REGULAR MEETING OF THE CITY COUNCIL OF THE
CITY OF ROLLING HILLS, CALIFORNIA
March 23, 1992
A regular meeting of the City Council of the City of Rolling
Hills was called to order by Mayor Pernell at 7:36 p.m. on Monday,
March 23, 1992 in the City Council Chambers at the City Hall/
Administration Building, 2 Portuguese Bend Road, Rolling Hills,
California.

Mayor Pro Tem Swanson moved approval of the Consent Calendar,
Councilmember Heinsheimer seconded and the motion passed without
objection.

RECESS AND RECONVENE
Mayor Pro Tem Swanson announced that birthday cake would be
served in honor of Mayor Pernell's birthday. A five-minute recess
was called at 7:38 p.m. while refreshments were shared with all
present. The meeting was reconvened at 7:43 p.m.

PUBLIC HEARINGS - CONTINUED
A. ZONING CASE NO. 461: CONSIDERATION OF AN APPEAL OF PLANNING
COMMISSION ACTION REAPPROVING A VARIANCE FOR THE ENCROACHMENT
OF A RETAINING WALL INTO THE SIDE YARD SETBACK, REAPPROVING A
CONDITIONAL USE PERMIT FOR THE RECONSTRUCTION OF A PREVIOUSLY
CONSTRUCTED CLAY SPORTS COURT, AND REPEALING RESOLUTION NO.
91-27.
OWNER: Dr. and Mrs. Mohan A. Bhasker
ADDRESS: 42 Portuguese Bend Road (Lot 120-RH)
Mayor Pernell asked if the appellant would be willing to hold
this matter over to the next City Council meeting in order that it
could be discussed by the full Council. Mr. Doug McHattie of South
Bay Engineering, representing Dr. and Mrs. Bhasker, indicated his
agreement with the continuance.

OLD BUSINESS
�. A. ORDINANCE NO. 235: An Ordinance of the City of Rolling Hills
regulating the use of steel -jawed leg -hold traps within the
limits of the City and amending the Rolling Hills Municipal
Code.
Mayor Pro Tem Swanson moved adoption of Ordinance No. 235,
Councilmember Heinsheimer seconded and the motion passed without
objection.

B. RESOLUTION NO. 672: A Resolution of the City Council of the
City of Rolling Hills, California approving the Final Draft of
the City's Household Hazardous Waste. Element (HHWE) in
response to the Integrated Waste Management Act of 1989 (AB
939).
City Manager Nealis reported that this Resolution memorializes
the action of the City Council on March 9, 1992 approving the final
draft of the HHWE.
Mayor Pro Tem Swanson moved .adoption of Resolution No. 672,
Councilmember Heinsheimer seconded and the motion passed without
objection.
NEW BUSINESS
A. CONSIDERATION OF SUPPLEMENTAL NOTICE OF CLAIM SUBMITTED BY THE
DEFENDANT RHONE-POULENC BASIC CHEMICALS COMPANY (UNITED STATES
OF AMERICA V. MONTROSE CHEMICAL COMPANY).
City Manager Nealis reported that this claim has resulted from
the United States of America v. Montrose Chemical Company case, and
the City Attorney has recommended that the claim be rejected, as
was the Montrose claim.
Councilmember Heinsheimer moved that the claim be rejected,
Mayor Pro Tem Swanson seconded and the motion passed without
objection.
B. AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT FOR THE CITY
OF ROLLING HILLS GENERAL PLAN AND ZONING ORDINANCE BETWEEN
COTTON/ BELAND/ASSOCIATES , INC. AND THE CITY OF ROLLING HILLS.
City Manager Nealis advised that the City entered into a
contractual relationship with Cotton/Beland/Associates prior to
1991 for services to update the City's General Plan and Zoning
Ordinance documents. All elements of the General Plan have been

completed and adopted, and the Zoning Ordinance now needs to be
brought up to date. The proposed amendment provides that this be
accomplished at a cost not to exceed $8,850. It is expected that
the final document will be available in late July or early August.
The City Attorney has reviewed and approved the amendment.
Mayor Pro Tem Swanson moved adoption of the Amendment to the
Professional Services Agreement, Councilmember Heinsheimer seconded
and the motion passed without objection.
OPEN AGENDA
No one present wished to speak on the open agenda.
MATTERS FROM MEMBERS OF THE CITY COUNCIL
Mayor Pro Tem Swanson reported that she met with City
Treasurer Courtright and Councilmember Murdock for a Finance
Committee review of the preliminary City budget. Everything seems
to be in good order.
Councilmember Heinsheimer noted that the entire City Council
sends their best wishes to Councilmember Leeuwenburgh, who is
currently in Torrance Memorial Hospital.
MATTERS FROM STAFF
City Manager Nealis thanked City Treasurer Courtright for his
help in preparing the preliminary City Budget.
City Manager Nealis reported that the City of Rolling Hills
Estates has requested support for Senate Bill 1861, which would
authorize specifically trained law enforcement officers to stop and
remove a big rig from the streets if they deem it unsafe for
travel. Under current law, only a California Highway Patrol
officer can remove a vehicle from traffic.
In reply to Mayor Pernell, Captain Bill Mangan indicated that
the Sheriff's Department is in favor of the Bill. He said that
there are many officers in his department who attend the CHP
training and they also have training in their own academy to
prepare officers to perform these duties.
Councilmember Heinsheimer moved approval of the request of the
City of Rolling Hills to support Senate Bill 1861, and asked the

Mayor and Staff to draft an appropriate letter. The motion was
seconded by Mayor Pro Tem Swanson and passed without objection.
Mayor Pro Tem Swanson added that she had a recent meeting with
Captain Mangan to discuss the problems of crime and gang activity
in neighboring communities. She thanked Captain Mangan for his
time and helpfulness.

None.
CLOSED SESSION
There was no need for a closed session.
ADJOURNMENT
The meeting was adjourned at 7:56 p.m. to Monday, April 13,
1992 at 7:30 p.m.
