4/10/19611 1 F -j MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE .CITY OF ROLLING HILLS, CALIFORNIA April 10, 1961 In the absence of the Mayor and Mayor pro tempore, it was moved by Councilman O'Flaherty and seconded by Council- man Roach that Councilman Nielsen preside. The regular meeting of the City Council of the City of Rolling Hills, was called to order by acting Mayor Nielsen at 7:30 P.M., Monday, April 10, 1961. ROLL CALL Present: Absent: Also Present: APPROVAL OF MINUTES Councilmen Nielsen, O'Flaherty and Roach Councilman Tourtelot and Mayor Horn City Attorney William Kinley City Manager Gilbert B. Myers De.pty City Clerk Mary Louise Powers Mr. James Elliott 9 Eastfield Drive On motion of Councilman Roach, seconded by Council- man O'Flaherty and unanimously carried, the minutes of the meeting held March 27, 1961 were approved as written. CORRESPONDENCE The City Clerk read the following: a) letter from City of San Gabriel dated March 29, 1961 enclosing copy of resolution adopted by said City entitled "A Resolution of the City Council of the City of San Gabriel, California, Imploring All Patriotic Americans to Awaken and to Fight All Communistic Activity". b) letter dated March 31, 1961 from City of Inglewood stating that its City Council at their meeting on March 28, 1961 took action to oppose the proposed Municipal Court consolidation until complete study can be made. c) letter dated March 31, 1961 from the City of Torrance enclosing copy of resolution urging foundation of a four-year college on the Palos Verdes Peninsula. d) letter dated March 24, 1961 re the consolidation of Municipal Courts e) letter from the Torrance Chamber of Commerce re the re -location of Superior Court Districts f) letter dated April 6, 1961 from City of South Gate urging all city councilmen to attend the U. S. Conference of Mayors in Washington in June and the American Municipal Association Conference in Seattle in August. MUNICIPAL COURT CONSOLIDATION The matter was ordered tabled until the next meeting at which time the City Attorney will -make a report. PALOS VERDES-PENINSULA COORDINATING COUNCIL The City Clerk read a letter dated April 1, 1961 from John H. Muchmore, President, Palos Verdes Peninsula Coordinating Council re the establishment of a Civic Improve- ment Committee as a permanent part of the Council activities. The Committee, composed of personnel appointed by each of the member organizations, would originate and -plan community action toward beautifying and improving the Peninsula.thr-ough tree planting, weed control, anti -litter campaigns and other problem areas which may be suggested to the Committee. Enclosed with letter was a report of the Peninsula Recreation Planning Council which made the following recommend- ations and suggestions to the Coordinating Council at their meeting on Feb. 2, 1961: 1) that petitions be circulated within the boundaries of the Palos Verdes School District for the purpose of initiating formation of a peninsula recreation district;. that a tax limit be set -between 10� and 15(,% per $100 assessed valuation; that it be understood that - areas could be withdrawn or added at the time of protest hearings; that private (or city) facilities remain private. 2) that the Goord�nating Council form a working committee to implement the recommendation to form a peninsula recreation district. - Councilman Nielsen, representing the City of Rolling Hills on'the Palos Verdes Peninsula Coordinating Council, stated that he had voted against Recommendation No. 1. After discussion, the City Attorney was requested to make a written report at the next meeting of the City Council on the.procedures-which are followed in the formation of a recreation district. Councilman Nielsen further stated that it would be necessary for him to resign from the Palos Verdes Peninsula Coordinating Council and instructed the City Clerk to so inform Mrs. Walter Bott, Chairman. Replacement for Councilman Nielsen will be appointed at the next meeting of the City Council. It was moved by Councilman O'Flaherty, seconded by Councilman Roach and unanimously carried that the City Clerk direct a letter to the Parks and -Recreation Department of Los'Angeles County.requesting a reply to Councilman Nielsen's letter re proposed recreational facilities at the landfill area. 1 1 r GATE OPERATION It was moved by Councilman O'Flaherty, seconded by Councilman Roach and unanimously carried that -the City Council reconsider its motion of March 27, 1961 in which the City Council authorized expenditure of -additional $1',500.00 over $37,000.00 by.the Association. The City Clerk presented the register of bills ,to be allowed for payment.. On motion of Councilman Roach, seconded by Councilman O'Flaherty and on roll call vote by the City Clerk unanimously carried Demands 842 through 847 were approved,for payment from the General Fund, and Demands 848 through 850 were approved.for payment from. the Special In Lieu Fund as follows: Demand After discussion of the operation of the gates, State `Employees'*.-Re`tirement... . it was moved by Councilman Roach, seconded by Councilman 0' -Flaherty and on roll call vote by the City Clerk unan- imously carried that the City reimburse the.Rolling Hills $ 184.50 Community Association for the operation of the gates for No. all sums of money expended.by'them or to be expended by Internal Revenue.Service them in excess of the contract price of $3,083.33 per:..,. Demand month -through the month of April, 1961.. On May 1,.1961 844 the City will advise the Association of the amount of 10.50 money, if any, that is to be expended for the months of No. May and June, 1961 in excess of the contract price of Pacific Telephone $3,083.33 per month. Demand No. t1; SWAFFIELD MEMORIAL .73.70 Demand •-* The�Manager reported that.letters had been sent == to the Presidents of the Board.of Directors of.the Rolling Hills Community Association, Los Caballeros Del Rancho -.TO Palos Verdes and Rolling Hills Garden Club and to the Mayor $ 437.43 requesting that they attend a meeting of the Swaffield -No. Memorial Committee on April'19, 1961. City of Rolling Hills PAYMENT OF CITY BILLS The City Clerk presented the register of bills ,to be allowed for payment.. S. Treasury Bills; and in the In Lieu Fund the,balance was $12,499.82, including $12,000.00 face value Treasury Bills. On motion bade by Councilman O'Flaherty, seconded by Councilman Roach and unanimously carried, the report was accepted and ordered filed. BOWIE ROAD FIRE REPORT The City Clerk was directed to find out from Chief Thomas when the City Council could expect to receive the - report on the water flow in all of the hydrants in the City of Rolling Hills. REPORT ON PURCHASE OF GATE PROPERTIES Mr. Kinley reported that he had talked with Mr. E. D. Palmer of Palos Verdes Properties regarding the price of certain pieces of property at the entrance gates to the City of Rolling -.Hills. He reported that Mr. Palmer stated that Palos Verdes Properties was of the opinion that any price that was set on the property on which the Palos Verdes Properties Administration Building is located would have to be precficated on its use as permitted by the deed restrictions rather than.the use as permitted by the zoning ordinance. He further reported that Mr. Palmer stated that this site could be sold to a private school and this was the best use to be made of the property. He further reported that Palos Verdes Properties possibly might take the position that they would not sell any of the gate properties unless the city agreed to a variance of the zoning ordinance, allowing the property on which the Administration Building is located to be used as a private school. Mr. Kinley reported that in the event the Palos Verdes Properties would not sell to the City of Rolling Hills,that then the only remedy left to the city, if they desired to acquire the property, would be to condemn the same and if they elect to follow that procedure that the money for the purchase of the condemned property would have to be immediately available. Councilman Nielsen suggested that the City Council meet with the Board of Directors of the Rolling Hills Community Association to discuss what course should be taken in connection with the acquisition of the.gate properties.
