CALL TO ORDER
A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor
Heinsheimer at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road,
Rolling Hills, California.
ROLL CALL
Councilmembers Present: Hill, Lay, Mayor Pro Tem Pernell and Mayor Heinsheimer.
Councilmembers Absent: Black (excused).
Others Present: Craig Nealis, City Manager.
Michael Jenkins, City Attorney.
Yolanta Schwartz, Planning Director.
Marilyn Kern, Deputy City Clerk.
CONSENT CALENDAR
Matters which may be acted upon by the City Council in a single motion. Any
Councilmember may request removal of any item from the Consent Calendar causing
it to be considered under Council Actions.

Mayor Pro Tem Pernell moved that the City Council

PUBLIC HEARING

CONSTRUCTION OF A NEW RESIDENCE TO REPLACE AN EXISTING RESIDENCE
AND A VARIANCE TO EXCEED THE MAXIMUM PERMITTED DISTURBED NET LOT
AREA IN ZONING CASE NO. 689 AT 12 SOUTHFIELD DRIVE, (LOT 35 -SF) (PATEL).
(RECOMMENDED FOR CONTINUANCE)
Hearing no objection, Mayor Heinsheimer continued the public hearing, at the applicant's
request, to the next regular meeting of the City Council scheduled to be held on Monday,
November 22, 2004.
Mayor Heinsheimer requested that items 8-A and 8-B be considered next on the agenda.
NEW BUSINESS
RESOLUTION NO. 969: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROLLING HILLS APPROVING A MODIFICATION TO CITY COUNCIL
RESOLUTION NO. 946 AND APPROVING AN EXTENSION TO A PREVIOUSLY
APPROVED SITE PLAN REVIEW REQUEST TO CONSTRUCT AN ADDITION TO A
SINGLE FAMILY RESIDENCE AND GRANTING VARIANCE REQUESTS TO
EXCEED THE MAXIMUM PERMITTED STRUCTURAL AND TOTAL LOT
COVERAGE AT AN EXISTING SINGLE FAMILY RESIDENCE IN ZONING CASE
NO. 664 AT 15 EASTFIELD DRIVE, LOT 52 -EF. (GORDON).

City Manager Nealis presented the staff report outlining the applicant's request for an
extension of time. Hearing no discussion, Mayor Heinsheimer called for a motion.
Councilmember Lay moved that the City Council adopt Resolution No. 946. Mayor Pro Tem
Pernell seconded the motion, which carried unanimously by those Councilmembers in
attendance.
CONSIDERATION OF A SECOND AMENDED AND RESTATED JOINT POWERS
AGREEMENT WITH THE SOUTH BAY CITIES COUNCIL OF GOVERNMENTS (A
JOINT POWERS AUTHORITY).
City Manager Nealis presented the staff report outlining the amendments regarding board
appointments, voting of delegates and alternates and governing board elections. Hearing no
discussion, Mayor Heinsheimer called for a motion.
Councilmember Hill moved that the City Council approve the agreement. Mayor Pro Tem
Pernell seconded the motion, which carried unanimously by those Councilmembers in
attendance.
CONSIDERATION OF A RECOMMENDATION FROM THE PLANNING
COMMISSION CONCERNING A PROPOSED ORDINANCE NO. 295: AN
ORDINANCE OF THE CITY OF ROLLING HILLS REGARDING COMPREHENSIVE
AMENDMENTS TO THE ROLLING HILLS MUNICIPAL CODE TITLE 16,
SUBDIVISION, AND TITLE 17, ZONING, AND AMENDING TITLE 16, SUBDIVISION,
AND TITLE 17, ZONING, OF THE ROLLING HILLS MUNICIPAL CODE. (FIRST
READING AND INTRODUCTION)
Mayor Heinsheimer announced the item and opened the continued public hearing.
Mr. Criss Gunderson, 2024 Via Pacheco, Palos Verdes Estates, stated that as a local architect he
is concerned about the inclusion of covered porches and entryways in the pad coverage
calculations for development projects in the City. He explained that these architectural
features are consistent with ranch style homes and that they add to the character of the City.
He also explained the practical reasons for having a protected entry to a home. Mr.
Gunderson indicated that he feels that clients will choose to not construct these features if they
will impact the pad area in the same manner as habitable space. He further explained that
clients would more than likely elect to remove the covered porch or entryway before they
would reduce the size of a particular room in a proposed structure. He suggested that the
City Council might wish to consider an allowance toward the covered porches rather than
grouping them together in the structural coverage calculations. He suggested an allowance of
10%-20% of the livable area.
The City Council discussed Mr. Gunderson's concern and suggestion and concurred that the
Planning Commission should study this concept in the future. Discussion ensued regarding
covered porches and other like structures and their impact on the footprint of the proposed
structure and the property. The City Council felt that the amendment that covered porches be
included in the pad calculation should remain in the ordinance due to the impact that these
types of structures have on the property. Mayor Pro Tem Pernell thanked Mr. Gunderson for
expressing his concern to the City Council.
Following discussion, and a determination that the Planning Commission should study the
subject of including covered porches in the pad calculations, Mayor Heinsheimer called for a
motion. Councilmember Lay moved that the City Council waive further reading and
introduce Ordinance No. 295. Councilmember Hill seconded the motion, which carried
unanimously by those Councilmembers in attendance. The public hearing was continued to
the next regular meeting of the City Council scheduled to be held on Monday, November 22,
2004 for consideration of second reading and adoption.

MATTERS FROM STAFF
City Manager Nealis provided an update on the Rule 20A Undergrounding Project on Crest
Road. He indicated that the cable and phone companies must complete their work before this
project can be finalized.
MATTERS FROM THE CITY ATTORNEY
CLOSED SESSION
The City Council finds, based on advice from legal counsel, that discussion in open
session will prejudice the position of the local agency in the litigation.

No closed session was held.
ADJOURNMENT
Hearing no further business before the City Council, Mayor Heinsheimer adjourned the
meeting at 7:55 p.m. in memory of long time Rolling Hills residents, Dr. Dave Basque, Mr. Ken
Crane and Mr. William Peters who passed away recently. The meeting was adjourned to a
regular meeting of the City Council scheduled to be held on Monday, November 22, 2004,
beginning at 7:30 p.m., in the City Council Chambers at City Hall, 2 Portuguese Bend Road,
Rolling Hills, California.
