10/24/2005 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA OCTOBER 24, 2005 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Pernell at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills,California. ROLL CALL Councilmembers Present: Black, Heinsheimer, Hill, Mayor Pro Tem Lay and Mayor Pernell. Councilmembers Absent: None. Others Present: Craig Nealis, City Manager. Mike Jenkins, City Attorney. Ewa Nikodem, Recording Secretary. Lt. Greg Ahn,LASD, Lomita Station. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Meeting of October 10, 2005. RECOMMENDATION: Approve as presented. b. Payment of Bills. RECOMMENDATION: Approve as presented. Councilmember Heinsheimer moved that the City Council approve the recommendations in the Consent Calendar. Councilmember Hill seconded the motion, which carried unanimously. SPECIAL PRESENTATION "PALOS VERDES PENIlVSULA SALUTE TO SERVICE" PRESENTATTON TO 2r1D LIEUTENANT ALLISON M. HILL, UNTTED STATES ARMY (PARENTS: MAUREEN AND FRANK HILL). Mayor Pernell presented 2nd Lieutenant Allison Hill with a Certificate of Appreciation and a gift basket of hometown memorabilia and also presented 2nd Lieutenant Allison Hill's parents, Maureen and Frank Hill with a Blue Star poster. Mayor Pernell indicated that 2nd Lieutenant Allison Hill has served as Platoon Leader in the Army's 29`k' Signal Battalion in Ft. Lewis, WA, and will be deployed to Iraq next month. Mayor Pernell indicated that 2°d Lieutenant Allison Hill grew up in Rolling Hills and attended Peninsula High School, where she was active in Varsity Basketball. Mayor Pernell described her achievements as a part-time employee at the Peninsula News and as a babysitter and noted her awards in high school, including the PVP Coordinating Council Service Award, the Assisteens Service Award and was a National Merit Finalist and the fact that as an ROTC Scholar, she attended Duke University, where she graduated in 2004 with a degree in Religion. Mr. Kelly Johnson, Palos.Verdes Peninsula High School Principal, presented 2"d Lieutenant Allison Hill with a Palos Verdes Peninsula High School Panther spirit bag and school spirit items. Palos Verdes Library Board of Trustees Member Mr. Robert Lee, commended 2nd Lieutenant Allison Hill. Mrs. Maureen Hill introduced those in attendance to honor 2°a Lieutenant Allison Hill including her grandmother, brothers, former school teachers and friends. Mayor Pernell called for a recess at 7:45 p.m. for a reception. The meeting reconvened at 7:58 � p.m. Minutes City Council Meeting 10/24/05 -1- PLANNING COMMISSION ITEMS RESOLUTTON NO. 2005-32. A RESOLUTTON OF Tf-iE PLANNING COMNIISSION OF THE CITY OF ROLLING HILLS GRANTIl�TG APPROVAL FOR A SITE PLAN REVIEW FOR GRADING AND CONSTRUCTION OF A PLAY AREA AND A RECREATTON ROOM, A CONDTITONAL USE PERNIlT TO CONSTRUCT THE RECREATTON ROOM AND A VARIANCE TO EXCEED TI� MA�QMUM PERNIITTED DISTURBED AREA OF THE LOT AT AN EXISTING SINGLE FAMILY RESIDENCE IN ZONIlVG CASE NO. 711, AT 2 OUTRIDER ROAD, (LOT 70-A-EF). (KIM). City Manager Nealis presented the staff report outlining the applicant's plan and providing background regarding the property and the Planning Commission action relative to Zoning Case No. 711. Councilmember Heinsheimer moved that the City Council receive and file Resolution No. 2005-32. Councilmember Hill seconded the motion. Mayor Pro Tem Lay expressed concern regarding the development and the Variance to exceed the maximum permitted disturbed area. Discussion ensued regarding the disturbed area. In response to Mayor Pro Tem Lay, Planning Director Schwartz indicated that the required future stable and corral are included in the proposed disturbed area. Following discussion regarding the amount of grading and the size of the retaining (planter) wall, Councilmember Heinsheimer withdrew his motion and Councilmember Hill withdrew his second. After brief discussion, Councilmembers took this item under jurisdiction and directed the City Manager to set a public hearing to consider this case at the next regular City Council meeting on Monday, November 14, 2005. RESOLUTION NO. 2005-33. A RESOLUTION OF TI� PLANNIlVG COMNIISSION OF TI� CITY OF ROLLING HILLS GRANTIl�TG APPROVAL FOR A VARIANCE TO CONSTRUCT AN INFINITY SV'VIMNIING POOL, A PORTION OF WHICH WOULD ENCROACH INTO T�-� FRONT SETBACK AT AN EXISTIl�IG SINGLE FAMILY RESIDENCE IN ZOI�TING CASE NO. 714, AT 7 QUAIL RIDGE ROAD NORTH (LOT 108-RH), (CHILLINGWORTH). City Manager Nealis presented the staff report outlining the applicant's request and providing background regarding the property and the Planning Commission action relative to Zoning Case No. 714. Mayor Pro Tem Lay moved that the City Council receive and file Resolution No. 2005-33. Councilmember Heinsheimer seconded the motion,which carried unanimously. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS-CONTINUED ZONIlVG CASE NO. 708 MR. AND MRS. PHILIl' CHO, 25 PORTUGUESE BEND ROAD, (LOT 89-A-RH). STTE PLAN REVIEW FOR GRADING AND CONSTRUCTION OF AN ADDITION TO AN EXISTIl�TG SINGLE FAMILY RESIDENCE, A SPORTS COURT AND A GUEST HOUSE; CONDITIONAL USE PERNIITS TO CONSTRUCT A SPORTS COURT AND A GUEST HOUSE AND A VARIANCE TO LOCATE THE SPORTS COURT IN THE FRONT YARD AREA AT AN EXISTIl�TG SINGLE FAMILY RESIDENCE. Mayor Pernell reported that the field trip to this property scheduled for 6:30 p.m. this evening was not held and continued the public hearing to the next City Council meeting. A field trip was tentatively scheduled for Thursday, November 17, 2005 at 8:00 a.m. OLD BUSINESS None. NEW BUSINESS CONSIDERATION OF RESPONSE FROM TI� CITY OF ROLLING HILLS ESTATES REGARDING CROSSING GUARD SERVICES AT THE INTERSECTTON OF PALOS VERDES DRIVE NORTH,PORTUGUESE BEND ROAD AND ROLLING HILLS ROAD. Minutes � City Council Meeting 10/24/05 -2- City Manager Nealis presented the staff report providing background regarding this subject including the findings in the pedestrian crossing activity study conducted last year and information provided in the recent correspondence submitted by the City of Rolling Hills Estates. He stated that based on the last year's study and the reported lower number of students from Rolling Hills attending Dapplegray School this year, that Rolling Hills Estates does not feel the data supports the introduction of crossing guard services at the subject intersection,however, they would be willing to consider establishing crossing guard services if the City of Rolling Hills would fund the services. City Manager Nealis reported that Rolling Hills Estates has projected that crossing guard services would cost $7,800 for an entire school year, excluding the summer session, for 3 hours of service per day (90 minutes in the morning and 90 minutes after school). He further reported that the contractor that provides this service requires a 3 hour minimum each day and that Rolling Hills Estates recommends that this service should be provided in the morning and afternoon if it is introduced. He further reported that Rolling Hills Estates would want to present this idea to their Traffic Commission if Rolling Hills desires to move forward with this idea. Councilmember Black reported that these services are only needed in the afternoon and that crossing activity has increased this school year. In response to Councilmember Black and following discussion, City�Manager Nealis indicated that he would continue to discuss this idea with Rolling Hills Estates to determine if services can be implemented in the afternoon only and report back to the City Council. Councilmember Black indicated that he would contact some Rolling Hills residents to survey crossing activity. OPEN AGENDA-APPROXIMATELY 8:00 P.M.- PUBLIC COMMENT WELCOME None. MATTERS FROM MEMBERS OF THE CITY COUNCIL Councilmember Black queried if extended work hours for the RHCA Poppy Trail Road project were being implemented. City Manager Nealis explained the previous action of the City Council to allow the RHCA to establish extended work hours for their project as requested, and commented that the grader reported to him that there were some difficulties in coordinating the activities of two shifts for this project, but that the grader felt that good progress was being made. City Manager Nealis commented that the grading currently being done is under the RHCA contract. Councilmember Black indicated that he may contact the RHCA. 1Vlayor Pernell reported that the Sanitation District started a new program. for students called "Sewer Science Program". MATTERS FROM STAFF STATUS REPORT RELATIlVG TO NUISANCE ABATEMENT AT 1 POPPY TRAIL. City Manager Nealis reported that he had no new evidence that the owner of #1 Poppy Trail had taken any of the actions outlined in Resolution No. 996 adopted by the City Council on September 26, 2005. City Manager Nealis reported that Caballeros was going to host a 25-year membership celebration in the City Council Chambers in November. City Manager Nealis reported that following the report from the West Vector Control District that a tick positive with Lyme Disease was found in the Purple Canyon, Mrs. McDonald, 30 Caballeros Road, was reportedly bit by a tick over the weekend in that area and that she was being treated by her physician who may elect to send the tick to a lab for testing. In response to Mayor Pernell, City Manager Nealis indicated that Caballeros and RHCA were notified immediately after the information was presented to the City from the District and the trails have been posted per the instructions from the District. In response to Councilmember Black, City Manager Nealis explained that the person believed to be responsible for the recent thefts in the City was arrested. Minutes City Council Meeting 10/24/05 -3- MATTERS FROM THE CITY ATTORNEY CLOSED SESSION The City Council finds, based on advice from legal counsel, that discussion in open session will prejudice the position of the local agency in the litigation. Existing Litigation: G.C. 54956.9(a) judith Hassoldt and William Hassoldt, Individuals, Plaintiffs, vs City of Rolling Hills, et. al., Los Angeles County Superior Court, Case No. BC275012. No closed session was held relating to this matter. ADJOURNMENT Hearing no further business before the City Council, Mayor Pernell adjourned the meeting at 8:30 p.m. to a regular meeting of the City Council scheduled to be held on Monday, November 14, 2005,beginning at 7:30 p.m. in the City Council Chambers at City hall, 2 Portuguese Bend Road, Rolling Hills,CA.
