CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA OCTOBER 10, 2005 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Pernell at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. � ROLL CALL � Councilmembers Present: , Black, Heinsheimer, Hill, Mayor Pro Tem Lay and Mayor Pernell. � Councilmembers Absent: None. Others Present: Craig Nealis, City Manager. Mike Jenkins, City Attorney. Marilyn Kern, Deputy City Clerk. Lt. Greg Ahn, LASD, Lomita Station. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single. motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Meeting of September 26, 2005:. RECOMMENDATION: Approve as presented. b. Payment of Bills. RECOMMENDATION: Approve as presented. , Councilmember Hill moved that the City Council approve the recommendations in the Consent Calendar. Councilmember Heinsheimer seconded the motion. In response to Councilmember Black, City Manager Nealis explained the order of the checks and the two special checks under "Payment of Bills". The motion carried unanimously. PLANNING COMMISSION ITEMS None. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS A. ZONING CASE NO. 708 MR. AND MRS. PHILII' CHO, 25 PORT'UGUESE BEND ROAD, (LOTS 89-A-RH). STTE PLAN REVIEW FOR GRADING AND CONSTRUCTION OF AN ADDTITON TO AN EXIS'TIl�1G SINGLE FAMILY RESIDENCE,A SPORTS COURT AND A GUEST HOUSE; CONDITTONAL USE PERMITS TO CONSTRUCT A SPORTS COURT AND A GUEST HOUSE AND A VARIANCE TO LOCATE THE SPORTS COURT IN TI-� FRONT YARD AREA AT AN EXISTING SINGLE FAMILY RESIDENCE. City Manager Nealis presented the staff report outlining the applicants' request and providing background regarding the property. He indicated that the City Council took this case under jurisdiction at their September 26, 2005 meeting. City Manager Nealis reported that the applicants' representative has provided a cross-section of the proposed sports court and that the plan shows trees that will be introduced around the proposed sports court. He stated that the applicant plans to have a few 36" and 48" boxed trees around the proposed court at the City Council field trip. Councilmember Black indicated that grading for the residential Minutes City Council Meeting 10/10/05 _1_ structure can be seen from Portuguese Bend Road and that the flags for the proposed sports court are also visible from Portuguese Bend Road. Mayor Pernell opened the public hearing and called for testimony. Mr. Doug McHattie, Bolton Engineering, explained the flagging that is visible from Portuguese Bend Road is the line depicting the top of the fence around the proposed sports court. He explained the trees that the applicants have ordered will significantly screen the proposed sports court and indicated that they will not grow above the roofline of the residential structure on the property. Hearing no further comments or discussion, Mayor Pernell continued the public hearing to Monday, October 17, 2005 at 5:30 p.m. for the purpose of conducting a field review of the subject property. OLD BUSINESS None. NEW BUSINESS REQUEST FOR A TWO YEAR TIlVIE EXTENSION FOR A SITE PLAN REVIEW FOR GRADING AND CONSTRUCTION OF A NEW RESIDENCE TO REPLACE AN EXISTIl�IG RESIDENCE AND A VARIANCE TO EXCEED THE MAXIMUM PERMITTED DISTURBED NET LOT AREA IN ZONING CASE NO. 689 AT 12 SOUTHFIELD DRIVE, (LOT 35-SF) (PATEL). City Manager Nealis presented the staff report outlining the applicant's request for a two-year extension to Zoning Case No. 689. Hearing no discussion, Mayor Pernell called for a motion. Mayor Pro Tem Lay moved that the City Council adopt Resolution No. 997. Councilmember Black seconded the motiori,which carried unanimously. CONSIDERATION OF A CLAIM SUBMTTTED BY ALAN SHEEN, 1 POPPY TRAIL, ROLLING HILLS,CALIFORNIA. City Manager Nealis presented the recommendation from Carl Warren & Co. that the claim be rejected. Hearing no discussion, Mayor Pernell called for a motion. Mayor Pro Tem Lay moved that the City Council reject the claim. Councilmember Heinsheimer seconded the motion, which carried unanimously. OPEN AGENDA- APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME Ms. Nicole Vanderhurst, representing Clean Energy, provided information regarding natural gas vehicles. She indicated that a natural gas station was located nearby in Carson and highlighted that the prices of natural gas are less than regular gasoline. Lt. Greg Ahn, provided information regarding the Open House that will be held at Lomita Station on Saturday, October 15, 2005. MATTERS FROM MEMBERS OF THE CITY COUNCIL Mayor Pro Tem Lay thanked the City Council and staff for the plant provided to him on his birthday. Mayor Pernell commented on the luncheon meeting he and the City Manager attended earlier in the day with Congressman Dana Rohrabacher. He reported that the Congressman's office would be arranging a disaster preparedness event in the future. MATTERS FROM STAFF' STATUS REPORT RELATIlVG TO NUISANCE ABATEMENT AT 1 POPPY TRAIL. City Manager Nealis explained the actions that were required to be implemented by the owner of 1 Poppy Trail and indicated that to date, the property owner had not taken the required actions outlined in Resolution No. 996 adopted by the City Council on September 26, 2005. Minutes City Council Meeting 10/10/05 -2- MATTERS FROM THE CITY ATTORNEY CLOSED SESSION The City Council finds, based on advice from legal counsel, that discussion in open session will prejudice the position of the local agency in the litigation. Existing Litigation: G.C. 54956.9(a) Judith Hassoldt and William Hassoldt, Individuals, Plaintiffs, vs City of Rolling Hills, et. , al., Los Angeles County Superior Court, Case No. BC275012. No closed session was held relating to this matter. City Aftorney Jenkins reported that the City Council determined unanimously to add a closed session to the agenda on the subject of a matter of potential litigation under government Code Section 54956.9(c) pertaining to 1 case. Following the closed session, he reported that no action was taken in closed session. .
