7/28/2003MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA JULY 28, 2003 CALL TO ORDER An adjourned regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Hill at 7:07 p.m. at 10 Portuguese Bend Road, Rolling Hills, California. ROLL CALL Councilmembers Present: Lay, Pernell, Mayor Pro Tem Heinsheimer and Mayor Hill. Councilmembers Absent: Black (excused). Others Present: Craig Nealis, City Manager. Yolanta Schwartz, Planning Director. Stan Lamport, Applicants' Representative. Criss Gunderson, Applicants' Representative. Ling Ling Hwung, Applicant. Jeff Pieper, 3 Eucalyptus Lane. PUBLIC HEARINGS - Continued ZONING CASE NO. 660 CONSIDERATION OF AN APPEAL OF PLANNING COMMISSION DECISION TO DENY A REQUEST FOR A SITE PLAN REVIEW TO PERMIT THE CONSTRUCTION OF A SWIMMING POOL/SPA, ON A PROPERTY THAT REQUIRES PLANNING COMMISSION REVIEW, DUE TO EXISTING STRUCTURAL DEVELOPMENT APPROVED IN MARCH 2001, AT A SINGLE FAMILY RESIDENCE, AT 10 PORTUGUESE BEND ROAD, (LOT 52-RH. (HWUNG). City Manager Nealis presented the staff report describing the applicants' appeal of a Planning Commission denial for a 508 sq. ft. pool and spa. The City Manager reviewed the history of this case indicating that this property has a restriction on future development requiring Planning Commission review and that this restriction was imposed by the Commission during the previous approval of the residential structure on the lot. Mayor Hill opened the continued public hearing. Discussion ensued regarding the case. Councilmember Lay questioned why the pool was not planned in the beginning. Stan Lamport, representing the applicants, indicated that the applicant had not originally wanted a pool and due to fire suppression benefits and the minimal impact on the property, the applicant has elected to request a pool at this time. Mrs. Huang further emphasized that they originally did not want a pool, however, desires to have a pool at this time. Architect Criss Gunderson indicated that he felt that when the Planning Commission viewed this property in the field, that the Commission did not have a full impact of the flatness and the size of the lot due to the debris and construction staging areas that were present. Staff provided an explanation regarding the impact of the Community Association easements relative to the setbacks for this property and the impact on net lot area. Applicants' representative Stan Lamport indicated that he felt the impact of the proposed pool and spa is minimal. Hearing no further discussion, Mayor Hill continued the public hearing to the next regular meeting of the City Council to be held on Monday, July 28, 2003, at 7:30 p.m. in the City Council Chambers, 2 Portuguese Bend Road, Rolling Hills, California.
