OF THE CITY OF ROLLING HILLS, CALIFORNIA
23.February 1960
The regular meeting of the -City Council of the
City of Rolling Hills was called to order by Mayor
Tourtelot at 7:30 P.M. Tuesday, 23 February 1960,
in the City Hall,
ROLL CALL
Present: Councilmen Goodman, Horn, Nielsen,
Roach and Mayor Tourtelot.
Absent: None
Also Present: City Clerk .Gilbert Myers, Deputy City
Clerk Phyllis Stockdale, City Attorney
William Kinley', Clifton A. Hix, Mr.
and Mrs. George M. Russell
MINUTES = MEETING OF 14 DECEMBER 1959
It was moved by Councilman Goodman that the minutes
of the meeting held 14 December 1959 be tabled until the
next meeting. The motion was seconded by Councilman Niel-
sen and unanimously carried.
RESOLUTION NO. 92
The Manager reported that the County Fire Department
had requested that the City institute proceedings to
annex a portion of the real property in the Crest Road
easement near the South Gate to the Consolidated Fire Pro-
tection District and accordingly presented a form of
resolution for so doing to the Council.
Thereupon, on motion made by Councilman Goodman,
seconded by Councilman Nielsen and, after discussion
in which all Councilmen participated, Resolution No. 92
entitled'"A Resolution of the City Council of the City
of Rolling Hills Requesting Approval of the Los Angeles
County Board of Supervisors of Proposed Annexation No.
67-59, Territory Located Within the City -of Rolling Hills,
to the Consolidated County Fire Protection District", was
on roll call vote by the City Clerk unanimously adopted.
Resolution No. 92 is set forth in full in the Book of
Resolutions.
CORRESPONDENCE
The City Clerk presented'correspondence, as follows:
a. letter of resignation dated 15 February 1960
from James L. Elliott, Chairman of the Traffic
Commission. On motion of Mayor Tourtelot,
L' seconded by Councilman Nielsen and carried
the resignation was accepted by the Council
and the City Attorney was directed to prepare
a resolution commending Mr. Elliott's service
to the City.
b. letter dated 11 February 1960 from the President
of the City Council of theCCity of Los Angeles
extending an invitation to attend an "Enlist-
ment Ceremony" February 25, 1960 at the Chambers
of the Los Angeles City Council.
c. letter dated February 15, 1960 from the City of
Lakewood enclosing a letter written by the Mayor
of that City to Governor Edmund G. Brown request-
ing that --he call a special session of the Legis-
lature to consider the narcotics problem, It was
moved by Councilman Goodman, seconded by Council-
man Nielsen and unanimously carried that the Mayor
be directed to write to Governor Brown and request
that he call a special session of the Legislature
concurrently with the coming budget session to
deal with the narcotics problem.
d. copy of letter dated February 11, 1960 to the
Palos Verdes Peninsula Realty Board, Inc. from
the City of Palos Verdes,Estates thanking the
Board for its financial support in opposing the
proposed water rate increase.
e. letter from the County Engineer of Los Angeles
County dated 15 February 1960 regarding the
correction of street names in the City of Rolling
Hills on County index maps. The matter was re-
ferred to the City Attorney for.study.
f. certified copy of Resolution No. 1680cof the City
of Gardena, requesting the State Highway Com-
mission of the State of California to Provide
for a Permanent Off -Ramp of the Harbor Freeway
at Redondo Beach Boulevard.
g. letter dated February 16, 1960 from Allan F.
Bullard of 3 Eucalyptus Lane regarding the pro-
posed zoning ordinance.
CITY BILLS
The City Manager presented the register of bills
to be allowed for payment. On motion,of Councilman Nielsen,
seconded by
Councilman Roach and on roll,.call vote
by the
City Clerk unanimously carried, Demands 565 through 577
were approved for payment from the General Fund,

RESOLUTION NO. 93,
Proposed Resolution No. 93 entitled "A Resolution;46f
the City Council of the City of Rolling Hills Requesting.
the Board of Supervisors of the County of Los Angeles to
Permit the Registrar of Voters of Said County to Render
Specified Services to the City of Rolling Hills Relating
to the Conduct of a'General Municipal Election to be Held
in said City on ,April 12, 1960"was read in full by the
City Clerk and amended as'to punctuation by Councilman
Goodman.
Thereupon, on motion'of Councilman Horn, seconded
by Councilman Goodman, and after discussion in which all
Councilmen participated, Resoluti-on ,,No. _'93 as amended

was on roll call vote by the City Clerk unanimously
adopted. Resolution No. 93 is set forth in full in
the Book of Resolutions.
GEORGE M. RUSSELL VS. THE CITY OF ROLLING HILLS
Councilman Roach moved that the action taken at
the special meeting Saturday, 20 February 1960,
instructing the City Attorney to defend against the
action entitled "Petition for a Writ'of Mandate and
for Writ' of Prohibition" be ratified and confirmed.
The motion was seconded by Councilman Nielsen and
unanimously carried.
Councilman Goodman advised the Council that.he
and the City Attorney had been working together on
the defense of the above litigation and -recommended
that the Council take the following.action:
1. repeal Ordinance No. U-12, "An Ordinance of
the City of Rolling Hills, California,
Providing for'the Approval of.Plans for the
Construction, Erection, Enlargement, Alter-
ation, Repairing and,Maintenance of Build-
ings or Structures and for Grading in the
City of Rolling Hills."
2. rescind that certain letter. dated January
26, 1960 from Mayor Tourtelot to the -County
Building.and Safety Office requesting that
the County not issue building permits un-
less the plans had been approved by the
Rolling Hills Community Association.
Thereafter the Council took the following action:
ADOPTION OF ORDINANCE NO. U-20 - REPEALING,
ORDINANCE NO. -U-12
Proposed Ordinance No. U-20, "An Ordinance of
the Cityrbf Rolling Hills Repealing and Rescind-
ing Ordinance No. U-12 of the City of Rolling
Hills" was read in full by Councilman Goodman.
Thereupon, on motion made by Councilman Goodman,
seconded by Councilman Horn, said Ordinance No.
U-20 was, on roll call vote by the City Clerk,
unanimously adopted. Ordinance No. U-20 is set
forth in full in the Book of Ordinances.
RESCINDING OF LETTER OF JANUARY 26. 1960
It was then moved by Councilman Goodman that the
letter dated January 26, 1960 from Mayor Tourte-
lot to the County Building Office regarding the
issuance of City Building Permits be rescinded.
The motion was seconded by Councilman Nielsen
and carried unanimously.
INSTRUCTIONS FOR THE ISSUANCE OF CITY BUILDING PERMITS,
On motion of Councilman Goodman, seconded by
Councilman Nielsen and unanimously carried, the
City Clerk was instructed to advise the County
Building Office by letter that Ordinance No.
U-12 has been repealed, that the -,,letter of
January 26, 1960 has been rescinded and that
hereafter building and grading plans be accepted
for checking if they comply with the zoning
ordinance in effect at the time, with Ordinance
No. U-14$ and with the Los Angeles County Build-
ing Code as adopted by Ordinance No. 23.
ADOPTION OF ORDINANCE NO. U-21. THE SUBDIVISION
ORDINANCE
It was moved1by Councilman Goodman that the form
of ordinance heretofore introduced under the *title of
"An Ordinance of the City of Rolling Hills Regulating!
and Controlling the Design and Improvement of Subdivi-
sions and Other Divisions of Property" be withdrawn
from further -consideration by the Council. The motion
was seconded by Councilman Nielsen and carried unani-
mously.
Councilman'Goodman then introduced and moved the
adoption of Ordinance,No. U-21 entitled "An Ordinance
of the City of Rolling Hills Regulating and Controlling
the -Design -and Improvement of Subdivisions and Other
Divisions of Property" which motion was seconded by
Councilman Horn. It was then moved by Councilman Good-
man that Section (i) be amended to read as follows:
"Approximate locations of all areas subject to
inundation or storm water overflow, or,geologi-
cal hazard, which areas shall be marked "Sub-
e_t,to Floodinv" or "Sub iect to Geological
Hazard'", and.the locations.,'width and directions
of flow of all water courses;11
The motion was seconded by Councilman Horn and carried.
The Ordinance was read in full and was on roll
call vote by the City Clerk unanimously adopted as
amended. Ordinance No. U-21 is set forth in full in
the Book of Ordinances.
PALOS VERDES WATER COMPANY APPLICATION FOR RATE INCREASE
Councilman Nielsen reported that the water rate
increase hearing had continued February 17 and that the
Water Company had presented its case, with testimony
regarding its equipment and the costs of service, etc.

4.11 and 4i12 of ORDINANCE NO.
It was moved by Councilman Goodman, seconded by
Councilman Nielsen and unanimously carried that the City
Attorney be directed to prepare a resolution authorizing
and direct'ing,the City Clerk to extend the time for the
performance of certain acts set forth in Sections 4-09
to 4-12 incl. of Ordinance No. U-21.
CLOSING OF MEETING TO THE PUBLIC
It was then moved by Councilman Goodman that the
meeting be closed to the public in order that the City
Attorney might advise the Council as to its legal
rights and liabilities in connection with the action
entitled "George M. Russ'ell vs. the City of Rolling
Hills." The motion was seconded by Councilman Roach
and unanimously carried.
The City Attorney then informed the Council of the
status of the above litigation since the commencement
of the action on February 18, 1960.

the meeting, it was moved by Councilman Horn,
seconded by Councilman Nielsen and unanimously
carried that the meeting be adjourned at 10:15 p.m.
