2/13/1996MINUTES OF A REGULAR ADJOURNED MEETING OF THE CITY COUNCIL OF 'THE CITY OF ROLLING HILLS, CALIFORNIA FEBRUARY 13, 1996 CALL TO ORDER A regular adjourned meeting of the City Council of the City of Rolling Hills was called to order by Mayor Pro Tem Murdock at 7:30 p.m., in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL Councilmembers Present: Heinsheimer, Hill, Lay, Mayor Pro Tem Murdock and Mayor Pernell (arrival at 7:45 p.m.). Councilmembers Absent: None. Others Present: Craig R. Nealis, City Manager. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Regular Meeting of January 22, 1996. RECOMMENDATION: Approve as presented. b. Payment of Bills. RECOMMENDATION: Approve as presented. C. Annual Financial Statement for FY 94-95. RECOMMENDATION: Approve as presented. d. Correspondence from Browning Ferris Industries regarding recovered recyclable material. RECOMMENDATION: Receive and file. e. Consideration of a Planning Process Guide for residents of Rolling Hills. RECOMMENDATION: Approve recommendation as presented. f. California Water Service Company Advice Letter No. 1416, which is being filed with the California Public Utilities Commission to recover an annual one-time surcharge for the Department of Health Services Office of Drinking Water fees. RECOMMENDATION: Receive and file. Councilmember Heinsheimer moved that the City Council approve the recommendations contained in the Consent Calendar. Councilmember Hill seconded the motion which carried unanimously. SPECIAL PRESENTATIONS CONSIDERATION OF A REPORT FROM THE SOUTHERN CALIFORNIA EDISON COMPANY REGARDING A REQUEST FROM THE ROLLING HILLS COMMUNITY ASSOCIATION TO RETURN A UTILITY VAULT ON CREST ROAD, JUST EAST OF PORTUGUESE BEND ROAD, UNDERGROUND. Minutes City Council Meeting 02/13/96 -1- City Manager Nealis presented the staff report outlining the background relative to this matter. Southern California Edison Company Regional Manager Scott Gobble provided a verbal update outlining the comments in his correspondence to the City Council dated February 6, 1996. In response to Councilmember Lay, Mr. Gobble stated that Edison does not intend to remove other facilities from underground in the future and that it is the ultimate goal of Edison to underground their facilities. He indicated that, in this case, reactivation of electrical services will occur faster for the 350 residents of Rolling Hills which are served by this transformer in case of a power outage if it is located above ground. Mr. Gobble explained that this large high voltage transformer serves as a mini -substation and it is difficult to acquire in an underground configuration. He also explained that it does not _ last, what would be considered a normal life expectancy, in the underground structure. Mayor Pernell arrived at 7:45 p.m. and apologized for his late arrival. Mayor Pro Tem Murdock reviewed the proceedings that had taken place before his arrival. • George Cashman, 2 Crest Road East, offered his support for the returning of the transformer unit underground as stated in his letter to the City Council dated February 13, 1996. • Mrs. Ann Carley, 2900 Palos Verdes Drive North, Rolling Hills Community Association Landscape Chair, expressed support for maintaining the vault in an above ground configuration if it is appropriately screened from view and serves to expedite Edison returning power to customers following an outage. Discussion ensued regarding the City's encouragement of underground utilities whenever possible. Councilmembers also discussed Edison's necessity to access the vault quickly and easily to make repairs. City Councilmembers concurred that it is their ultimate desire that the this vault be returned underground. However, due to the unique circumstances relating to this situation, they requested Edison to meet and negotiate with Mr. Cashman and the Community Association to reach an appropriate solution and report any progress in this regard back to the City Council. Hearing no objection, Mayor Pernell continued this item to the next regularly scheduled meeting of the City Council to be held on Monday, February 26, 1996 for the purposes of receiving an update. In response to Mayor Pernell, Mr. Gobble presented a brief report regarding the Edison's new corporate structure. PLANNING COMMISSION ITEMS None. TRAFFIC COMMISSION ITEMS None. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME • Mr. Scott Gobble, Southern California Edison Company Area Manager, requested that the City Council place consideration of a request regarding the use of Rolling Hills Rule 20A funds for a utility underground project on Silver Spur Road in the City of Rancho Palos Verdes. Hearing no objection, Mayor Pernell directed staff to place this item on the Monday, February 26, 1996 agenda. Minutes City Council Meeting 02/13/96 -2- PUBLIC HEARINGS ZONING CASE NO. 453, SUBDIVISION NO. 86 AND TENTATIVE PARCEL MAP NO. 21444 REQUEST FOR A PROPOSED 3 -LOT SUBDIVISION OF LAND AT LOTS 89-A-RH, 89-C-RH, AND 92-RH, AND CURRENTLY; 25 PORTUGUESE BEND ROAD, ROLLING HILLS, CA, AN EXISTING LOT THAT HAS ONE RESIDENTIAL UNIT, TO BE IMPLEMENTED BY MRS. DOTHA S. WELBOURN. LOTS 89-A-RH, 89 -C- RH, AND 92-RH, CONSIST OF 13.7 ACRES GROSS TO BE DIVIDED INTO THREE PARCELS AS FOLLOWS: PARCEL 1 - 8.40 ACRES GROSS, 6.53 ACRES NET; PARCEL 2 - 3.02 ACRES GROSS, 2.39 ACRES NET; AND PARCEL ,3 - 2.8 ACRES GROSS, 2.12 ACRES NET. City Manager Nealis presented the staff report outlining the applicant's request and the Planning Commission's recommendation regarding this item. Principal Planner Ungar explained the modifications to the subdivision requirements being requested. Mayor Pernell opened the public hearing and called for testimony. • Mr. Stanley Lamport, applicant's representative, explained that the applicant's engineering representative will be out of town and requested that the City Council hear his report this evening and, if possible, arrange for a field trip so that the engineer can be present. Mr. Lamport chronicled the steps taken to fulfill the application requirements. He also provided the City Council with an update on issues relating to a report from the applicant's consulting biologist and the natural vegetation mitigation measures offered by the applicant. He pointed out on an aerial photograph of the property the areas that would be affected. He reported that. the example takes into consideration a "worst-case" scenario. He explained the Wildlife Preservation Committee's review and recommended approval of this issue. Mr. Lamport referred the City Council to Planning Commission Resolution No. 96-2 and reported on the suggested changes to the conditions. Assistant City Attorney Ennis further explained conditions in Planning Commission Resolution No. 96-2. Mr. Lamport further explained the location of the cul-de-sac. He reported that the cul- de-sac was relocated due to the concerns of a neighboring property owner. Councilmembers discussed the various conditions in the Planning Commission Resolution. Mayor Pernell expressed concern regarding the monitoring of the various conditions. Mr. Lamport explained the assurance offered by the applicant to make certain that conditions would be met. In response to Mayor Pernell, City Manager Nealis explained that City staff is ultimately responsible for ensuring that the conditions are met when Site Plan Review requests are submitted on this or any property. Mr. Lamport stated that the applicant has agreed to these controls and will to the best of their ability ensure that the conditions are met. • Mr. Doug McHattie, South Bay Engineering, in response to Councilmember Lay regarding the, amount and purpose of grading on Lot No. 1, explained that this grading was necessary due Los Angeles County Materials Engineering Department requirements. Mr. McHattie explained the remedial work proposed for Lot No. 1. Discussion ensued regarding the location and size of the building pad on Lot No. 1. In response to Mayor Pernell, Mr. McHattie stated that grading will take approximately six weeks. In response to Councilmember Lay, Mr. McHattie stated that the natural contour of the land will be maintained. Hearing no objection, Mayor Pernell continued the public hearing to Thursday, February 15, 1996, at 7:30 a.m. for the purpose of conducting a field trip at 25 Portuguese Bend Road. OLD BUSINESS None. Minutes City Council Meeting 02/13/96 -3- NEW BUSINESS CONSIDERATION OF AN APPEAL FILED PURSUANT TO SECTION 6.24.040 OF THE ROLLING HILLS MUNICIPAL CODE RELATIVE TO REQUIRED CONFINEMENT OF A DOG TO A RESIDENTIAL PROPERTY PURSUANT TO AFFIRMATIVE FINDINGS UNDER SECTION 6.24.020, PARAGRAPH A OF THE ROLLING HILLS MUNICIPAL CODE FOR OWNER OF PROPERTY LOCATED AT 5 RANCHERO ROAD. CONSIDERATION OF AN APPEAL FILED PURSUANT TO SECTION 6.24.040 OF THE ROLLING HILLS MUNICIPAL CODE RELATIVE TO REQUIRED CONFINEMENT OF A DOG TO A RESIDENTIAL PROPERTY PURSUANT TO AFFIRMATIVE FINDINGS UNDER SECTION 6.24.020, PARAGRAPH A OF THE ROLLING HILLS MUNICIPAL CODE FOR OWNER OF PROPERTY LOCATED AT 2 SPUR LANE. Assistant City Attorney Ennis explained the Dog Confinement Appeal Hearing Procedures. He reported that each of the animal owners were presented with the Appeal Hearing Procedures prior to this evening's meeting. Assistant Attorney Ennis suggested that since the two cases involve a single incident, that the City Council could consider both appeals in one hearing. Assistant City Attorney Ennis also explained that this proceeding is not a formal judicial proceeding and that the formal rules of court evidence do not apply. He indicated that this is a quasi-judicial proceeding and that the Council should evaluate the evidence in the light of the standards set forth in the Municipal Code and determine whether there is substantial evidence in the record to support a conclusion that the dogs attacked and killed the livestock. At 9:00 p.m., Mayor Pro Tem Murdock reported that she must leave the meeting. She stated that she will review the tape .recording of the meeting. Materials were presented by Dr. Laurence David's Attorney to the City Council. City Manager Nealis presented the staff reports and affidavit filed by Mrs. McBride, the SPCA's investigation which led him to confine the dogs to their respective property, a chronology of events and the City Councils options relative to these appeals. City Manager Nealis also reported that material presented earlier in the day from Mrs. Michelle McBride has been placed before the City Council. He also presented photographs of the dead goats provided by Mrs. McBride. Discussion ensued regarding the distance between the dog owners' homes and Mrs. McBride's property. In response to Councilmember Heinsheimer, City Manager Nealis stated that the two Rottweilers were not licensed. He reported that both of the Rottweilers have since been licensed. City Manager Nealis also reported that the City has received reports over the past two years of two Rottweilers exhibiting aggressive behavior and running with in a pack in the Flying Triangle area. He stated that none of these dogs had been identified. In response to Mayor Pernell, Mr. Burt Arnold reported that he has had his dog for three years. It was also reported that Dr. David's dog has lived at 5 Ranchero Road for three years. Mayor Pernell expressed concern that both of these dogs were unlicensed. It was reported by Mr. Arnold that his dog was previously licensed but that the license had expired. It was reported that it is unknown whether the Dr. David's dog had previously been licensed. • Lt. Douglas Buck, Director of Shelter Services for the SPCA, stated that he was not directly involved in the investigation of these cases, however, would answer questions regarding the policies and procedures of the SPCA. He stated that he was involved in the decision to impound Dr. David's Rottweiler on January 28, 1996, when it was found to be in violation of the confinement order and was determined to be unlicensed. • Officer Helen Bosaz, SPCA, reported on her investigation of Mrs. McBrides affidavit, various incidents surrounding the cases and recommendations in her reports to the City. She also stated that she investigated an affidavit filed by Mrs. Marion Busia Minutes City Council Meeting 02/13/96 -4- regarding two Rottweilers exhibiting aggressive behavior toward her and her animals. Officer Bosaz stated that she could not make a finding that could support that an actual attack and injury occurred relative to Mrs. Busia's affidavit. Discussion ensued regarding the impounding of Dr. David's dog on January 28, 1996. City Manager Nealis explained the SPCA's �aith'biriy`'the Municipal Code to enter property in the City. • Sgt. Brenda Herrington, SPCA, reported on her written statement regarding her telephone interview with Dr. David. City Manager Nealis summarized the report submitted by Sgt. Herrington. He stated that Dr. David felt that his dog was not involved in the killing of the goats and that they jumped the fence and broke their necks. He also said that Dr. David expressed that the McBrides should keep their goats confined to a pen since there is no leash law in the City. • Dr. Duncan and Mrs. Michelle McBride, 1 Running Brand Road. Dr. McBride described the written testimony by other residents regarding the behavior of these .two dogs. He stated that their concern and the concern of those providing written testimony is for the safety of children. Dr. McBride reported on the incident as stated in their Affidavit and the other incidents described in the SPCA. reports. He reported -that given his medical training and experience, he feels that the goats had been taken down by the dogs due to the predator style puncture wounds in their necks. He also explained the open wounds in the abdomens of the goats. Dr. McBride provided further explanation of how they identified the owners of the two Rottweilers and of the events that occurred following the original incident on January 13, 1996. He explained that Mr. Burt Arnold was very cooperative and assisted Mrs. McBride in removing the goat carcasses from their property and stated that he disputes Dr. David's comments on what occurred. He also provide a brief accounting of Mrs. Marion Busia's encounters with these dogs. Dr. McBride stated that they are fearful of these dogs. He. provided photographs of the pen area where the goats are kept. He further disputed Dr. David's claims that the goats were killed by jumping the fence and breaking their necks or that the goats were killed by other dogs or other predators. He stated that a Community Association Maintenance worker had previously been bitten by Mr. Arnold's dog. He presented an article from the journal "Pediatrics" dated November, 1995, entitled "Severe Dog Bites in Children" explaining that Rottweilers were the second most common dog to attack children. In conclusion, Dr. McBride stated the he would request that for the protection of all children in the City that the City Council amend the recommendation by the City Manager that the dogs be confined and order that these two Rottweilers be removed from the City. I , • Mr. Charlie Raine, 2 Pinto Road, stated that he feels that the dogs were not roaming, but hunting due to the great distances between the properties involved. In response to Mayor Pernell, Mr. Raine indicated that he had not witnessed the events but that the dogs have chased his car. • Mrs. Pia Raine, 2 Pinto Road, stated that she previously witnessed an attack on the McBride dog by the Arnold dog. She reported that she has experience in the training of German Shepherds and Rottweilers and that, in her opinion, these two Rottweilers are dangerous. She further commented that Dr. David did not examine his dog when he picked it up from the McBrides property stated in his letter. • Dr. Duncan McBride, 1 Running Brand Road, commented on Dr. David's statement that the dogs did not seem disturbed nor did they have any visible evidence on them when he viewed them. He stated that Dr. David did not see the dogs until two hours after the incident. Dr. McBride stated that when they heard the commotion in their yard on January 13, 1996, they immediately ran out and found the two Rottweilers and a Retriever standing over the dead goats. , • Mr. Michael Ungar, attorney for Dr. Laurence David, stated that he shares the concern for children in the community. He stated that he can find no evidence that Dr. David's dog has ever exhibited aggressive behavior toward children. He pointed out that there Minutes City Council Meeting LL 02/13/96 -5- are numerous letters in his material presented to the City Council this evening that support that Dr. David's dog is a friendly, kind, gentle and considerate dog and has been left in the company of children in the past. Mr. Ungar reported that Dr. David was out of town on business and unable to attend this meeting. He presented a letter dated February 13, 1996, prepared by Dr. David outlining his comments regarding the incident. He highlighted that Dr. David indicates in the letter that on January 13, 1996, that he did receive a call from Mrs. McBride who indicated that his dog had killed her goats and requested that he come to the house and pick up his dog. It explained that it was Dr. David's observation, at that time, that both of the dogs were clean with no blood on their mouths, body or any other evidence that they had been involved the incident. He stated that Dr. David took his dog over to one of the dead goats and that his dog showed no interest. Mr. Ungar further stated that Dr. David suspects that the dogs heard the noise and commotion on the McBride property and were attracted to it and ventured onto the McBride property to investigate. He indicated that since the McBrides were able to capture these dogs, that they are not vicious. Mr. Ungar reported that his client was out of town and had not received personal notice of confinement of his dog. He stated that Dr. David received the notice via hand delivery on January 29, 1996. Mr. Ungar stated that Dr. David's dog has never given any indication of aggressive behavior and indicated that other Rottweilers or wild animals may have caused the death of the goats. He stated that the fact that these dogs were present after the commotion is not proof that they did the attacking. Mr. Ungar commented on the letters submitted by the McBrides relative to the descriptions of the animals collars and weight. He stated that in speaking with Dr. David's son, he indicated that his father's dog does not own a brass collar and that the dog weighs one hundred nine pounds, much heavier than the McBride description. Mr. Ungar stated that he does not feel that the identification of the dog stated in the various letters submitted by the McBrides is accurate. He also stated the he feels that no substantial evidence has been presented that would implicate Dr. David's dog and that he feels that the dog is of no danger to children. He further stated that his client loves and cares for his dog and would be devastated if his dog were to remain confined or ordered removed from the City. • Mr. Jonathan David, 20210 Pacific Coast Highway, Malibu, stated that in the three years that his father has owned the dog, that it has never been aggressive. He stated that his father is a responsible dog owner. He further stated that he and Dr. David feel that they have been harassed. He reported that he spoke with a Captain Havaford of the SPCA regarding this situation. Mr. David said Captain Havaford stated that action was taken even though there was no proof that the dog killed the goats and that there is no proof that Dr. David's dog runs in packs. In response to Councilmember Lay, Mr. David stated that he feels that there may be two Rottweilers running around the City, but that it is not their dog. He further stated that all they know is that their dog was present at the scene with another Rottweiler when the McBrides found their dead goats. In response to Mr. Ungar, Mr. David stated that there has been no indication previously that their dog has been exhibiting the type of behavior reported this evening. Mr. David further commented on Captain Havaford's statements and the incident on January 28, 1996 when Dr. David's dog was impounded by the SPCA after being seen on the McBride property again. In response to Mr. Ungar, Mr. David stated that Dr. David's dog has never had a spiked or brass collar as reported. Mr. Burt Arnold also stated that his dog does not have a spiked or brass collar. In response to Councilmember Heinsheimer, Mr. Ungar stated that he feels that dogs are naturally curious and will investigation commotion and that is how Dr. David's dog became present at the site of the incident. He further stated that since there is no leash law in the city that any dogs may roam at will and that it is common behavior for dogs to smell blood from quite a distance and investigate. In response to Mr. Ungar's comments regarding the notice presented to Dr. David, City Manager Nealis explained that he made it very clear to Dr. David that he was to confine Minutes City Council Meeting 02/13/96 -6- �t',��> ''`Jy� � c ` ,�F,;k,�4•.;G;j"Eiji ��`�' his dog to his property during the course of the investigation when he spoke to Dr. David on January 22, 1996. He indicated that at that time Dr. David made it clear to him that he would not participate in the investigation by the SPCA and .he would not confine his dog to his property. City Manager Nealis .also reported- that he personally delivered the notice to Dr. David's property. He said the notice: wads.. also mailed to Dr. David via certified and Kii:tevr5iiy'�"z � regular mail which is beyond the requirement oto the Municipal Code. Mr. Ungar reported that on January 24, 1996, his client was out �of town and was not served in person. He stated that upon Dr. David's return on January 29, 1996, he received the notice which was hand delivered. • Mr. Burt Arnold and Mrs. Amy Arnold, 2 Spur Lane, stated that they feel that the McBrides have exaggerated the situation. Mr. Arnold also stated that he sympathizes with the McBrides, however, any other dog in the neighborhood could have killed their goats. Mr. Arnold stated that no one actually witnessed his dog or Dr. David's dog killing the goats. He stated that he assisted Mrs. McBride in disposing of the goat carcasses not out of guilt, but rather as a good neighbor. He stated that he feels that the dogs should not be restricted since other dogs or wild animals may have killed the goats. Mr. Arnold stated that it is quite common in Rolling Hills for dogs to chase automobiles. He stated -that he questions how the goats got out of their pen and indicated that perhaps the goats were roaming on the McBride's property. He stated that he feels that neither his dog nor Dr. David's dog killed the goats. Mr. Arnold reported that he received a call at 9:00 a.m. to go down to the McBrides property and retrieve his dog. He expressed concern regarding the timing of the incident indicating that his dog was in his house all night and was not let out until 8:30 a.m. Mr. Arnold reported that since the day of the attack, he has kept his dog confined. He further explained that his dog, as well as other dogs, roam freely in the neighborhood. He feels that it is the responsibility for the owners of goat, chickens or other farms animals to keep their animals penned up to prevent attacks. Mr. Arnold further stated that if he had known that the McBrides were going to exaggerate their claims that he too would have provided letters supporting the behavior of his dog. He stated that his dog has never shown any aggressive behavior toward animals or people unless it ' has been protective. In response to Councilmember Lay, Mr. Arnold stated that he is not aware of his dog running with Dr. David's dog. Mrs. Arnold stated that the dog sometimes wears a jeweled collar. Councilmember Lay stated that dogs running with another dog or in packs act differently than when they are alone. • Mr. Dale Bolon, 920 Venice Blvd, Venice, stated that he has known Dr. David's dog for about one year and that she has always been very friendly and docile. He stated that he has also seen the dog around children and that she has never been aggressive. In response to comments made by Mr. David regarding a conversation with a Captain Havaford, Sgt. Buck stated the he also spoke with Captain Havaford who is the head of SPCA Criminal Investigation Department. He reported that Captain Havaford stated to him that he had spoken to Mr. David and stated that the evidence, as given to him sounded a little weak. After explaining to Captain Havaford that this was not a criminal proceeding but rather an administrative hearing, Captain Havaford rescinded his comments regarding the evidence. Councilmember's discussed the various aspects to the case and the testimony received. Mayor Pernell indicated that the City does not have a leash law in order to maintain the rural feeling of the City. He stated that in light of the testimony, he feels that the dogs were seen on the McBride property on the goats and that he would rather see the City Council error on the side of caution. He stated that since there is a high degree of probability that these dogs killed the goats that he would support upholding the City Manager's confinement of the dogs to their respective properties. Councilmembers further discussed the testimony. They agreed with Mayor Pernell that they would rather error on the side of caution rather than to turn ,these dogs loose and have another incident occur. It was suggested that while these dogs are confined, that if another such incident were to occur involving two similar dogs, that the City Council could review the situation again. Minutes City Council Meeting 02/13/96 -7- In response to Mayor Pernell, Sgt. Buck stated that the SPCA needs assistance from the public in keeping dogs running in packs in check. He reported that Rolling Hills residents should report such incidents as soon as they occur. City Manager Nealis stated that an article could be placed in the Citywide Newsletter regarding the importance of reporting dogs running in packs. Councilmember Heinsheimer moved that the City Council uphold the decision of the City Manager relative to the confinement of both dogs to their respective properties. Councilmember Lay seconded the motion which carried by the following roll call vote: AYES: Councilmembers Heinsheimer, Hill, Lay, and Mayor Pernell. NOES: None. ABSENT: Mayor Pro Tem Murdock ABSTAIN: None. Assistant City Attorney Ennis stated that staff would draft Resolutions memorializing this action and present them for adoption at the next City Council meeting. RECESS Mayor Pernell recessed the meeting at 10:45 p.m. RECONVENE Mayor Pernell reconvened the meeting at 10:50 p.m. CONSIDERATION OF A COMMISSION AND COMMITTEE VOLUNTEER APPRECIATION EVENT. City Manager Nealis presented the staff report. City Councilmembers discussed the importance of the City's volunteers and directed staff to arrange a weekend brunch to honor the City's volunteers. MATTERS FROM MEMBERS OF THE CITY COUNCIL • Councilmember Heinsheimer commented on the Southern California Edison Company's request for the use of City of Rolling Hills Rule 20A funds for an underground utility project in the City of Rancho Palos Verdes. • Councilmember Hill requested that the City nominate Mrs. Joan Saffo as an outstanding older American to be honored at a luncheon on Wednesday, May 15, 1996, at the County of Los Angeles Music Center, Dorothy Chandler Pavilion Grand Hall. • Councilmember Hill also reported on the status of the proposed improvements to the Clif Hix riding ring and a plan to involve the RHCA in those improvements.
