, 1991. (Approved as presented) b. Minutes - Adjourned Regular Meeting of December 4, 1991. (Approved as presented) C. Payment of Bills - Demands Number 6000 through 6043 dated December 23, 1991 in the amount of $49,759.77 were approved for payment from the General Fund. d. Financial Statement for the month of November. (Approved as presented) 1 Rolling Hills City Council Meeting - 12/23/91 PLANNING COMMISSION ITEMS A. RESOLUTION OF APPROVAL NO. 91-30 ZONING CASE NO. 466 Address: 48 Saddleback Road (Lot 9-4-RH) Owner: Dr. Roberto Unguez City Manager Nealis reported that the Planning Commission approved this request for a Variance to permit construction of retaining walls that encroach into the front and side yard setbacks. Resolution of Approval No. 91-30 was accepted by the City Council without objection. B. RESOLUTION ZONING CASE Address: Owner: Applicant: OF APPROVAL NO. 91-31 NO. 468 2862 Palos Verdes Drive North (Lot 992-A-RH) Mr. Franz Fischer Mr. Gary Wynn, David C. Breiholz and Company City Manager Nealis advised that the Planning Commission approved granting this Variance permitting previously imported soil to remain on the lot and permitting previously constructed retaining walls which encroach into the front yard setback to remain. In reply to a question from Councilmember Murdock, City Manager Nealis stated that although the importation of soil had been done without permit approval, it will meet all City safety standards and slope requirements; therefore, the work was approved. Resolution of Approval No. 91-31 was accepted by the City Council without objection. PUBLIC HEARINGS A. CONSIDERATION OF DRAFT AMENDMENT TO THE HOUSING ELEMENT OF THE CITY OF ROLLING HILLS GENERAL PLAN. (a) RESOLUTION'NO. 660: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ADOPTING THE 1991 HOUSING ELEMENT OF THE GENERAL PLAN OF THE CITY OF ROLLING HILLS AND A NEGATIVE DECLARATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. City Manager Nealis reported that the City's draft revised Housing Element was submitted to the State Department of Housing and Community Development for review, and appropriate changes were made to the revised draft in response to the HCD comments. The Planning Commission has recommended approval by the City Council. Mayor Pernell opened the public hearing. 2 Ll Rolling Hills City Council Meeting - 12/23/91 Mr. Richard Colyear, 35. Crest Road West, asked several questions relating to payments to Cotton/Beland Associates. Mayor Pernell suggested that such questions be submitted in writing to allow staff time to research and prepare answers, and reminded Mr. Colyear that this public hearing was for comments on the draft Housing Element. Mr. Colyear raised several objections to the Land Use Controls section of the draft Housing Element, specifically with reference to the preclusion of second units on single-family lots. He contended that the City of Rolling Hills is legally obligated to permit its fair share of low and moderate income housing, and stated that exclusionary zoning could lead to litigation by public interest law firms. He urged the City Council not to take actions which would zone out poor or less fortunate people. No additional public testimony being offered, Mayor Pernell closed the public hearing. Councilmember Heinsheimer moved approval of Resolution No. 660 adopting the revised draft Housing Element and incorporating the changes contained in Cotton/Beland's letter of December 23, 1991. The motion was seconded by Councilmember Murdock and passed 4-0. OLD BUSINESS None. NEW BUSINESS A. CONSIDERATION OF GRANT DEED FOR THE DONATION OF PROPERTY TO THE CITY. City Manager Nealis advised that a grant deed has been prepared to transfer 5,443 square feet of land immediately east of the Rolling Hills City Hall from its owner, Mr'. Samuel A. Keesal, Jr. to the City of Rolling Hills. Councilmember Murdock moved that the City accept the grant deed and direct staff to take appropriate actions to complete the paperwork required for the transfer. The motion was seconded by Councilmember Heinsheimer and passed 4-0. Mayor Pro Tem Swanson suggested that a letter of appreciation be sent to Mr. Keesal for his generous gift to the City. Rolling Hills City Council Meeting - 12/23/91 B. RESOLUTION NO. 655: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, APRIL 14, 1992, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES. C. RESOLUTION NO. 656: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO RENDER SPECIFIED SERVICES TO THE CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, APRIL 14, 1992. D. RESOLUTION NO. 657: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION TO BE HELD ON TUESDAY, APRIL 14, 1992. E. RESOLUTION NO. 658: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, ORDERING THE CANVASS OF THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, APRIL 14, 1992 BE MADE BY THE CITY CLERK. City Manager Nealis advised that all four Resolutions pertain to the General Municipal Election to be held on Tuesday, April 14, 1992, and all four could be considered for adoption in one motion. Mayor Pro Tem Swanson moved adoption of Resolutions No. 655, 656, 657 and 658, Councilmember Heinsheimer seconded and the motion passed 4-0. F. RESOLUTION NO. 659: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, AWARDING THE CITYWIDE REPLACEMENT OF TRAFFIC STRIPING AND PAVEMENT MARRING CONTRACT TO SAFETY STRIPING SERVICE, INC. OF VENTURA, CALIFORNIA. City Manager Nealis reported that four bid packages were distributed to contractors and Safety Striping Service, Inc. was the sole bidder. Their price of $20,593.70 compares favorably with rates charged by other contractors, and they have been recommended highly by several cities. Mayor Pro Tem Swanson moved adoption of Resolution No. 659 awarding the Citywide replacement of traffic striping and pavement marking contract to Safety Striping Service, Inc. Councilmember Heinsheimer seconded and the motion passed 4-0. 0 1 1 Rolling Hills City Council Meeting - 12/23/91 OPEN AGENDA No one present wished to speak on the open agenda. MATTERS FROM MEMBERS OF THE CITY COUNCIL Councilmembers expressed happy holiday wishes to all. MATTERS FROM STAFF City Manager Nealis reported that he would like to attend a meeting of the League of California Cities from February 5-7, 1992 in San Diego if his workload permits. Mayor Pernell advised him to use his own discretion and good judgment in determining whether or not to attend. MATTERS FROM THE CITY ATTORNEY City Attorney Jenkins thanked Councilmembers for the Holiday Open House on December 9 and wished everyone a happy holiday season.
