8/28/2000MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA AUGUST 28, 2000 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Pernell at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. - ROLL CALL 1 1 Councilmembers Present: Heinsheimer, Hill, Lay, Mayor Pro Tem Murdock and Mayor Pernell. Councilmembers Absent: None. Others Present: Craig R. Nealis, City Manager. Nan Huang, Finance Director. Lola Ungar, Planning Director. Marilyn L. Kern, Deputy City Clerk. CONSENT CALENDAR Matters which may be acted upon by the City Council Councilmember may request removal of any item from the it to be considered under Council Actions. a. Minutes - Regular Meeting of August 14, 2000. RECOMMENDATION: Approve as presented. b. Payment of Bills. RECOMMENDATION: Approve as presented. C. Financial Statement for the month of July, 2000. RECOMMENDATION: Approve as presented. d. BFI Recycling Tonnage Report for July, 2000. RECOMMENDATION: Receive and file. e. Consideration of a date for the Holiday Open House. RECOMMENDATION: Approve as presented. in a single motion. Any Consent Calendar causing Councilmember Heinsheimer moved that the City Council approve the recommendations in the Consent Calendar. Councilmember Hill seconded the motion which carried unanimously. PLANNING COMMISSION ITEMS RESOLUTION NO. 2000-17: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING A VARIANCE TO EXCEED THE MAXIMUM STRUCTURAL LOT COVERAGE PERMITTED AT AN EXISTING SINGLE FAMILY RESIDENCE LOCATED AT 15 EASTFIELD DRIVE IN ZONING CASE NO. 614. Mr. and Mrs. Errol Gordon, 15 Eastfield Drive (Lot 52 -EF) City Manager Nealis presented the staff report outlining the applicants' request, background regarding the property and Planning Commission action relative to Zoning Case No. 614. Hearing no discussion or objection, Mayor Pernell ordered that Resolution No. 2000-17 be received and filed. RESOLUTION NO. 2000-18: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING A VARIANCE TO CONSTRUCT A RESIDENTIAL ADDITION TO ENCROACH INTO THE FRONT YARD SETBACK, GRANTING A VARIANCE TO CONSTRUCT A STABLE TO ENCROACH INTO THE FRONT YARD SETBACK AND GRANTING SITE PLAN REVIEW APPROVAL TO AUTHORIZE THE RETENTION AND MAINTENANCE OF ILLEGALLY CONDUCTED GRADING AT A SINGLE FAMILY RESIDENCE AT 29 MIDDLERIDGE LANE SOUTH IN ZONING CASE NO. 616. Mr. Kenneth J. Johnson, 29 Middleridge Lane South (Lot 248 -A -1 -UR) Minutes City Council Meeting 08/28/00 -1- City Manager Nealis presented the staff report outlining the applicants' request, background regarding the property and Planning Commission action relative to Zoning Case No. 616. Mayor Pernell expressed concern about the portion of the application seeking the retention and maintenance of the illegally conducted grading. City Manager Nealis explained how staff became aware of this situation and indicated that the applicant was given a choice to return the area to its original condition, complying with the original approval, or to apply to the City to maintain it in its current configuration. Hearing no further discussion, Mayor Pernell called for a motion. Councilmember Heinsheimer moved that the City Council take jurisdiction of Zoning Case No. 616. Mayor Pro Tem Murdock seconded the motion which carried unanimously. A public hearing will be scheduled for the next regular meeting of the City Council to be held on Monday, September 11, 2000. Mayor Pernell suggested that staff place an item on the upcoming retreat meeting of the City Council regarding land use application procedures in cases involving pre-existing and/or unauthorized grading or building activities. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS None. OLD BUSINESS None. NEW BUSINESS CONSIDERATION OF DISPOSITION OF CITY OF ROLLING HILLS COUNTY REGIONAL PARK AND OPEN SPACE PROPOSITION "A" PER PARCEL DISCRETIONARY FUNDS. City Manager Nealis presented the staff report providing background regarding these funds and the proposals from Rolling Hills Estates and Rancho Palos Verdes for projects in those cities that are eligible for the use of the funds. Councilmember Lay moved that the City Council allocate the City of Rolling Hills 1996 County Regional Park and Open Space Proposition "A" Per Parcel Discretionary Funds to the City of Rancho Palos Verdes. Mayor Pro Tem Murdock seconded the motion. Councilmembers discussed the proposals from Rolling Hills Estates and Rancho Palos Verdes. Councilmember Lay indicated that he feels that the project at Pt. Vincent Interpretive Center will benefit all residents of the Peninsula. Discussion ensued regarding the past practice of allocating such funds on a 60%/40% basis to neighboring cities and Councilmembers indicated that it is difficult to determine the benefit of one project over another. In response to Councilmember Hill, City Manager Nealis explained that the last allocation of these funds was given to the City of Rolling Hills Estates for improvements to parks and park equipment and that recently the City Council allocated Proposition A Maintenance funds to Rolling Hills Estates for the maintenance of those improvements. Hearing no further discussion Mayor Pernell noted that the motion carried unanimously. A resolution memorializing this action will be presented to the City Council at the next regular meeting to be held on Monday, September 11, 2000. Staff was directed to place an item on the upcoming retreat meeting of the City Council regarding a policy for allocation of locally unusable funds to neighboring cities. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME In response to Mr. Ken Johnson, 29 Middleridge Lane South, Mayor Pernell reported that the City Council took jurisdiction of Zoning Case 616. City Manager Nealis indicated to Mr. Minutes City Council Meeting 08/28/00 -2- 1 1 Johnson that this matter will be scheduled for a public hearing at the next City Council meeting scheduled for September 11, 2000. MATTERS FROM MEMBERS OF THE CITY COUNCIL Councilmember Heinsheimer reported on his attendance at the Annual Caballeros Hix Barbecue and at the Los Angeles County Sanitation Districts' Ocean Inspection Trip. Mayor Pernell stated that he has invited other City Commission and Committee members to attend an upcoming Ocean Inspection Trip. Councilmember Lay reported on his meeting with RHCA Board President Donne Moen regarding a request from Caballeros for funding for improvements and maintenance of the riding rings. Staff was directed to discuss this matter with the RHCA Manager and consider Lease Agreement modifications for consideration by the City Council that would provide funding from the RHCA and the City for this purpose. Councilmember Lay reported that he will be absent from the September 11, 2000 City Council meeting. MATTERS FROM STAFF None. MATTERS FROM THE CITY ATTORNEY None. ADIOURNMENT Hearing no further business before the City Council, Mayor Pernell adjourned the meeting at 7:55 p.m., in memory of long time resident and former Planning Commissioner Clifford Bundy. The meeting was adjourned to the next regular meeting of the City Council scheduled to be held on Monday, September 11, 2000, beginning at 7:30 p.m., in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
