3/28/1994MINUTES; ;OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA MARCH 28, 1994 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Murdock at 7:35 p.m. on Monday, March 28, 1994, in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL Councilmembers Present: Swanson, Pernell, and Mayor Murdock. Councilmembers Absent: Councilmember Heinsheimer (excused) and Mayor Pro Tem Leeuwenburgh (excused). Others Present: Craig R. Nealis, City Manager. Lola Ungar, Principal Planner. Larry Courtright, City Treasurer. Marilyn Kern, Deputy City Clerk. Steve Aryan, Administrative Intern. Captain Herb Pettus, Los Angeles County Sheriff's Department, Lomita Station. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Meeting of March 10, 1994. RECOMMENDATION: Approve as presented. b. Minutes - Meeting of March 14, 1994. RECOMMENDATION: Approve as presented. C. Payment of Bills. RECOMMENDATION: Approve as presented. d. Financial Statement for the Month of February, 1994. RECOMMENDATION: Approve as presented. e. Correspondence from Honorable John McTaggart, South Bay Steering Committee Chairperson and City of Rancho Palos Verdes Councilman, regarding Signal Synchronization Pilot Project 1. RECOMMENDATION: Receive and file. Councilmember Pernell moved approval of the recommendations contained in the Consent Calendar. Councilmember Swanson seconded the motion which carried unanimously. PLANNING COMMISSION ITEMS A. ZONING CASE NO. 504 MR. AND MRS. DON L. TUFFLI, 76 EASTFIELD DRIVE (LOT 120 -1 -EF) RESOLUTION NO. 94-8: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING SITE PLAN REVIEW APPROVAL FOR A PREVIOUSLY CONSTRUCTED SEMI -SUBTERRANEAN STORAGE BUILDING IN ZONING CASE NO. 504. Principal Planner Ungar presented the staff report outlining the Planning Commission's review of this Zoning Case. In response to Mayor Murdock, Principal Planner Ungar reported that the City became aware of the illegally constructed storage building through the Rolling Hills Community Association Architectural Inspector Roger Vink. She further reported that Mr. Tuffli indicated to Minutes City Council Meeting 03-28-94 -1- her that when he called the County Department of Building and Safety he was told that a building permit was not required for a 72 square foot improvement to his property. Principal Planner Ungar explained that Site Plan Review was triggered because of the grading required to construct the semi -subterranean storage building. Discussion ensued regarding how information regarding building permits and planning requirements is disseminated by the County and the City. Councilmember Swanson suggested that articles be placed in the Citywide Newsletter from time to time advising residents of the City's various planning and building regulations. Councilmember Pernell requested that the County Department of Building and Safety be contacted regarding the information Mr. Tuffli received in connection with this case. City Manager Nealis indicated that he would address this situation with the County and explain to them that certain follow up questions should be initiated when advising a resident on construction procedures. Councilmembers discussed the City's policy on "as built" construction. Staff was directed to review the policies of neighboring cities regarding penalties for "as built" construction and report back to the City Council. Hearing no objection, Mayor Murdock ordered that Planning Commission Resolution No. 94-8 granting Site Plan Review approval for a previously constructed semi -subterranean storage building in Zoning Case No. 504 be received and filed. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS None. OLD BUSINESS A. RESOLUTION NO. 733: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS GRANTING APPROVAL OF TENTATIVE PARCEL MAP NO. 21486, SUBDIVISION NO. 84, A REQUEST TO SUBDIVIDE A 6.07 ACRE EXISTING LOT THAT HAS ONE RESIDENTIAL UNIT INTO 2 SINGLE-FAMILY RESIDENTIAL LOTS FRONTING THE NORTHERN TERMINUS OF PINE TREE LANE IN ZONING CASE NO. 450. City Manager Nealis directed the City Council's attention to Principal Planner Ungar's memorandum regarding amendments that have been made to Resolution No. 733. He explained that Page 10, Paragraph 30(e) has been amended to add the following: "The covenant shall also include the removal of any structure, including but not limited to the garage, and other portions of the house, that lie within the thirty-five (35) foot required side yard setback along the eastern side of the property. The removal shall be completed within 12 months of the completion of the roadway extension."; and that Page 12, Paragraph 52 has been amended to add the following: "....demolish garage, and other portions of the house, that lie within the thirty-five (35) foot required side yard setback along the eastern side of the property; and construct a new minimum 2 -car garage on the western side of the house." Councilmember Swanson moved that the City Council adopt Resolution No. 733 granting approval of Tentative Parcel Map No. 21486, Subdivision No. 84, a request to subdivide a 6.07 acre existing lot that has one residential unit into 2 single-family residential lots fronting the northern terminus of Pine Tree Lane in Zoning Case No. 450 as amended. Councilmember Pernell seconded the motion which carried unanimously. NEW BUSINESS None. OPEN AGENDA APPROXIMATELY 8:00 P.M. PUBLIC COMMENT WELCOME None. Minutes City Council Meeting 03-28-94 -2- 1 1 1 1 MATTERS FROM MEMBERS OF THE, CITY. COUNCIL • Mayor Murdock announced that the California Contract Cities Association will conduct the Annual Election Meeting on April 20, 1994. • Mayor Murdock reported on correspondence received from Rancho Palos Verdes Mayor Steven T. Kuykendall regarding a proposed South Bay Law Enforcement Forum. Captain Herb Pettus provided the Council with an update on this program. Captain Pettus stated that he and Palos Verdes Estates Police Chief Johanson were working on establishing a date and location for the Forum. • Mayor Murdock also reported on correspondence from Rancho Palos Verdes Councilmember and South Bay Steering Committee Chairperson John C. McTaggart regarding meetings to discuss consolidation of South Bay (Transportation) Corridor Steering Committee and South Bay Cities Association. • Councilmember Swanson reported on recommendations that will be coming before the MTA regarding reductions in service which may impact Palos Verdes Peninsula transportation services. • Mayor Murdock discussed correspondence received from the County Sanitation Districts asking for the City Council's support in opposing SB 1666. (Mello) which would shift the Sanitation District's property tax revenues from enterprise special districts to the counties. Staff was directed to prepare correspondence to the Senate Local Government Committee on behalf of the Mayor and those Councilmembers present opposing this legislation. • Mayor Murdock announced that the Vista Grande Elementary School has scheduled Family Reading Day for April 8, 1994 and encouraged City Councilmember's participation in this event. • Mayor Murdock reported on correspondence received from Sergeant James R. Miller requesting the City Council's support for the Lomita Station running team on April 9, 1994, in the "10th Annual" 1994 Baker to Las Vegas, ChallengeCup Relay. Staff was directed to include an article on the event in the next Newsletter. MATTERS FROM STAFF • City Manager Nealis reported that construction of the gates to the recycling area would begin next week. ♦ City Treasurer Larry Courtright expressed his thoughts on local gun control legislation. MATTERS FROM THE CITY ATTORNEY None. CLOSED SESSION None.
