5/9/1960602, MINUTES OF REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA 9 May 1960 The regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor pro tempore Tourtelot at 7:30 P. M., Monday, 9 May 1960 in the City Hall. ROLL CALL Present: Councilman OFlaherty, Roach, and Mayor pro tempore Tourtelot Absent: Councilman Horn and Mayor Vigo G. Nielsen Also present: City Clerk Gilbert B. Myers, City Attorney William Kinley, Mary Louise Towers, Patricia H. Gribbin, Capt. Joseph Dennis, and Lt. Hamilton of the Los Angeles County Sheriff's Office, Lloyd J..Oye, Mrs. Ronald J.-Dessy, Mrs. Warren C.- McDermid and a group of eight students from Dapplegray School. APPROVAL OF MINUTES The minutes of the meetings held April 19 and 25, 1960 and the Public Hearing of April 252 1960 were approved as corrected. The minutes of the meeting held 11 April 1960 were held over for consideration at such time as they are available. MRS. MARY LOUISE POWERS The City -Clerk introduced Mrs. Powers as the replacement for the position vacated by Mrs. Stockdale. PERSONAL APPEARANCES The Mayor pro tempore, on behalf of the City and the Council, welcomed Capt. Joseph Dennis of the Los Angeles County Sheriffts Office who was introduced by Lt.Hamilton as Capt. Weddlets replacement. The City Clerk advised the Mayor pro -tempore of the presence of the delegation from Dapplegray School, and Mr. Tourtelot.introduced the members of the Council and explained the functioning of the City Council to the students. Mr. Oye was invited to speak before the Council. He informed the Council that he had learned of a proposed school playground of the La Cresta School which was to be installed in the.immediate vicinity of hiis home, 16 Crest Road West. After discussion of the matter by all Councilmen, the City Clerk was requested to discuss the matter with Mr. Oye, the Planning Commission, Mr. Denlay and the School Board in an effort to bring some relief to Mr. Oye. CORRESPONDENCE The City Clerk presented correspondence as follows: (air Resolution No. 60-18 of the City of El Centro -and Resolution No. 4446 of the City of Huntington Park requesting the producers, distributors_, and exhibitors of motion.pictures in this area to cease forthwith the presentation of films to the public which are salacious in nature. It wasunanimously agreed by the Council that action on this matter be tabled until the next meeting. 603 03 (b) a letter dated 2 May 1960 from the County Engineer, County of Los Angeles relative to the fees collected under the terms of Agreement No. 21OL. (c) League of California Cities report ion Gas Tax Funds. W A letter from the County Engineer, County of Los Angeles dated 15 February 1960 and a Memorandum relative to the Correction of County Index Maps which was ordered to the Planning Commission for action and report. (e) A resolution of the City of Santa Monica dated 2 May 1960 recommending Formala No. 1 (based on 85% population and 15% street mileage) for apportioning gas tax to cities. (f) A notification from the League of California Cities. (g) A letter from the Corinth Company Forwarding Public Official Bond forms for use d' Mayor Nielsen and Mayor pro tempore Tourtelot. The City Clerk requested that Mr. Tourtelot complete the papers covering his position and return them for action by the office. The City Attorney was directed to prepare a Resolution to cover the matter of bonding. (h) General Telephone Company letter of 3 May 1960 relative to a suggested change in the wording of the proposed Zoning Ordinance (Section 3.01, Paragraph D., Subparagraph 2) from 'telephone repeater stations"" to "Telephone exchange buildings". The Council determined that this would be 'considered before final adoption of the zoning ordinance. (i) A letter from Sweeney, Irwin and Foye, Attorneys at Law, dated 5 May 1960 relative to Swim Schools and a new type of 'Swim -at -Home" swim school. Mr. Kinley is to investigate the situation and report to the Council what acti,on, if any, he feels is necessary. (j) A notice dated 15 April 1960 of the League of California Cities on the New Mayorst and Councilmnents :i..3n l ,s Institute to be held at the Hotel Claremont, Berkeley, California May 26-27,' 1960. (k) A report on the State of California Division of Highways on the April, 1960 Apportionment of Gas Tax Funds for Expenditure on City Streets. (1) A copy of the Los Angeles County Budget was presented for =information to the Council. ZONING ORDINANCE Mrs. Ronald J. Dessy and Mrs. Marren C. McDermid arrived to discuss the proposed Zoning Ordinance. They informed the Council that their parcels (f property were located within an area tentatively zoned as a one -acre area in the proposed Zoning Ordinance. They.said that they would like the area upgraded to a minimum of two -acre parcels. They were assured by the Council that the matter would be considered at the time of the review of -all suggestions and criticisms of the proposed Zoning Ordinance. Mrs. McDermid advised the Council that she intended to circulate a petition among the residents in that area to poll their opinion on the matter of the increase of the minimum lot size as proposed by her and Mrs. Dessy. : ANNUAL BUDGET FORMATION The City -Clerk advised that a meeting with Councilman OtFlaherty, Rolling Hills Community association Director Bernard Young, and a representative of the accounting firm of Robbins and Lake had been arranged for 9:00 A.M. on the 20th?of May to begin to formulate the 1960-61 budget. PARTY PROCEDURE The City Clerk advised the,Councll, who then approved action of the Board of Directors of the Rolling Hills. Community Association in adopting a new Party Procedure policy. WATER COMPANY RATE INCREASE APPLICATION Mr. Kinley reviewed the matter for the benefit of the new Councilman, Mr. OtFlaherty. _ _ o PENINSULA COORDINATING COUNCIL a The appointment of a representative to the Peninsula Coordinating Council was delayed for a future meeting. SECOND READING OF ORDINANCE NO. 31 AMENDING U-14 RE FIRE HYDRANTS Councilman Roach `read in full the title of proposed Ordinane'ect No. 31 "An Ordinance of'the City of Rolling Hills, California Amending Ordinance No. U-14 of the City of Rolling Hills' and moved that the reading of the proposed ordinance in full be. waived. The motion was seconded by Councilman OtFlaher•ty and unanimously carried,. Thereupon on motion of -Councilman Roach and second by Councilman OtFlaherty, said Ordinance No. 31 was on roll call vote by the City Council unanimously adopted. Ordinance No. 31 is set forth in full in the Book of Ordinances. SECOND READING OF ORDINANCE NO. 32 AMENDING ORDINANCE NO. U-21 Councilman OtFlahe7D'ty read in full the title of proposed Ordinance No. 32 41An Ordinance of the City of Rolling Hills Regulating and -Controlling the Design and Improvement of Subdivisions,and Other Divisions of .Property and Repealing Ordinance No. U -21t° and moved that the reading of the' proposed ordinance in full be waived. The motion was seconded"by Councilman Roach and unanimously carried. Thereupon on motion of Councilman OtFlaherty and second by Councilman Roach, said Ordinance No. 32 was on roll call vote by the City Council unanimously adopted. Ordixiance No. 32 is set forth iri`full An the Book of Ordinances. LEAGUE OF.CALIFORNIA CITIES - REPRESENTATIVE It was unanimously agreed that Mayor Nielsen be designated as representative to the League of -California'-', Cities and Mayor -pro tempore be named as alternate. CITY' TREASURER - APPOINTMENT It was decided to. postpone further discussion, of. the appointment of a City Treasurer,until Mayor Nielsen and Councilman Horn were present. OPINION ON IN LIEU BANK.ACCOUNT Mr. Kinley reported that in his.o,pinion no changes should be made in the General Fund and In Lieu Bank Accounts. I. 1 1 CREST SCHOOL SEWER The City Clerk read a letter from the County of Los Angeles Department of County Engineer Office dated 29 April 1960 relative to the Crest School Siewer, Private Contract No. 4787. Mr. Kinley was instructed by the Council to discuss the matter with the County Counselte office and report. RUSSELL LAW -SUIT Mr. Kinley reported on the law suit and was instructed by the Council to continue negotiations with Mr. Russell's attorney in connection with a possible compromise settle- ment of the pending litigation. Mr. Kinley reviewed the action of the Board of Directors in the matter of Russell versus Rolling Hills Corr unity Association and read in full his letter dated 4 May, 1960 directed to Mr. Roy Woolsey, ,counsel for Mr..Russell.
