2/14/1961MINUTES OF REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA February 14, 1961 The regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Nielsen at 7:30 P.M., Tuesday, February 14, 1961. ROLL CALL Present: Councilmen Horn, O'Flaherty, Roach, Tourtelot and Mayor Nielsen Absent: None Also Present: City Attorney William Kinley City Manager Gilbert B. Myers City.Treasurer Lloyd W. Hully Deputy City Clerk Mary Louise Powers APPROVAL OF MINUTES On motion of Councilman O'Flaherty, seconded by Councilman Tour_telot and unanimously carried, the minutes of the meeting h.eld'January'23, 1961 were approved as written. CORRESPONDENCE The City Clerk read the following: a) letter from City of Torrance, dated January 20, 1961, requesting that the City Council of the City of Rolling Hills adopt a Resolution requesting that the Board of Supervisors and the -Superior Court Judges of Los Angeles County select Torrance as the site for the Southwest Superior Court District Courthouse, and to realign the boundaries of said district. After a discussion_, it was decided that the City Council would not reverse its decision of December 12, 1960 to remain in the South District of the Los Angeles County Superior Court, rather than be included in the Southwest District. b) letter from Virgil Spongberg, City of Long Beach, dated January 26, 1961,E regarding a resolution to the County Board of Supervisors, requesting a more equitable distribution of the County Gas Tax Allocation. On December 22, 1960 letter was addressed to Mr. Virgil Spongberg c/o League of California Cities from.the City Attorney of -the City of Rolling Hills, explaining that this City has no public roads and that the private roads are maintained without the expenditure of any public funds whatsoever. 7 a 1 1 c) copy of letter dated Feb. 1, 1961 sent to Dixwell E. Pierce, Secretary, State Board of Equalization, from Howard Seelye, Editor of Palos Verdes News, questioning sales in the City of Rolling Hills. f) letter dated Feb. 7, 1961 from Los Angeles County Department of Auditor -Controller enclosing copy of authorization which requested cancel- lation of erroneous assessment of Allen J. Kirk, 2 Pheasant Lane, in the amount of $550.00. Since the City Council has to approve deleting the above amount from the assessment roll, a motion was made, seconded and unanimously carried that the City Attorney be authorized to sign the request for cancellation of erroneous assessment in the amount of $550.00. SEISMOGRAPH STATION LOCATED IN CITY OF ROLLING HILLS The City Clerk reported that he had received a letter and had been contacted by Frederick Fryling of California Institute of Technology Seismological Laboratory, who informed him of the Franciscan Schist outcropping in the City's Community area and requested permission to place a temporary seismograph station (approximately 500 ft. south of the residence at 36 Saddleback Road) for a period of two'to six weeks. The City Clerk further reported the receipt of a letter from H. H. G. Nash, Secretary of California Institute of Technology, to guarantee the City of Rolling Hills that it would be held harmless against all claims or suits arising out of bodily injury or property damage or alleged bodily injury or alleged property damage arising out of the Institute's operations in the City of Rolling Hills. The City Attorney referred to Ordinance -No. 11 of the City of Rolling Hills entitled "An Ordinance of the City of Rolling Hills, California, Imposing a City Sales and Use Tax; Providing for �he'Performance by the State Board of Equalization -of all Functions Incident to the Administration, Operation and Collection of the Sales and Use Tax Hereby Imposed; and Providing Penalties for Violations Thereof." d) letter dated Feb. 8, 1961 from Mayor of City of San Gabriel urging adoption of resolution by the City Council of the City of Rolling Hills, imploring all Patriotic Americans to Awaken and to Fight All Communistic Activity.. No action was taken on the letter. e) letter dated Feb. 9, 1961 from Mayor of City of Santa Fe Springs, enclosing copy of article printed in Los Angeles Times on Sunday, Feb. 5, 1961, regarding incorporation of small communities. Newspaper article called attention to proposed bill recommending requirement of 5,000 registered voters and 15,000 population rather than 500 voters and 1,500 population in communities considering incorporation. f) letter dated Feb. 7, 1961 from Los Angeles County Department of Auditor -Controller enclosing copy of authorization which requested cancel- lation of erroneous assessment of Allen J. After discussion, it was moved by Council -man Tourtelot, seconded by Councilman'O'Flaherty and unanimously carried that the Manager be instructed to contact '' Mr. Fryling and inform him that the City Council approved the installation of.a temp- orary seismograph station. I DISASTERPLANS OF PALOS VERDES UNIFIED SCHOOL DISTRICT, The City Clerk read a letter dated February 2, 1961 from Area G Civil Defense and Disaster Planning Board, ex- plaining the "Bell and Light System" suggested for installation in each of the nine schoolslin the Palos Verdes School District, provided the School Board approved and the jurisdictions in which the schools are located will participate. The recommended method of payment is as follows: a) One-half by Federal Government, using the Contribution Program. b) One-fourth by the School District. c) One-fourth by the jurisdiction concerned. The City Clerk informed the Council that the City of Rolling Hills share of installation would be approximately $31.33, and for maintenance approximately $1.31 per month. 1. on a motion duly made, seconded and unanimously carried the City Clerk Was directed to inform J. J. Rochefort, Coordinator of Area G that the City Council of the City of Rolling Hills approved the installation of thel Bell and ' Light System" and will participate in the cost of installation of same in the one school located in the City of Rolling Hills. RESIGNATION OF MAYOR NIELSEN Letter from Mayor Nielsen was addressed to the City Council confirming his intention of.resigning as Mayor of the City of Rolling Hills, effective February 14, 1961 because of conflicts of other demands on his time. It was moved by Councilman Roach) seconded by Councilman.To ' urtelot and unanimously carried that the resignation.of V. G. Nielsen as Mayor be accepted. EXPRESSION OF APPRECIATION.FOR.WORK OF MAYOR NIELSEN, Mayor pro tempore'Tourtelot expressed appreciation and thanked Councilman Nielsen on behalf of himself and the City for the service he had tendered., Councilmen Horn, Roach and O'Flaherty added their expressions of appreciation. ELECTION OF MAYOR Councilman Horn was nominated for Mayor by Councilman Roach. There being no further -nominations, it was moved by Councilman Roach that the Clerk be instructed to cast a unanimous ballot in favor of Councilman Horn for Mayor. The motion was seconded by Councilman O'Flaherty and unanimously carried. Thereafter) the City,Clerk cast a unanimous ballot in favor of Councilman Hornfor Mayor, as moved by Councilman Roach and'seconded-by Councilman O'Flaherty. n 1 TRANSFER OF GATES TO CITY The City.Clerk read a Resolution of the Board of Directors of the Rolling Hills Community Association adopted at its meeting held on January 19, 1961 transferring all right, title and interest in and to the electrically controlled gates to the City of Rolling Hills. On a motion duly made, seconded and unanimously passed the City Council accepted the ownership of the follow- ing described electrically controlled gates: Three (3) sets of Parcoa semaphore type automatic electrically controlled gates bearing the following serial numbers: In 8-54-62 Out 3-54-77 In 9-54-79 Out 9-54-81 In 3-54-80 Out 3-54-83 TRAFFIC ACCIDENT REPORT Councilman Tourtelot submitted a report obtained from Captain Joseph Denis at the Lennox Sheriff's Station covering the traffic accidents which occurred January 18, 1961 and January 21, 1961 and which were discussed at the City Council meeting held January 23, 1961. Report showed: Jan. 18, 1961 accident reported 11:10,P.M. ambulance arrived at scene 11:23,P.M. Jan. 21, 1961 accident reported 2:14;A.M. ambulance arrived at scene 2:46 A.M. Councilman Tourtelot further reported that generally the Sheriff designates control of hospital designation unless patient or victim requests otherwise; they use San Pedro Community Hospital or Bay Harbor Hospital on Lomita Blvd. Bowers and Goodhew ambulance services are \ called because they are the closest. COVENANT FROM DAUGHTERS OF MARY AND JOSEPH The City Attorney reported that the original Covenant from the Daughters of Mary and Joseph in California was filed in the County Recorder's Office on January 20, 1961 as Document No. 3499, in Book M689, Page 241. The Covenant is on file with the records of- - the City Clerk. OFFICE REORGANIZATION STUDY Councilman Tourtelot reported the Office Reorganization Study Committee had met on Thursday, February 9, 1961 and discussed the possibility of remodeling present office since there is some doubt that the Palos Verdes Properties office will move from their present location. m s USE OF RIDING RING BY PONY CLUB The City Clerk read a letter dated February 6' 1 1961 from Col. John K. Brown of the Rolling Hills Pony Club requesting.permission for -the Club to use the Community Riding Ring in Rolling Hills two or three times per month, including hours from 10 to 12 on the first and third Saturday mornings each month. Col. Brown's letter further stated that the Club is obtaining liability insurance to protect the City from all liability as a result of the use of the City's facility. After discussion, a motion was duly made, seconded and unanimously carried that the Pony Club be permitted to use the Community RidingRingon a trial basis. The City Clerk was 'instructed to direct a letter to Col. Brown . stating that the Ring could be used by the Pony Club on a trial basis from 10 to 12 on the first and third Saturdays each month; that no gymkhanas or horse shows be held there; and that the City Attorney approve the insurance policy obtained by the Pony Club. PAYMENT OF CITY,BILLS The City Clerk presented the register of bills to be allowed for payment. Onmotion of 'Councilman Tourtelot, seconded by Councilman Roach and on roll call vote by the City Clerk unanimously carried. District Attorney .40 Demand No. 810 Floyd Stationery Co. 8.69 Demand No. 811 Zellerbach Paper Co.. 60.95 Demand No. 812 Void Demand No. 813 California Bank 145.40 TOTAL TO BE PAID FROM THE GENERAL FUND $3,364.87 CITY TREASURER'S REPORT The report'of the City Treasurer was submitted.for the month of January, 1961, which stated that as of January 31, 1961 the balance in the General Fund was $31,958.51, including $14,824.82 in U. S. Treasury Bills; in the In Lieu Fund the balance was $14,343.41, including $12,000.00 face value Treasury Bills. On motion made by Councilman Roach, seconded by Councilman O'Flaherty and unanimously carried, the report was accepted and ordered filed. SECOND READING OF,ORDINANCE NO. 37 Councilman Tourtelot read in full the title of the proposed Ordinance No. 37 entitled "An Ordinance of the City Council of the City of Rolling Hills Amending Ordinance No. 16 of the City of Rolling Hills" and moved that the reading in full of the proposed ordinance be waived. The motion was seconded by Councilman O'Flaherty and unanimously carried. Thereupon, on motion of Councilman Tourtelot, seconded by Councilman O'Flaherty, said Ordinance No. 37 was on roll call vote by the City Clerk unanimously adopted. Ordinance No. 37 is set forth in full in the Book of Ordinances. 1 1 1 RESOLUTION NO. 113 .On motion made by Councilman Roach, seconded by Councilman Nielsen and on roll call vote by the City Clerk unanimously adopted, the following Resolution No. 113 entitled "A Resolution of the City Council of the City of Rolling Hills,.California Requesting the Establishment of a State College on the Palos Verdes Peninsula". Resalution No. 113 is set forth in full in the Book of Resolutions. RESOLUTION NO. 114 On motion made by Councilman Tourtelot,'seconded by Councilman Nielsen and on roll call vote by the City Clerk unanimously adopted, the following Resolution No. 114 entitled "A Resolution of the City Council of the City of Rolling Hills, California Fixing the Hours for the Trans= acting of City Business in the City Offices". Resolution No. 114 is set forth in full in the Book of Resolutions. ADJOURNMENT There being no further business*to come before the meeting, it was moved by Councilman Nielsen, seconded by Councilman Tourtelot and unanimously carried that the meeting be adjourned at 9:30 P.M.
