2/14/2005MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA FEBRUARY 14, 2005 CALL TO ORDER An adjourned regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Heinsheimer at 8:00 a.m. at 65 Eastfield Drive, Rolling Hills, California. ROLL CALL Councilmembers Present: Black, Hill, Lay, Mayor Pro Tem Pernell and Mayor Heinsheimer. Councilmembers Absent: None. Others Present: Craig Nealis, City Manager. Dr. & Mrs. Randolph Tyndall. Mr. Joe Juge. Mr. Stan Lamport. PUBLIC HEARINGS - CONTINUED CONSIDERATION OF AN APPEAL OF COMMITTEE ON TREES AND VIEWS RESOLUTION NO. 2004-1-CTV SETTING FORTH FINDINGS RELATING TO THE REMOVAL AND TRMMUNG OF TREES AT 61 EASTFIELD DRIVE RELATING TO A VIEW IMPAIRMENT FROM 65 EASTFIELD DRIVE. LOCATION: 61 EASTFIELD DRIVE PROPERTY OWNER: MR. JOE JUGE, JR. COMPLAINANT: DR. & MRS. RANDOLPH T. TYNDALL APPELLANT: DR. & MRS. RANDOLPH T. TYNDALL City Manager Nealis provided an orientation of the view that was established by the Committee adjacent to the northerly most glass door facing directly toward the pool. Mr. Nealis also explained the Committee determination relative to the five trees, two of which were to be removed, two to be trimmed and laced, and one trimmed, laced and reduced in height by five feet. Mr. Nealis also pointed out that tree number one, which was identified for removal, was no longer in the view because it had fallen during the recent storms. Dr. Tyndall commented that he felt that the View Committee did not allow him to fully express his concerns in this case and was arbitrary in the determination on how the trees should be trimmed. He expressed his support to have his view restored and his overall frustration with the process. City Councilmembers viewed the vista from the perspective of 65 Eastfield Drive (Tyndall property). Following a brief discussion, the City Council proceeded to inspect the trees from the Juge property, 61 Eastfield Drive. All City Councilmembers, staff, Mrs. Tyndall, Mr. Juge and Mr. Lamport joined the City Council at the Juge property. The City Council observed the trees from the area immediately outside of the home where they had been viewed by the Committee. City Manager Nealis explained the discussion that had taken place at the Committee meeting involving the idea of removing the right most trunk of tree number two, when facing uphill, however, the Committee had ultimately determined to not require that. trunk to be removed. Mr. Juge explained that the trees offer him privacy especially from his patio. Those in attendance viewed the patio area of the home. Following discussion and hearing no other business before the City Council, the public hearing was continued to February 28, 2005 at 7:30 p.m. to reconvene at the City Council Chambers, 2 Portuguese Bend Road, Rolling Hills. Mike Jenkins, City Attorney. Marilyn Kern, Deputy City Clerk. Lt. Greg Ahn, LASD, Lomita Station. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes -Regular Meeting of January 24, 2005. RECOMMENDATION: Approve as presented. b. Payment of Bills. RECOMMENDATION: Approve as presented. C. BFI Recycling Tonnage Report for December, 2004. RECOMMENDATION: Receive and file. d. Request by the Rolling Hills Tennis Club for disbursement of FY 2004-05 funds for specific projects. RECOMMENDATION: Approve as presented. Councilmember Hill moved that the City Council approve the recommendations in the Consent Calendar. Mayor Pro Tem Pernell seconded the motion, which carried unanimously by those Councilmembers in attendance. PLANNING COMMISSION ITEMS None. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS None. OLD BUSINESS None. NEW BUSINESS CONSIDERATION OF PARTICIPATION IN A PENINSULA -WIDE SALUTE TO SERVICE 'BLUE STAR" OVERSEAS MILITARY SERVICE RECOGNITION PROGRAM. City Manager Nealis provided a staff report on this item and indicated that the City of Rolling Hills Estates would be coordinating the program and that the other Peninsula Cities have indicated that they would participate. Hearing no further discussion, Mayor Heinsheimer called for a motion. Councilmember Lay moved that the City Council participate in the 'Blue Star" Program. Mayor Pro Tem Pernell seconded the motion, which carried unanimously by those Councilmembers in attendance. Mayor Heinsheimer appointed Councilmember Frank Hill to serve as the City Council coordinator for this program. Minutes City Council Meeting 02/14/05 -1- CONSIDERATION OF THE GENERAL SERVICES AGREEMENT BETWEEN THE CITY AND THE COUNTY OF LOS ANGELES. RESOLUTION NO. 972: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ADOPTING THE GENERAL SERVICES AGREEMENT BETWEEN THE CITY OF ROLLING HILLS AND THE COUNTY OF LOS ANGELES. Mayor Heinsheimer announced the item. Hearing no discussion, he called for a motion. Councilmember Hill moved that the City Council adopt Resolution No. 972. Councilmember Lay seconded the motion, which carried unanimously by those Councilmembers in attendance. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME None. MATTERS FROM MEMBERS OF THE CITY COUNCIL Councilmember Lay reminded the City Council of the South Bay Cities Council of Governments 6"' General Assembly on Thursday, February 24, 2005 at the Norris Pavilion for the Performing Arts Center and requested that the event information be forwarded to the City Council. Mayor Pro Tem Pernell commented on correspondence received recently from Assembly Member Betty Karnette seeking a nomination for the 54' Assembly District "Woman of the Year". Councilmembers discussed that there are a number of women in Rolling Hills deserving of this recognition. Mayor Heinsheimer asked that Councilmembers forward any nominations to staff. Councilmember Lay suggested, and the City Council concurred, that the Mayor be permitted to select the nomination. MATTERS FROM STAFF City Manager Nealis reported that the Traffic Commission had recently considered driver feedback signs at their last meeting and that Councilmember Hill had suggested that Caballeros be consulted about the signs prior to presenting a report to the City Council and that unless there were any objections that he and Councilmember Hill would proceed. There were no objections from the City Council. MATTERS FROM THE CITY ATTORNEY CLOSED SESSION The City Council finds, based on advice from legal counsel, that discussion in open session will prejudice the position of the local agency in the litigation. Existing Litigation: G.C. 54956.9(a) Judith Hassoldt and William Hassoldt, Individuals, Plaintiffs, vs City of Rolling Hills, et. al., Los Angeles County Superior Court, Case No. BC275012. No closed session was held. ADIOURNMENT Hearing no further business before the City Council, Mayor Heinsheimer adjourned the meeting at 8:40 p.m. to then next regular meeting of the City Council scheduled to be held on Monday, February 28, 2005, beginning at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
