8/12/2002MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA AUGUST 12, 2002 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Lay at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL Councilmembers Present: Heinsheimer, Pernell, Mayor Pro Tem Hill and Mayor Lay. Councilmembers Absent: Murdock (excused). Others Present: Craig Nealis, City Manager. Mike Jenkins, City Attorney. Yolanta Schwartz, Planning Director. Marilyn Kern, Deputy City Clerk. Lt. Gregg Ahn, LASD, Lomita Station. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Regular Meeting July 22, 2002. RECOMMENDATION: Approve as presented. b. Payment of Bills. RECOMMENDATION: Approve as presented. Mayor Pro Tem Hill moved that the City Council approve the recommendations in the Consent Calendar, Councilmember Pernell seconded the motion, which carried unanimously. PLANNING COMMISSION ITEMS None. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS CONSIDERATION OF RESOLUTION NO. 920: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL IMPLEMENTATION REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089. City Manager Nealis presented the staff report providing information regarding the Congestion Management Program and the City's compliance with this program. Mayor Lay opened the public hearing and called for testimony. Hearing none and no discussion, he closed the public hearing and called for a motion. Councilmember Heinsheimer moved that the City Council adopt Resolution No. 920. Mayor Pro Tem Hill seconded the motion, which carried unanimously. ORDINANCE NO. 289: AN ORDINANCE OF THE CITY OF ROLLING HILLS AMENDING THE STORM WATER AND URBAN RUNOFF POLLUTION CONTROL ORDINANCE TO PROVIDE STORM WATER POLLUTION CONTROL FOR PLANNING AND CONSTRUCTION OF NEW DEVELOPMENT AND REDEVELOPMENT PROJECTS AND AMENDING AND SUPPLEMENTING THE ROLLING HILLS MUNICIPAL CODE AND DECLARING THE URGENCY THEREOF. City Attorney Jenkins presented the staff report providing information regarding the National Pollutant Discharge Elimination System Permit and the City's requirement to modify its existing ordinance. City Attorney Jenkins highlighted the changes in the new requirements that are included in the ordinance and indicated that some of the requirements do not apply to Minutes City Council Meeting 08/12/02 -1- Rolling Hills because they apply to commercial and industrial areas. Councilmembers discussed the revisions. In response to Councilmember Pernell, Planning Director Schwartz reported that the Los Angeles County Department of Building and Safety ensures that projects are in compliance with the ordinance and that Planning Commission resolutions contain conditions that specify compliance with the ordinance. Mayor Lay opened the public hearing and called for testimony. Hearing none and no further discussion, Mayor Lay closed the public hearing and called for a motion. Councilmember Heinsheimer moved that the City Council waive further reading and adopt urgency Ordinance No. 289. Councilmember Pernell seconded the motion, which carried unanimously. OLD BUSINESS None. NEW BUSINESS None. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME None. MATTERS FROM MEMBERS OF THE CITY COUNCIL Councilmember Pernell commented on a recent flyer he received from a local realtor, which listed 39 homes for sale in Rolling Hills. He also reported that the Palos Verdes Peninsula Regional Law Enforcement Committee recommended that the individual member cities authorize the funding for two additional Students and the Law Classes. He indicated that this recommendation will be on a future City Council Agenda. Mayor Lay reported that he would be absent from the City Council meetings in September. MATTERS FROM STAFF UPDATE ON WILDLIFE MANAGEMENT. City Manager Nealis provided an update regarding coyote management activities in the City. He reported on the 7/8/02 and 8/6/02 instances of predatory acts by coyotes against domestic pets during the day while people were present, and the successful calling and dispatching of a young coyote at one of those properties. He reported on the increased sightings, suspected and confirmed predatory activity reports and that eight months of trapping had not resulted in the capture of any animals. He indicated that Councilmember Heinsheimer suggested that the City more proactively manage the numbers of coyotes in the City. Councilmembers discussed the two predatory activities occurring in close proximity to humans. Councilmember Heinsheimer commented on the chart provided by staff and the marked increase in the number of sightings. In response to Councilmember Pernell, City Manager Nealis explained that the dispatching of coyotes would not be an attempt to remove all of the coyotes from the community, but would represent an attempt to reduce the population to manageable level and reinstall their natural behavior of nocturnal predatory activities rather than daytime predatory activities in the proximity of humans. Councilmembers concurred that due to the increased number of coyote sightings, lack of results from trapping, recent reported predatory acts near humans and the age of the coyote that was managed, that staff be authorized to work with the Los Angeles County Department of Agriculture to proactively reduce the number of coyotes in the City. The Council commented that after this action, a reduction in coyote reports should be observed. MATTERS FROM THE CITY ATTORNEY CLOSED SESSION The City Council finds, based on advice from legal counsel, that discussion in open session will prejudice the position of the local agency in the litigation.
