9/26/1960MINUTES OF REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA 26 September 1960 The regular meeting of the City Council of the City of Rolling -Hills was called to order by Mayor Nielsen at` 7:15 P.M., Monday, 26 September 1960 in the City Hall. ROLL CALL.: Iā€”ā€” - Present: Councilmen Horn, Roach,-Tourtelot and Mayor Niel' 6ii­ Absent: Councilman O'Flaherty Also Present: City Clerk Gilbert B. Myers City Attorney William Kinley. City Treasurer Lloyd W. Hully. Deputy City Clerk Mary Louise Powers Others Present: Mr. and Mrs. C. W. Beck - Arrived 17 Crest East P.M. PUBLIC HEARING ON RESOLUTION NO. 2 OF THE PLANNING'COMMISSION CHANGE OF ZONE OF LOTS AND PARCELS The Mayor stated that this public hearing was held to consider Resolution No. 2 of the Planning Commission, recommending the enactment of an amendment to Ordinance No. 33 of the City of Rolling Hills providing for zoning, which would change the zone of lots 69-A, 69-C,'69-E,and 70-B of Miscellaneous Parcels from Zone RAS -1 to Zone RAS -2. ,The Mayor further stated that notices of-the'public hearing were sent to owners of the above numbered parcels of property as well as to owners of all property located within five hundred (500) feet of the exterior boundaries of said above numbered parcels. He further stated that a.noti6e of the time and place of this public hearing was published in the "Palo's Verdes Newsil as required by Ordinance No. 33. There being no one present to speak either for or against Resolution No. 2 of the Planning Commission, the Mayor ordered the public hearing closed at 7:30. RESOLUTION NO. 105 Councilman Horn moved that Resolution No. 105 entitled "A Resolution of the *City Council of the City of Rolling Hills, California Approving and Adapting Resolution No. 2 of the Plan- ning Commission of the City of Rolling Hills, California which Recommended the Amendment of Ordinance No. 33 of the City of Rolling Hills to Change the Zone of Lots 69-A, 69-C, 69-E and 70-B 'of Mis-c:ellaneous Parcels" be adopted. The motion was seconded by Councilman Roach, and on roll call vote by the City Clerk was unanimously adopted. Resolution No. 105 is set forth in full in the Book of Resolutions. L 332 APPROVAL OF MINUTES On motion of Councilman Tourtelot, seconded by Councilman Horn and unanimously carried, the.minutes of the meeting held September 12, 1960 were approved as written. CORRESPONDENCE The City Clerk read the following: a) a.letter dated 13 September 1960 from Harold C. Marlowe, Undersheriff of Los Angeles County, expressing appreciation for the opportunity to appear before.Rolling Hills City Council meeting on 12 September 1960. b) copy of a letter dated 23 September 1960 addressed to Sheriff Peter J. Pitchess of Los Angeles County commending local deputy sheriffs; letter was written by Murray C. Beebe, Jr., 1 Spur Lane. e; RUSSELL LAWSUIT Mr. Kinley reported on.the present status of the action entitled "Russell v City of Rolling Hills". FENCE REGULATIONS The City Attorney -was instructed to draft.an . ordinance which would cover the regulations and specifications of fences for the restriction of dangerous animalg, i.e..stallions. PROCLAMATION - UNITED STATES DAY It was moved by Councilman Tourtelot and seconded by Councilman Horn that Sunday, October 23, 1960.be proclaimed ,by the Mayor to be United States Day in the City of Rolling Hills; the motion was unanimously carried. Thereupon, the Mayor proclaimed Sunday, October 23, 1960 as United States Day in the City of Rolling Hills and ordered the City Clerk to post a copy of said proclamation in the.usual public places. PAYMENT OF CITY BILLS The City Clerk presented the register of bills to be allowed for payment. On motion of Councilman Horn, seconded by Councilman Roach and on roll call vote by'the City Clerk unanimously carried. In the absence of Councilman O'Flaherty, Mayor.Nielsen appointed Councilman Tourtelot Finance Officer pro tempore. Demands 715, through 723 were approved for payment from the General,Fund as follows: Demand No. 715 William Kinley $. 350.00 Demand.No. 716 Gilbert B. Quinn 11.77 $4,534.57 a34 POST CARD POLL RE TAX RATE 1960-61 The City Clerk reported that he had mailed post cards re tax rate 1960-61 to all.660 property owners as directed at the 12 September 1960 City Council meeting. He -further reported that of the 250 responses received to date, 150 property owners voted to decrease the tax rate, and 100 property owners voted to increase the gate service. The City Clerk was directed to refer the results of the poll to the Board of Directors of.the Rolling Hills Community Association .at its next meeting. SUMMARY OF OPINIONS AND FINDINGS'.BEFORE PUBLIC UTILITIES COMMISSION RE APPLICATION FOR WATER RATE INCREASE The City Attorney submitted a "Summary of Opinions and Findings Before.the Public Utilities Commission in re: Application of Palos Verdes Water Company for General Rate Increase." The report was discussed and ordered filed in the records of the City -Clerk. OPINION OF CITY ATTORNEY - ELECTION OF COUNCILMEN FROM DISTRICTS As requested at the, -22 August 1960 City Council meeting, the City Attorney submitted an 6pinion as to whether the City of Rolling Hills could legally change its present method of electing councilmen from the city at large to a system of electing its councilmen by districts. It was the opinion of the City Attorney that it would be legally impossible for the City of Rolling Hills to change its present method of electing councilmen. The opinion was received and ordered filed in the records of the City Clerk. ZONING -MAP - REQUIRED BY ORDINANCE NO. 33 The City Attorney recommended that the Zoning Map, which is a part of the Zoning Ordinance, be placed in a perm- anent map case in order to protect the map. The City Clerk was directed to purchase the map case. LETTER TO MAYOR RE LANDFILL ODOR The Mayor reported that he had received a letter from R. Gilman, 7 Pine Tree Lane, re odors from Landfill on Crenshaw Boulevard. The Manager was directed to make inquiries i.e., ask Mr. Gilman if the odors are apparent from his residence or as he drives past the Landfill. MAYOR NIELSEN APPOINTED TO EXECUTIVE COMMITTEE OF COMMITTEE OF MAYORS OF THE CITIES OF LOS ANGELES COUNTY Mayor Nielsen reported that he had accepted a two- year appointment to the Executive Committee of the Committee of Mayors of the Cities of Los Angeles County. LETTER FROM GATE CARD COMMITTEE CHAIRMAN RE ISSUANCE OF GATE CARDS Councilman Horn, member of the Gate Card Committee, read letter addressed to -the City Clerk suggesting that the Gate Card Committee restrict issuance of gate cards. The matter was referred to the Board of Directors of the Rolling Hills Community Association. PURCHASE OF GATE HOUSE PROPERTIES The City Attorney reported a discussion with representatives of Palos Verdes Properties with regard to the purchase of gatehouse properties., Mr. Kinley was informed that Palos Verdes Properties has contracted to build an office building in the Peninsula Shopping Center, which they expect to occupy within a year. He further reported that Palos Verdes Properties had made.an appraisal of the value of the gate house properties within the last six months and recommended that the City likewise have an appraisal made of the properties as soon as possible. POSSIBLE LEGISLATION COMPELLING ANNEXATION _The City Attorney reported possible legislation which might compel annexation of island county areas by cities surrounding them. If this should become. law, he suggested that the city might elect to look further into the annexation which would ultimately provide more tax support. At the suggestion of the City Attorney, he and i" Mr. Owen Goodman were appointed to investigate the legal PP g g problems involved. "RENEWAL OF CIVIL DEFENSE CONTRACT The City Clerk submitted copies of "Agreement to Provide for Inter -Agency Cooperation in Civil Defense and Disaster" and recommended that the City Council approve the renewal of said agreement. RESOLUTION NO. 106 Thereupon, on motion made by Councilman Tourtelot, seconded by Councilman Roach, Resolution.No. 106 entitled "A Resolution of the City Council of the City of Rolling Hills, California Authorizing the Execution of a Renewal of Agreement to Provide for Inter -Agency Cooperation in Civil Defense and Disaster" wag unanimously adopted on roll call vote by the City Clerk. Resolution No. 106 is set forth in full in the Book of Resolutions. ADJOURNMENT There being no further business.to come -before -the meeting, it was moved by Councilman Tourtelot, seconded by Councilman Roach and unanimously carried that the'meeting be adjourned at -8:30 P -.M.
