11/10/20081 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA MONDAY, NOVEMBER 10, 2008 CALL TO ORDER A regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Hill at 7:35 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL Councilmembers Present: Black, Mayor Pro Tem Heinsheimer and Mayor Hill. Councilmembers Absent: Pernell and Lay (excused). Others Present: Anton Dahlerbruch, City Manager. Mike Jenkins, City Attorney. Yolanta Schwartz, Planning Director. Marilyn Kern, Deputy City Clerk. Lt. Greg Alm, LASD, Lomita Station. CONSENT CALENDAR Matters which may be acted upon by the City Council in a single motion. Any Councilmember may request removal of any item from the Consent Calendar causing it to be considered under Council Actions. a. Minutes - Regular Meeting of October 27, 2008. RECOMMENDATION: Approve as presented. b.. Payment of Bills RECOMMENDATION: Approve as presented. C. Consideration of a resolution of the City Council of the City of Rolling Hills declaring the City's support for an energy partnership between Southern California Edison and the South Bay Cities Council of Governments. RECOMMENDATION: Approve as presented. Mayor Pro Tem Heinsheimer moved that the City Council approve the items on the Consent Calendar. Councilmember Black seconded the motion. The City Attorney explained that the latest invoice from his firm reflects costs associated with litigation currently being pursued by the owner of 1 Poppy Trail. Following the explanation, the motion carried unanimously by those Councilmembers in attendance.. PLANNING COMMISSION ITEMS RESOLUTION 2008-17. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING A MINOR VARIANCE TO PERMIT CONSTRUCTION OF AN ADDITION, A PORTION OF WHICH WOULD ENCROACH INTO THE SIDE YARD SETBACK AT AN EXISTING SINGLE FAMILY RESIDENCE IN ZONING CASE NO. 761, AT 12 EASTFIELD DRIVE, (LOT 65 -A -EF) ROLLING HILLS, CA., (ITOH). Planning Director Schwartz presented the staff report outlining the applicant's request and providing background regarding the property and the Planning Commission's action relative to Zoning Case No. 761. Hearing no discussion Mayor Hill called for a motion. Mayor Pro Tem Heinsheimer moved that the City Council receive and file Resolution No. 2008-17. Councilmember Black seconded the motion which carried unanimously by those Councilmembers in attendance. RESOLUTION NO. 2008-18. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING A SITE PLAN REVIEW TO DEMOLISH AND REBUILT A LARGE PORTION OF AN EXISTING RESIDENCE AND TO CONSTRUCT AN ADDITION THERETO AND REQUEST FOR A VARIANCE FOR PREVIOUSLY GRADED AREAS THAT EXCEED THE MAXIMUM PERMITTED DISTURBED AREA OF THE NET LOT AT A SINGLE FAMILY RESIDENCE AT 8 MAVERICK LANE, (LOT 26 -A- SK), ROLLING HILLS, CA., (KARPF). Minutes City Council Meeting 11/10/08 -1- Planning Director Schwartz presented the staff report outlining the applicant's request and providing background regarding the property and the Planning Commission's action relative to the proposed development. Following brief discussion regarding grading that occurred in 1999 which was outside the scope of the approval and what recourse the City would have should the project not be approved, Mayor Hill called for a motion. Mayor Pro Tem Heinsheimer moved that the City Council receive and file Resolution No. 2008-18. Councilmember Black seconded the motion which carried unanimously by those Councilmembers in attendance. TRAFFIC COMMISSION ITEMS None. PUBLIC HEARINGS None. OLD BUSINESS None. NEW BUSINESS None. OPEN AGENDA - APPROXIMATELY 8:00 P.M. - PUBLIC COMMENT WELCOME Mr. Richard Colyear, 35 Crest Road West, expressed concern regarding noise, traffic safety and light pollution related to a proposed project at St. John Fisher Church in Rancho Palos Verdes. He stated that he feels that there is an inadequate number of parking spaces compared to the number of people that will be visiting the church on any given day causing traffic congestion on Crest Road West in the vicinity of the Crest Road Gate entrance to Rolling Hills. He also said that the number of vehicles might impede emergency vehicles passage into Rolling Hills or other neighboring areas. Mr. Colyear indicated that he feels that Rolling Hills residents who reside in the area of the proposed project would hear the proposed bells. He also stated that he feels that the lighted cross proposed would be contrary to the ambiance that the City's lighting ordinance provides. Mr. and Mrs. Roger Hawkins, 37 Crest Road West, expressed concern regarding noise, traffic safety and light pollution related to a proposed project at St. John Fisher Church in Rancho Palos Verdes. Mr. Hawkins stated that he feels that the bell tower may affect migratory birds. Mrs. Hawkins indicated that she hears noise emanating from the site as it is now and that the bells would only add to this noise. She also expressed concern about the noticing that was provided for the proposed project. Dr. Richard Krauthamer, 41 Crest Road West, expressed concern regarding noise, traffic safety and light pollution related to a proposed project at St. John Fisher Church in Rancho Palos Verdes. Dr. Krauthamer explained traffic encounters he has experienced when leaving the City related to the site. Ms. Cathy Nichols, 14 Crest Road West, expressed concern regarding noise, traffic safety and light pollution related to a proposed project at St. John Fisher Church in Rancho Palos Verdes. She also expressed concern about the noticing that was provided and the silhouette erected for the proposed proj ect. Mr. Spencer Karpf, 14 Caballeros Road, expressed concern regarding noise, traffic safety and light pollution related to a proposed project at St. John Fisher Church in Rancho Palos Verdes. He encouraged the City Council to agendize this matter for discussion at their next meeting. Following brief discussion regarding the City's options related to this matter, the City Council considered asking staff to send a letter to Rancho Palos Verdes to convey the resident's concerns. Without unanimous support for such a letter, staff was directed to agendize this topic for consideration by the City Council at their next regular meeting.
