00110 RESOLUTION NO. 11 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, AUTHORIZING EXECUTION OF AN AGREE- MENT WITH THE COUNTY OF LOS ANGELES PROVIDING FOR THE ENFORCEMENT OF THE BUILDING CODE, PLUMBING CODE AND ELECTRICAL CODE OF THE CITY OF ROLLING HILLS. WHEREAS, the City Council of the City of Rolling Hills has adopted ordinances setting forth a building code, a plumbing code and an electrical code for said City; and WHEREAS, the City Council of the City. of Rolling Hills desires to agree with the County of Los Angeles for the enforcement of said codes by said County; and NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk of the City of Rolling Hills, be and they hereby are authorized, empowered and directed, for and on behalf of the City of Rolling Hills, to enter into an agreement in the form submitted to this Council for the enforcement by the County of Los Angeles, through its Division of Building and Safety of the Department of County Engineers, of the building code, plumbing code and electrical code of the City of Rolling Hills; THAT the Mayor shall sign this resolution and the City Clerk shall attest and certify to the passage and adoption thereof and that there shall be attached to the permanent file copy of this resolution a copy- of the form of agreement above referred to. The City Clerk is directed to forward a certified copy -of this resolution to the Clerk of the Board of Supervisors. PASSED, APPROVED AND ADOPTED THIS 24th day of Januar-5 195? • Nlayor of the City 6f Ttoi ing gills ATTEST: Cit7.Cler APPROVED AS TO FORM: l C ty Attorney 1 6 AGREEMENT --BUILDING SERVICES The City of Rolling Hills, a municipal dorporation, hereinafter called City, and the COUNTY OF LOS ANGELES, a body politic and corporate, to -wit; a political sub- division of the State of California, hereinafter called County, pursuant to a resolution dated January 24th of­rthe City and an order dated January 24th of the County wherein the Mayor and the Chairman of the Board of Supervisors; respectively, of City and County Wier:e• authorized to sign and execute this agreement between said City and County, do consent and agree: 1. Inconsideration of payment by City.to.County of the sum hereinafter prescribed and, under authority l of Section 51,301 of the Government Code, and of Section 562 of the Charter of the County of Los Angeles, County agrees thru'its Division of Building and Safety.of the Department of County Engineer, to perform, within the City, all func- tions performed by said Division in the unincorporated territory of the County, which are applicable to the City. County thru its Division of Building and Safety, may do additional work related to inspection of construction, when requested by City and when fees specified therefor are adequate to cover the cost of such additional work. County agrees to enforce within th& City.all the provisions of the Building Code, Plumbing Code and Electrical. Code of said City and to make all. inspections and to issue all permits and orders required in such enforcement. Such enforcement shall include all of the duties prescribed in such ordinances including the determination of those matters placed within the jurisdiction of the Board of Appeals by such ordinances and the furnishing of the evidence necessary in any prosecution under such ordinances. In performing . such work the officers of the County assigned thereto shall have the powers and duties of Building Inspectors of the City. 2. City agrees to furnish and prepare all maps and ordinances required and to furnish necessary quarters, utilities, and janitor service. It is agreed that County may use the quarters furnished in.the administration of the functions of the County`Division of -Building and Safety without charge being made therefor by the City so long as such additional use does not increase the cost to the City therefor. 3. County, agrees to collect the fees called for in said ordinances and to account therefor to the City quarter- ly. County agrees to deposit all fees collected in a separate County Trust Fund for City. County agrees to pay City, within 30 days following each calendar quarter, all of the excess over expenditures for services and City agrees to pay County within said 30 days, and deficit be- tween expenditures for services and total fees collected. Expenditures for services, for the purpose of this agree- ment, shall be the number of hours of inspection and plan check services performed for the City at a rate of $4.85 per;,_hour. 4. -It is further agreed that no employee now employed by the City shall be. taken over by the County. and that there are no municipal pension rights of any employee of the City to be assumed ti$ the County. 5. Ostly, County Clerk By and ex officio Clerk of the Chairman, Board, of Board of Supervisors Supervisdrs By 1 This contract shall be sooner terminated at any time that City fails to enact and to maintain in full force and effect a Building Code, a Plumbing Code, and an Electrical Code in all material respects, in- cluding the amount.of fees provided, identical with the corresponding Codes now in force in the County, and in addition thereto to adopt an ordinance estab- lishing standards for electricians and plumbers plying their trades within said City equal to the standards prescribed by ordinance for electricians or plumbers within the County or to accept as evidence. -of qualifi- cation the Countyts Certificate thereof. This contract shall also be sooner terminated if City does not enact amendments to said Codes or ordin- ances, adopted by the Board of Supervisors, within 120 days after requested to do so by the County. The Divi- slon of Building and Safety, acting in behalf of the County, may use discretion and need not request City to adopt amendments which do not apply to the City: This contract shall become effective.
