8/9/2004MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA AUGUST 9, 2004 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Heinsheimer at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL Councilmembers Present: Black, Hill, Lay, Mayor Pro Tem Pernell and Mayor Heinsheimer. Councilmembers Absent: None. Others Present: Craig Nealis, City Manager. Michael Jenkins, City Attorney. Nan Huang, Finance Director. Yolanta Schwartz, Planning Director. Marilyn Kern, Deputy City Clerk. Lt. Gregg Ahn, LASD, Lomita Station. CONSENT CALENDAR Matters, which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Regular Meeting of July 26, 2004. RECOMMENDATION: Approve as presented. b: Payment of Bills. RECOMMENDATION: Approve as presented. C. Consideration of approval of an agreement between the City of Rolling Hills and Union Bank of California for banking services and for deposit of moneys. RECOMMENDATION: Approve as presented. At the direction of Mayor Heinsheimer based upon a request of Councilmember Black, Consent Calendar item 3-c was removed for discussion. Councilmember Hill moved that the City Council approve the recommendations in remainder of the Consent Calendar. Mayor Pro Tem Pernell seconded the motion, which carried unanimously. C. Consideration of approval of an agreement between the City of Rolling Hills and Union Bank of California for banking services and for deposit of moneys. RECOMMENDATION: Approve as presented. Councilmember Black reported that in light of the fact that Union Bank had proposed to charge fees for banking services, he had asked the Finance Director to contact Bay Cities National Bank and that they had offered to provide these services free of charge. The City Council directed staff to provide further information and a report regarding the services offered by Bay Cities National Bank at an upcoming City Council meeting. PLANNING COMMISSION ITEMS None. TRAFFIC COMMISSION ITEMS CONSIDERATION OF A RECOMMENDATION FROM TRAFFIC COMMISSION REGARDING A REQUEST FROM MR. DARTY CRONIN, 2 POSSUM RIDGE ROAD, FOR A SPEED LIMIT SIGN AND REVIEW OF SPEED LIMIT ON POSSUM RIDGE ROAD (SPEED LIMIT REDUCTION). City Manager Nealis presented the staff report providing information regarding the request from Mr. Cronin and the Traffic Commission recommended reduction of the speed limit on Possum Ridge Road to 20 mph. Mayor Heinsheimer asked if there was anyone in attendance Minutes City Council Meeting 08/09/04 -1- wishing to oppose the Traffic Commission recommendation. Hearing none, he called for a motion. Councilmember Black moved that the City Council approve the recommendation of the Traffic Commission to reduce the speed limit on Possum Ridge Road to 20 mph and that staff be directed to erect the appropriate sign(s). Mayor Pro Tem Pernell seconded the motion, which carried unanimously. CONSIDERATION OF A RECOMMENDATION FROM THE TRAFFIC COMMISSION RELATIVE TO CORRESPONDENCE FROM MRS. HILLARY POST, 1 ACACIA ROAD, REGARDING CROSSING GUARD SERVICES. City Manager Nealis presented the staff report providing information regarding Mrs. Post's request for crossing guard services on Palos Verdes Drive North at Portuguese Bend Road/Rolling Hills Road and the Traffic Commission recommendation that the City Council direct staff to request the City of Rolling Hills Estates to conduct a crossing activity survey. Mayor Heinsheimer asked if there was anyone in attendance wishing to oppose the Traffic Commission recommendation. In response to Mayor Pro Tem Pernell, City Manager Nealis explained that he had spoken to representatives in Rolling Hills Estates about this subject and they indicated that a crossing activity survey had been conducted at this location previously and at that time the crossing activity did not warrant a crossing guard. City Manager Nealis indicated that crossing activity might have increased during the past two years due to the re -opening of Dapplegray Elementary School and that Rolling Hills Estates is willing to conduct another survey. Hearing no further discussion, Mayor Heinsheimer called for a motion. Councilmember Lay moved that the City Council approve the recommendation of the Traffic Commission and direct staff to request the City of Rolling Hills Estates to conduct a crossing activity survey at the subject location and submit this information to the Traffic Commission for consideration. Councilmember Black seconded the motion, which carried unanimously. CONSIDERATION OF A RECOMMENDATION FROM THE TRAFFIC COMMISSION RELATIVE TO A REQUEST FOR SEPARATION OF DRIVEWAY ACCESS AT 3 (PODELL) AND 5 (ULLRICH) PINE TREE LANE. City Manager Nealis presented the staff report outlining the request for separation of the driveway access at 3 and 5 Pine Tree Lane. Mayor Heinsheimer asked if there was anyone in attendance wishing to oppose the Traffic Commission recommendation. Hearing none, he called for comments from the City Council. In response to Mayor Pro Tem Pernell, City Manager Nealis explained that the driveway has been in its current configuration since the lots were first developed. Councilmember Black confirmed that the driveway to the two properties had been in the current configuration since the lots were first developed. City Manager Nealis reported that the property at 5 Pine Tree Lane had recently been subdivided and that both property owners want to separate the driveways. In response to Councilmember Black, City Manager Nealis explained that the Traffic Commission recommended that the planting material in the planter be less than 3 feet in height. Hearing no further discussion, Mayor Heinsheimer called for a motion. Mayor Pro Tem Pernell moved that the City Council approve the recommendation of the Traffic Commission relative to a request for the separation of the driveway access at 3 and 5 Pine Tree Lane. Councilmember Black seconded the motion, which carried unanimously. Mayor Heinsheimer announced that unless there was an objection, he would like to consider item 7-A at this time because it is also a recommendation from the Traffic Commission. Hearing no objection, he so ordered. OLD BUSINESS CONSIDERATION OF SAFETY CONSIDERATIONS POSED BY A TREE ADJACENT TO 10 PINE TREE LANE, INCLUDING CONSIDERATION OF A RECOMMENDATION FROM THE TRAFFIC COMMISSION TO INSTALL AN "IMPAIRED VERTICAL CLEARANCE" SIGN AND OTHER POSSIBLE MEASURES OR ACTIONS. City Manager Nealis presented the staff report regarding the recommendation from the Traffic Commission relative to the installation of an "Impaired Vertical Clearance" sign on Pine Tree Lane. He reported that this recommendation from the Traffic Commission resulted Minutes City Council Meeting 08/09/04 -2- F, 1 1 Councilmember Lay moved that the City Council approve the recommendation of the Traffic Commission relative to the request from the American Institute of Architects Long Beach/South Bay Chapter to conduct a homes tour at 2 Williamsburg Lane and 11 Crest Road West. Councilmember Hill seconded the motion, which carried unanimously by those Councilmembers in attendance. CONSIDERATION OF A RECOMMENDATION FROM THE TRAFFIC COMMISSION RELATIVE TO THE PALOS VERDES ART CENTER AND PVP ROTARY CLUB CAR RALLYE ON SEPTEMBER 18, 2004. City Manager Nealis presented the staff report and Traffic Commission recommendation that the City Council approve the request. In response to Councilmember Lay, City Manager Nealis explained that this item is also subject to the approval by the RHCA. Mr. Don West and Mr. Mike Richardson, representing the PV Art Center and PVP Rotary Club, indicated that a letter has been presented to the RHCA Manager regarding the event. Mr. West further explained the route that the vehicles will follow and that drivers are required to adhere to local traffic laws. He stated that that the Sheriff's Department would be alerted to the event. Mayor Pro Tem Pernell asked if personnel monitoring the event would be stationed along the route. Mr. West and Mr. Richardson indicated that monitors are not used, but that drivers are attempting to complete the route as close to the time required by traveling at posted speed limits and obeying all other traffic regulations and that the event is not a "speed event". Hearing no further discussion, Mayor Pro Tem Pernell called for a motion. Councilmember Lay moved that the City Council approve the recommendation of the Traffic Commission relative to the request from the Palos Verdes Art Center and PVP Rotary Club to conduct a Car Rallye on September 18, 2004. Councilmember Hill seconded the motion, which carried unanimously by those Councilmembers in attendance. PUBLIC HEARINGS None. OLD BUSINESS None. NEW BUSINESS None. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME Mrs. Mary Graff, Co -President of the Women's Community Club invited the City Council and audience to the Women's Community Club's annual fundraiser on Saturday, July 31, 2004. MATTERS FROM MEMBERS OF THE CITY COUNCIL Mayor Pro Tem Pernell commented on the City's Hazard Mitigation Plan. City Manager Nealis explained that he and Planning Director Yolanta Schwartz participated in the second Hazard Mitigation Plan preparation meeting with the contractor and representatives of the Sheriff, Fire and Public Works Departments, RHCA, Area G and utility companies. Mayor Pro Tem Pernell also commented on correspondence that had been received from RHCA Board Member Ralph Black regarding an item on the Consent Calendar relating to AB 2702. After a brief discussion, Councilmembers in attendance elected to not take a formal position on this legislation. MATTERS FROM STAFF None. MATTERS FROM THE CITY ATTORNEY CLOSED SESSION The City Council finds, based on advice from legal counsel, that discussion in open session will prejudice the position of the local agency in the litigation. No closed session was held. ADIOURNMENT Hearing no further business before the City Council, Mayor Pro Tem Pernell adjourned the meeting at 7:55 p.m. to the next regularly scheduled meeting of the City Council to be held on Monday, August 9, 2004, beginning at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
