6/25/2001MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA JUNE 25, 2001 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Murdock at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL Councilmembers Present: Heinsheimer, Hill, Pernell, and Mayor Murdock. Councilmembers Absent: Mayor Pro Tem Lay (Excused). Others Present: Craig Nealis, City Manager. Yolanta Schwartz, Principal Planner. Nan Huang, Finance Director. Marilyn Kern, Deputy City Clerk. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Regular Meeting of June 11, 2001. RECOMMENDATION: Approve as presented. b. Payment of Bills. RECOMMENDATION: Approve as presented. C. Financial Statement for the month of May, 2001. RECOMMENDATION: Approve as presented. d. Correspondence from California Water Service Company regarding a water rate increase. RECOMMENDATION: Receive and file. e. Request from Wildlife Preservation Committee for support of funding for a Primate Seminar. RECOMMENDATION: Approve as presented. f. BFI Recycling Tonnage Report for May, 2001. RECOMMENDATION: Receive and file. Councilmember Heinsheimer moved that the City Council approve the recommendations in the Consent Calendar. Councilmember Hill seconded the motion which carried unanimously by those Councilmembers in attendance. PLANNING COMMISSION ITEMS ZONING CASE NO. 629 RESOLUTION NO. 2001-11. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING SITE PLAN REVIEW APPROVAL TO PERMIT GRADING AND CONSTRUCTION OF A NEW SINGLE FAMILY RESIDENCE WITH A POOL, A POOL HOUSE AND A STABLE, AND GRANTING A CONDITIONAL USE PERMIT APPROVAL TO CONSTRUCT A POOL HOUSE AT A VACANT SITE AT 4 PINE TREE LANE, IN ZONING CASE NO. 629. Principal Planner Schwartz presented the staff report providing information regarding the applicant's request and background regarding the property and Planning Commission action relative to Zoning Case No. 629. Hearing no discussion or objection, Mayor Murdock ordered that Resolution No. 2001-11 be received and filed. ZONING CASE NO. 630 RESOLUTION NO. 2001-12. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING A VARIANCE TO EXCEED THE MAXIMUM PERMITTED DISTURBED AREA, AND GRANTING A VARIANCE TO ENCROACH WITH AN ADDITION INTO THE FRONT YARD SETBACK AT A SINGLE FAMILY RESIDENCE AT 11 CABALLEROS ROAD, IN ZONING CASE NO. 630. Minutes City Council Meeting 06/25/01 -1- Principal Planner Schwartz presented the staff report providing information regarding the applicant's request and background regarding the property and Planning Commission action relative to Zoning Case No. 630. In response to Councilmember Pernell, Principal Planner Schwartz explained how the disturbed area was calculated for the subject property. Councilmember Heinsheimer requested information regarding the location of utility poles and overhead utility lines on the subject property. He also inquired as to whether the Planning Commission or City Council could require undergrounding of utilities during the discretionary review process. City Manager Nealis explained the Municipal Code Sections relative to underground utilities and indicated that he would have the City Attorney research this question and provide a report to the City Council. Hearing no further discussion, Mayor Murdock continued Zoning Case No. 630 to the next regular meeting of the City Council scheduled to be held on Monday, July 9, 2001. Staff was directed to determine the number of utility poles on the subject property and the authority of the City Council to require the undergrounding of utilities during the discretionary review process. ZONING CASE NO. 631 RESOLUTION NO. 2001-13. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING SITE PLAN REVIEW APPROVAL TO CONSTRUCT A BARN THAT REQUIRES GRADING AT AN EXISTING SINGLE FAMILY RESIDENCE AT 80 SADDLEBACK ROAD, IN ZONING CASE NO. 631. Principal Planner Schwartz presented the staff report providing information regarding the applicant's request and background regarding the property and Planning Commission action relative to Zoning Case No. 631. Discussion ensued regarding the undergrounding of the utilities on the subject property and it was suggested that this case be continued so that staff could investigate the applicability of the same questions described under Zoning Case No. 630. Hearing no further discussion, Mayor Murdock continued Zoning Case No. 631 to the next regular meeting of the City Council scheduled to be held on Monday, July 9, 2001. Staff was directed to determine the number of utility poles on the subject property and the authority of the City Council to require the undergrounding of utilities during the discretionary review process. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS - Continued A. CITY OF ROLLING HILLS DRAFT BUDGET FOR FISCAL YEAR 2001-02. (1) RESOLUTION NO. 902: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ESTABLISHING THE 2001-02 FISCAL YEAR APPROPRIATION LIMIT FOR THE CITY OF ROLLING HILLS. (2) RESOLUTION NO. 903: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ADOPTING THE FY 2001-02 CITY OF ROLLING HILLS BUDGET INCLUDING THE ANNUAL REPORT ON: GENERAL FUND, COMMUNITY FACILITIES FUND, MUNICIPAL SELF INSURANCE FUND, REFUSE COLLECTION FUND, SOLID WASTE CHARGES, COPS FUND, TRAFFIC SAFETY FUND, TRANSIT FUND -PROP. A, TRANSIT FUND -PROP. C FOR FISCAL YEAR 2001-02. (3) RESOLUTION NO. 904: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ESTABLISHING THE FISCAL YEAR 2001-02 MERIT PAY PLAN. City Manager Nealis presented brief comments regarding the draft budget and the resolutions pertaining to the budget. Mayor Murdock opened the public hearing and called for testimony. Hearing none and no discussion, Mayor Murdock closed the public hearing and called for a motion. Councilmember Heinsheimer moved that the City Council adopt Resolution No. 902, Resolution No. 903 and Resolution No. 904 relating to the FY 2001-02 Budget. Councilmember Pernell seconded the motion which carried by the following roll call vote: Minutes City Council Meeting 06/25/01 -2- AYES: Councilmembers Heinsheimer, Hill, Pernell and Mayor Murdock. NOES: None. ABSENT: Mayor Pro Tem Lay. ABSTAIN: None. Councilmember Pernell commended staff on the preparation of this year's budget. OLD BUSINESS None. NEW BUSINESS None. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME Mayor Murdock acknowledged that there were guests in the audience and asked that they introduce themselves. Ted Kim, introduced himself and indicated that he is lives in the City of Rancho Palos Verdes and is in attendance as an assignment for a government class at Harbor College. Cynthia Furey introduced herself and indicated that she is an intern working with the Palos Verdes Peninsula News. MATTERS FROM MEMBERS OF THE CITY COUNCIL Mayor Murdock commented on the upcoming Ocean Inspection Tours being conducted by the Los Angeles County Sanitation Districts and indicated that staff would have the information if any Councilmembers wished to attend. MATTERS FROM STAFF None. MATTERS FROM THE CITY ATTORNEY None. ADIOURNMENT Hearing no further business before the City Council, Mayor Murdock adjourned the meeting at 7:50 p.m. to the next regularly scheduled meeting of the City Council to be held on Monday, July 9, 2001 in the City Council Chambers, at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
