11/14/20051 1 1 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA NOVEMBER 14, 2005 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Pernell at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. . ROLL CALL Councilmembers Present: Black, Heinsheimer, Hill, Mayor Pro Tem Lay and Mayor Pernell. Councilmembers Absent: None. Others Present: Craig Nealis, City Manager. Mike Jenkins, City Attorney. Nan Huang, Finance Director. Yolanta Schwartz, Planning Director. Marilyn Kern, Deputy City Clerk. Lt. Greg Ahn, LASD, Lomita Station. Lt. Jason Lum, LASD, Lomita Station. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Regular Meeting of October 24, 2005. RECOMMENDATION: Approve as presented. b:- - Payment of Bills. RECOMMENDATION: Approve as presented. C. Financial Statement for the month of September, 2005. RECOMMENDATION: Approve as presented. d. BFI Tonnage Report for September, 2005. RECOMMENDATION: Receive and file. e. Request from Tennis Club for minor improvements area. RECOMMENDATION: Approve as presented. f. Approval of work authorization for property line Utility Project bid preparation. RECOMMENDATION: Approve as presented. to the tennis court picnic staking for Underground Councilmember Heinsheimer moved that the City Council approve the recommendations in the Consent Calendar. Councilmember Hill seconded the motion, which carried unanimously. PLANNING COMMISSION ITEMS None. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS ZONING CASE NO. 711 MR. & MRS. SAMIL KIM, 2 OUTRIDER ROAD (LOT 70 -A -EF). REQUEST FOR A SITE PLAN REVIEW FOR GRADING AND CONSTRUCTION OF A PLAY AREA AND A RECREATION ROOM, A CONDITIONAL USE PERMIT TO CONSTRUCT THE RECREATION ROOM AND A VARIANCE TO EXCEED THE MAXIMUM PERMITTED DISTURBED AREA OF THE LOT AT AN EXISTING SINGLE FAMILY RESIDENCE. City Manager Nealis presented the staff report outlining the applicants' request and providing background regarding the property. He indicated that the City Council took this item under Minutes City Council Meeting 11/14/05 -1- jurisdiction at their meeting on October 24, 2005. Mayor Pro Tem Lay stated that he asked that this Zoning Case be taken under jurisdiction and indicated that he had reviewed the case and Municipal Code sections and that he would like to withdraw his objection, close the public hearing and uphold the Planning Commission's decision. City Attorney Jenkins outlined the procedure for the City Council to uphold the Planning Commission's decision in this case. Mayor Pernell opened the public hearing and called for testimony. Hearing none, he closed the public hearing. Councilmember Heinsheimer moved that the City Council direct staff to prepare a resolution upholding the Planning Commission's decision relative to Zoning Case No. 711. Councilmember Hill seconded the motion, which carried unanimously. ZONING CASE NO. 708 MR. AND MRS. PHILIP CHO, 25 PORTUGUESE BEND ROAD, (LOT 89-A-RH). SITE PLAN REVIEW FOR GRADING AND CONSTRUCTION OF AN ADDITION TO AN EXISTING SINGLE FAMILY RESIDENCE, A SPORTS COURT AND A GUEST HOUSE; CONDITIONAL USE PERMITS TO CONSTRUCT A SPORTS COURT AND A GUEST HOUSE AND A VARIANCE TO LOCATE THE SPORTS COURT IN THE FRONT YARD AREA AT AN EXISTING SINGLE FAMILY RESIDENCE. City Manager Nealis presented the staff report outlining the applicants' request and providing background regarding the property. He indicated that the City Council had tentatively set this case for a field review on Thursday, November 17, 2005 and that this case is being presented this evening in the event that the City Council needs to select another date for the field review. Mayor Pennell opened the continued public hearing and called for testimony. Hearing none, after discussion regarding a date for the field review, the public hearing was continued to an adjourned regular meeting of the City Council scheduled to be held on Monday, November 28, 2005 beginning at 8:00 a.m. at 25 Portuguese Bend Road for the purpose of conducting a field review. OLD BUSINESS None. NEW BUSINESS CONSIDERATION OF AWARD OF BID FOR TRIMMING OF TREES ON THE WEST AND SOUTH SIDES OF TENNIS COURT NUMBER ONE AND WEST SIDE OF TENNIS COURT NUMBER THREE AND TREES ON THE CITY HALL CAMPUS AREA. City Manager Nealis presented the staff report providing background regarding the tree trimming project and the bids received indicating that Traver's Tree Service was the low bidder. Councilmember Hill moved that the City Council award the bid for trimming of trees at the tennis courts and city hall campus area to Travers Tree Service in an amount not exceed $6,780.00. Councilmember Heinsheimer seconded the motion, which carried unanimously. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME Lieutenant Greg Ahn introduced the new Lomita Station Operations Lieutenant Jason Lum. Lieutenant Lum provided background regarding his qualifications and tenure at Lomita Station. Councilmembers welcomed Lieutenant Lum and wished him well in his new position at Lomita Station. Mayor Pernell called upon students attending the meeting. Eric and Andrew Wallace, 11 Eastfield Drive, introduced themselves and indicated that they were working on a citizenship merit badge for the Boy Scouts. MATTERS FROM MEMBERS OF THE CITY COUNCIL Councilmember Black reported that residents would be conducting a survey of children crossing the intersection of Portuguese Bend/Rolling Hills Roads and Palos Verdes Drive North during the morning and afternoon hours. Councilmember Hill commented on his attendance at the memorial reception for long time resident Lew Hankins. Minutes City Council Meeting 11/14/05 -2- 1 Mayor Pro Tem Lay indicated that he may not be in attendance at the November 28, 2005 field trip and that he would visit the property at 25 Portuguese Bend at another time. Mayor Pernell and Mayor Pro Tem Lay reported on their attendance that the recent Palos Verdes Peninsula Regional Law Enforcement Committee meeting. Mayor Pernell commented on a letter received from the Ghormley family offering their parents' property to the City at a discounted rate for a community center. Councilmembers discussed the offer and concurred that there would be challenges to purchase, improve and maintain the property for the purposes described in the letter from Mr. Ghormley. Councilmembers acknowledged that this item would be discussed by the Rolling Hills Community Association -at their next meeting and indicated that they would be willing to discuss the matter further. with the Association if the Association determines that they would like to pursue this matter further. Following discussion, staff was directed to prepare a letter thanking the Ghormley family for their offer and a memo to the Association that the City would be prepared to further discuss this concept if the Community Association expresses a desire to move forward. MATTERS FROM STAFF None. MATTERS FROM THE CITY ATTORNEY At 7:55 p.m. the City Council recessed into closed session. CLOSED SESSION The City Council finds, based on advice from legal counsel, that discussion in open session will prejudice the position of the local agency in the litigation. At 9:25 p.m. the City Council returned to open session. City Attorney Jenkins reported that the Council discussed the items listed on the closed session agenda and that no reportable action was taken in closed session. ADIOURNMENT Hearing no further business before the City Council, Mayor Pernell adjourned the meeting at 9:25 p.m. in memory of long time Rolling Hills resident Lew Hankins to an adjourned regular meeting of the City Council on Monday, November 28, 2005, beginning at 8:00 a.m. at 25 Portuguese Bend Road, Rolling Hills, California.
