' 'H,.0 _ MINUTES OF AN ADJOURNED REGULAR MEETING ; OF THE.. �, CITY COUNCII; OF THE CITY OF ROLLING HILLS; CALIFORNIA MONDAY, OCTOBER 4, 2010 CALL TO ORDER An adjourned regular meeting of the City Council of the City of Rolling Hills was called to order by Mayor Pernell at 7:30 p.m. in the City Council Chambers at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. ROLL CALL � Councilmembers Present: Heinsheimer, Hill, Mayor Pro Tem Lay and Mayor Pernell. Councilmembers Absent: Black. Others Present: Anton Dahlerbruch, City Manager. Elizabeth Calciano, Assistant City Attorney. Yolanta Schwartz,Planning Director. Heidi Luce,Deputy City Clerk. , CONSENT CALENDAR None. COMMISSION ITEMS None. CONTINUED PUBLIC HEARINGS ORDINANCE NO. 320 - AN ORDINANCE OF THE CITY OF ROLLING HILLS APPROVING A ZONING MAP AMENDMENT TO CHANGE ZONING CLASSIFICATION OF A PORTION OF A LOT HAVING AN APN NO. 7567-001-901 FROM R.AS-1 TO RAS-2 ZONING CLASSIFICATION, IN ZONING CASE NO. 790, ZONING MAP AMENDMENT NO. 2010-01. (SECOND READING AND ADOPTIOI� Mayor Pernell opened the continued public hearing and asked staff to provide the introductory remarks. City Manager Dahlerbruch stated that before the City Council this evening are two continued public hearings. He stated that regarding Item SA, it is recommended that the City Council take public testimony, waive full reading of the ordinance and adopt Ordinance No. 320 pertaining to a Zoning Map amendment in Zoning Case No. 790. He then stated regarding item SB, it is recommended that the City Council take public testimony and adopt Resolution No. 1095 granting approval of a Tentative Parcel Map in Zoning Case No. 789 and adopting a Mitigated Negative Declaration. City Manager Dahlerbruch then provided an overview of the responses to the three items raised at the previous meeting pertaining to noise and dust, electrical undergrounding on Chuckwagon and water run off. He noted that there is a typographical error in the first sentence of the Ordinance and stated that it should be corrected to read as follows, "The City Council of the City of Rolling Hills does hereby ordain as follows." Lastly he stated, as referenced in the previous public hearing, the California Joint Powers Insurance Authority and Mr. Norm LaCaze are in discussions to come to an agreement pertaining to Mr. LaCaze's concerns and although an agreement has not yet been signed, Mr. Ed Richards, attorney for the CJPIA has indicated that a conceptual agreement has been discussed and they are working out the language. Following City Manager Dahlerbruch's comments, Mayor Pernell called for public testimony. Mr. Stanley Lamport addressed the City Council on behalf of Mr. Norm LaCaze, 24 Portuguese Bend Road stating that they are in conceptual agreement with the CJPIA and are finalizing the language, but Minutes—Adjourned Regular City Council Meeting ]0/04/]0 -1- that there is no agreement until everyone signs. He stated that if they do enter an agreement, his client's opposition and concerns about the project would cease. He further stated that his client still has concerns regarding the Mitigated Negative Declaration specifically related to Noise Measure 6 and that they are continuing in their position until they have a final agreement. John Lacy, 7 Poppy Trail addressed the City Council to express his support of the project. Hearing no further testimony, Mayor Pernell closed the Public Hearing on Ordnance No. 320 and called for a motion. Councilmember Heinsheimer moved that the City Council waive full reading and adopt Ordinance No. 320 pertaining to a Zone Map amendment. Mayor Pro Tem Lay seconded the motion which carried by the following roll call vote: AYES: Councilmembers Heinsheimer, Hill, Mayor Pro Tem Lay and Mayor Pernell. NOES: None. ABSENT: Councilmember Black. ABSTAIN: None. ZONING CASE NO. 789. SUBDIVISION NO. 92, TENTATIVE PARCEL MAP NO. 71374. Request to subdivide the lot resulting from the lot line adjustments in Zoning Case No. 788, into two parcels: a. Parcel 1 — 4.09 acres gross and 2.68 acres net (as calculated for development purposes pursuant to the Rolling Hills Municipal Code); b. Parcel 2 — 6.08 acres gross and 4.76 acres net (as calculated for development purposes pursuant to the Rolling Hills Municipal Code). Modifications requested with the Tentative Parcel Map: a. the requirement of a 60-foot roadway easement (proposed 45-55 feet) b. designate the rear setbacks on both parcels to be parallel to the southerly property lines c. to allow steeper than permitted road(max. 18.4%) d. to allow steeper than permitted driveways (max. 16%) e. to grade and create building pads prior to issuance of construction permits. Variance requested with the Tentative Parcel Map: a. to set aside an area for a future stable and corral in the front yard on Parcel 1 b. to exceed the maximum permitted disturbance on each lot and, Consideration of adoption of a Mitigated Negative Declaration. Consideration of Resolution No. 1095: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS GRANTING APPROVAL OF A TENTATIVE PARCEL MAP NO. 71374, SUBDIVISION NO. 92, A REQUEST TO SUBDNIDE A 10.16 ACRE LOT INTO TWO SINGLE FAMILY RESIDENTIAL LOTS, BOTH FRONTING ON POPPY TRAIL ROAD, AND GRANTING APPROVAL OF VARIANCES TO LOCATE AN AREA FOR A FUTURE STABLE AND CORRAL IN THE FRONT YARD ON PARCEL 1 AND TO EXCEED THE MAXIMUM PERMITTED DISTURBANCE OF THE LOTS, IN ZONING CASE NO. 789, AND ADOPTING A MITIGATED NEGATIVE DECLARATION, (CJPIA). Mayor Pernell called for public testimony pertaining to Zoning Case No. 789. Mr. Lamport stated that his comments from the previous item pertain to this items as well. Hearing no further public comment, Mayor Pernell closed the public hearing and called for a motion. Councilmember Heinsheimer moved that the City Council adopt Resolution No. 1095 granting approval of a Tentative Parcel Map in Zoning Case No. 789 and adopting a Mitigated Negative Declaration. Councilmember Hill seconded the motion which carried by the following roll call vote: AYES: Councilmembers Heinsheimer, Hill, Mayor Pro Tem Lay and Mayor Pernell. NOES: None.
