2/6/2003MINUTES ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS THURSDAY, FEBRUARY 6, 2003 The adjourned regular meeting of the City Council of the City of Rolling Hills was called to order at 4:40 PM at 40 Eastfield Drive by Mayor B. Allen Lay on Thursday, February 6, 2003. PRESENT: Councilmembers Hill, Pernell and Mayor Lay. ABSENT: Councilmember Heinsheimer, excused. ABSENT DUE TO ABSTENTION: Councilmember Murdock, excused. ALSO PRESENT: Craig Nealis, City Manager. Yolanta Schwartz, Planning Director. Mr. Nicholas Tonsich, applicant. Mr. Jerry Rodin, Architect. Mr. and Mrs. Bauer, 38 Easfield Drive. 1. FIELD TRIP TO THE FOLLOWING SITE A. ZONING CASE NO. 653 Mr. Nicholas Tonsich, 40 Eastfield Drive (Lot 91 -EF). Site Plan Review and a Conditional Use Permit to construct a detached garage and a guesthouse; request for a Variance to permit encroachment of the proposed detached garage into the side yard setback; and request for a Variance to locate the guesthouse in the rear yard area on a through lot at an existing single family residence in Zoning Case No. 653 at 40 Eastfield Drive. An addition to the main residence, which does not require discretionary approval and a future stable are also proposed. At the meeting, Mr. Rodin and Mr. Tonsich depicted the boundaries of the proposed detached garage and guest house, as well as the location of the future stable. Mr. Bauer, 38 Eastfield stated that when he bought his house he understood that the setback requirement for new construction was 20 feet. However, the garage and shed were there before he bought his property so he didn't object to their current location. He stated that the roof of the existing shed is lower than the roof of the proposed garage, and that part of the proposed garage will be located where the existing shed is. Mr. Bauer requested clarification as to the actual proposed construction versus the silhouette. Councilmembers expressed concern about the proximity of the proposed garage to the adjacent property and easement line. Mr. Tonsich commented that he would be willing to plant trees in the easement to obstruct the proposed garage from the neighbor's view. Mayor Lay stated that planting in the easement is not allowed, unless a license agreement is approved by the RHCA, and that the City Council could not approve a development with a condition that planting be installed in an easement. Following discussion, Councilmember Pernell suggested that the proposed garage be moved away from the easement, so that a lesser encroachment into the side yard setback would be required, and so screening could be accomplished outside of the easement. After viewing the silhouette of the project at 40 Eastfield Drive, the City Council visited 38 Eastifeld Drive to view the project from that property. Following further discussion, the applicant agreed to take City Council's concerns under consideration and revisit the proposal. The public hearing was continued to February 10, 2003. 2. ADJOURNMENT Hearing no further business before the City Council, the Council adjourned the meeting at 5:15 PM., to a regular meeting of the City Council to be held on Monday, February 10, 2003 beginning at 7:30 p.m., in the City Council Chambers, at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
