11/3/2004MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA NOVEMBER 3, 2004 CALL TO ORDER An adjourned regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Heinsheimer at 7:32 a.m. at 12 Southfield Drive, Rolling Hills, California. ROLL CALL Councilmembers Present: Black, Hill, Lay, Mayor Pro Tem Pernell and Mayor Heinsheimer. Councilmembers Absent: None. Others Present: Craig Nealis, City Manager. Yolanta Schwartz, Planning Director. Roger North, Applicant's Architect. Doug McHattie, Applicant's Representative. Mahesh Patel, Applicant. John Margeta, Planning Commissioner. PUBLIC HEARINGS ZONING CASE NO. 689. REQUEST FOR A SITE PLAN REVIEW FOR GRADING AND CONSTRUCTION OF A NEW RESIDENCE TO REPLACE AN EXISTING RESIDENCE AND A VARIANCE TO EXCEED THE MAXIMUM PERMITTED DISTURBED NET LOT AREA IN ZONING CASE NO. 689 AT 12 SOUTHFIELD DRIVE, (LOT 35 -SF) (PATEL). Those ,in attendance viewed the silhouette presented for consideration of the above referenced Zoning Case. Councilmember Lay expressed concern over the length and height of the wall located along the southwestern limit of the pad. Mr. McHattie and Mr. North oriented those in attendance to the location of the wall, setbacks, basement and above ground structures associated with the project. Councilmember Lay expressed concern over the existing quantity of disturbed area and that the case is requesting to increase the area of disturbance and the grading. Mayor Heinsheimer inquired whether the wall was necessary and if the setback requirements were preventing a smaller wall from being requested in the setback on that portion of the property. He also questioned whether the wall could be removed from the project if the grading for the slope were to increase in that direction. Mr. McHattie indicated that it would be possible to do the project without the wall but that it would increase the grading and disturbed area. Mayor Pro Tem Pernell expressed concern over the mass and size of the structure. Councilmember Black indicated that he felt the project was not too large. Councilmember Black concurred with the idea of sloping the pad toward the setback. Following discussion, Mayor Heinsheimer suggested that the applicant consider reducing the height of the pad slightly and moving the home a few feet in the northerly direction, which would also minimize the grading toward the adjoining downhill property. Planning Director Schwartz provided background regarding the original design of the house submitted to the Planning Commission by the applicant. Planning Commissioner John Margeta commented on the Commission deliberation on the case and expressed his concern that the house, in relation to the lot size, was significantly smaller than cases that were being approved by the Commission for new homes on Eastfield Drive. Commissioner Margeta indicated that he had voted in support of this case at the Commission level. Following discussion, it was the consensus of the City Council to retain jurisdiction of this case and not remand it back to the Planning Commission. The applicant was requested to work with his representatives and staff to perhaps move the house slightly to the north and lower the pad slightly, which would reduce or eliminate the need for the wall on the southwestern limit of the pad. The applicant was also suggested to consider reducing the project to address concerns expressed by Mayor Pro Tem Pernell. ADIOURNMENT Hearing no further business before the City Council, Mayor Heinsheimer adjourned the meeting at 8:08 a.m. to the next regularly scheduled meeting of the City Council to be held on Monday, November 8, 2004, beginning at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
