CALL MEETING TO ORDER
A meeting of the City Council was called to order at 4:00 p.m. by Mayor Heinsheimer on Thursday, July
30, 2009, at 3 Quailridge Road South, Rolling Hills, California.
ROLL CALL
Council Members Present: Lay, Pernell, Black and Mayor Heinsheimer.
Council Members Absent: Frank Hill, excused, due to location of sites in proximity to his
property.

VIEW IMPAIRMENT APPEAL OF A DECISION OF THE COMMITTEE ON TREES
AND VIEWS IN A VIEW IMPAIRMENT CASE FILED BY DR. AND MRS. BELLIS,
3 QUAIL RIDGE ROAD SOUTH, AND DR. AND MRS. WITTE, 5 QUAIL RIDGE
ROAD SOUTH, AGAINST TREES LOCATED ON PROPERTY OWNED BY MR.
AND MRS. PRICE SHOEMAKER, 7 QUAIL RIDGE ROAD SOUTH. THE APPEAL
WAS FILED BY MR. AND MRS. SHOEMAKER.
The City Council members started out at 3 Quailridge Road South in a southwest patio adjacent to the
main residence. Planning Director Schwartz provided a brief summary of the preceding meeting and the
nature of the appeal. Mayor Heinsheimer reiterated the major points of disagreement. Council members
reviewed the pictures in relationship to the Shoemakers property. Dr. Witte provided a spreadsheet for
Council's consideration in which the Wittes and Bellises summarize the corrective actions based on the
Resolution adopted by the Committee on Trees and Views and their suggestions for minor changes, and
an aerial photograph of the three properties showing the trees under consideration. Mrs. Shoemaker
stated that she would like the trees to remain on the property for shade and privacy.
The Council members then visited 5 Quail Ridge Road South, Dr. and Mrs. Witte property.
Council members viewed the view from the patio outside the main residence.
Planning Director Schwartz and Mrs.. Witte pointed out the trees on the list that the Wittes would like to
have removed or trimmed. Mrs. Witte pointed out to the Council members the partial blockage of the
view of the canyon and the trail to the north east of the shoreline. She stated that the Palm Tree and the
leaning Pine are starting to block the view, but that she could live with the palm tree but would like to
have the leaning Pine removed.
The Council members then visited 7 Quail Ridge Road South, Mr. and Mrs. Shoemaker property.
Members of the City Council viewed the trees on the Shoemakers property from the rear patio. Mrs.
Shoemaker showed the Council members the pictures taken when they moved in 2000 and stated that
the property was overgrown by trees and shrubs and that the Bellises and Wittes did not have a view.
She stated that many of the trees and the hedge have not been trimmed this year, pending the resolution
of the dispute. Mrs. Shoemaker further stated that the trees, especially tree #1 and #2 provide shade and
privacy and that the rest of the trees are a valued asset to their property and look very nice.
The Council members then observed the trees on the side of the property as well as near the trash bin
that is also subject of this complaint as well as row of oleander shrubs with saplings of other species of
trees, which Mr. Shoemaker said will be trimmed.

Hearing no further business before the City Council, Mayor Heinsheimer adjourned the meeting at 5:00
p.m. to a regular meeting of the City Council scheduled on Monday, August 24, 2009 beginning at 7:30
p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
