8/6/1997MINUTES OF A JOINT MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS AND THE COMMUNITY ASSOCIATION BOARD OF DIRECTORS AUGUST 6,1997 CALL TO ORDER Mayor Lay called a joint meeting of the City Council of the City of Rolling Hills and the Rolling Hills Community Association Board of Directors to order at 7:00 p.m., in the City Council Chambers, at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL Councilmembers Present: Heinsheimer, Murdock, Pernell and Mayor Pro Tem Hill and Mayor Lay. Councilmembers Absent: None. Board of Directors Present: Crocker, Howroyd, Stringfellow and President Henke. Board of Directors Absent: Adams. Others Present: Craig R. Nealis, City Manager. Peggy Minor, RHCA Manager. Mike Jenkins, City Attorney. Sid Croft, RHCA Attorney. Julie Heinsheimer, Landscape Consultant. Lola Ungar, Planning Director. Marilyn L. Kern, Deputy City Clerk. TOPICS FOR DISCUSSION RHCA AND CITY VIEW IMPAIRMENT PROCEDURES. RHCA Board Member Don Crocker explained the RHCA's authority to maintain and improve views. He highlighted and differences between the RHCA's procedure and the City's View Preservation Ordinance. Those in attendance discussed the contribution of views to the City and the City's and RHCA's interest in the protection of natural vegetation from indiscriminate removal. Those in attendance also discussed the implementation and enforcement of the two view restoration procedures. Discussion ensued regarding the RHCA's ability to restore views through the CC&R's. City Attorney Mike Jenkins suggested that the City may not wish to duplicate this authority and may wish to review the City View Preservation Ordinance. The suggestion was offered by RHCA Board Member Don Crocker that the Planning Commission may have leverage during the discretionary review of residential development applications to ensure that vegetation will not cause a view impairment. City Manager Nealis explained the findings of fact and conditions of approval utilized by the Planning Commission which contain landscape limitation and view protection provisions. Following discussion, City staff was directed to review the City view preservation policy and see how it might be incorporated into the Planning Commission discretionary review process and the City Attorney was directed to review the current applicable Municipal Code Sections. PROCEDURES FOR HANDLING ABANDONED PROJECTS. Those in attendance discussed the City's procedures outlined in the staff report. RHCA Board Members expressed their concern for the visual impact of projects that have been abandoned. RHCA Board Members commented on what the RHCA could possibly do to influence property owners to complete projects. Minutes City Council/RHCA Board of Directors Joint Meeting 08/06/97 -1- PLAN CHECK PROCESS --SCENARIO ON HOW THE PLAN CHECK PROCESS IS ADMINISTERED IN ORDER TO PREVENT BUILDINGS FROM BEING CONSTRUCTED BEYOND THEIR ORIGINAL SCOPE OF APPROVAL. Those in attendance discussed the plan check process as outlined in the staff report. City Manager Nealis explained the grading confirmation and soil import/export processes initiated by the City. Discussion ensued regarding when applicants submit their plans for City approval and for RHCA Architectural approval. RHCA Manager Peggy Minor reported that usually applicants submit plans to the RHCA after receiving Planning Commission approval. Concerns were expressed regarding the submission of "as -built" grading plans. City Manager Nealis explained the Planning Process Guide used by the City and the grading sign -off sheet being reviewed by the Planning Commission. Board Member Howroyd stated that he feels that some County approvals should be obtained before applicants submit their projects to the City or the RHCA. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME • Landscape Consultant Julie Heinshiemer, commented on the efforts of the City and RHCA to maintain views in the City. MATTERS FROM MEMBERS OF THE RHCA BOARD OF DIRECTORS None. MATTERS FROM MEMBERS OF THE CITY COUNCIL • Councilmember Pernell commended of the efforts of the City and the RHCA on being sensitive to resident's concerns while keeping in mind the rules and regulations of each entity. • Mayor Lay thanked the RHCA Board for their attendance and suggested that this type of meeting be held more frequently. • Mayor Pro Tem Hill announced that a meeting, conducted by the Sheriff's Department for residents of Cinching Road and Spur Lane, will be held on Tuesday, August 12, 1997 at 7:00 p.m. and invited members of the Board of Directors to attend. MATTERS FROM STAFF None. ADIOURNMENT Hearing no further business, Mayor Lay adjourned the meeting at 9:20 p.m. to the next regular meeting to be held on Monday, August 11, 1997, beginning at 7:30 p.m. in the City Council Chambers, at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
