0040RESOLUTION 140. 40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY RE- QUIRE THE CONSTRUCTION OF CERTAIN PUBLIC IMPROVE- MENTS FOR PUBLIC USE AS SET FORTH HEREIN, AND THAT THE FEE SIMPLE TITLE, IN AND TO ALL THE REAL PROPERTY HEREIN DESCRIBED, IS NECESSARY THEREFOR; AUTHORIZING, EMPOWERING AND REQUESTING THE CITY ATTORNEY TO INSTITUTE EMINENT DOMAIN, PROCEEDINGSNECESSARY TO ACQUIRE SAID PROPERTY. The City Council of the City of Rolling Hills resolves as follows: Section 1. The City Council of the City of Rolling Hills hereby finds and determines that: - `(a) the public interest, convenience and necessity require the acquisition, construction and completion, by the City of Rolling Hills, of certain public improve- ments for public use within the City of Rolling Hills, California, namely: The acquisition, construction, operation and main- tenance of a public park and playground. (b) The acquisition of the fee simple title in and to all that real property situated.in the City of Rolling Hills, County of Los Angeles, State of Califor- nia, and described as follows i,s nece-ssary for said public improvements for public use. That portion of Lot H of Rancho Los Palos Verdes, in the County of Los Angeles, State of California, alloted to Jotham Bixby by Decree of Partition in Case No. 2373 of the District Court of the 17th Judicial District and entered in Book 4, Page 57 of Judgments, in the Superior Court of said County, bounded by the following . described lines: Beginning at the most southerly corner of Lot 67 of Rolling Hills, as shown on map recorded in Book 201, Page -29 et-seq., of Maps, records of said County; thence along the southwesterly line of said Lot 67, North 450 27410" West 251.44 feet to an angle point therein; thence along said southwesterly line, North 570 30110" West 217.89 feet,to the most northerly corner of the land described in deed to Jack V. Evans and wife, recorded in Book 168629 Page 119, Official Records of. said County; thence along the exterior boundaries of said last mentioned land, south 20'43400T1 East 115.54 feet; South 27° 28450" East 152.98 feet; South 380 16440" West .97,13 feet; North 720 33"00" West 237-07 feet and North -120 22430" West 88.12 feet to the southeasterly boundary of.Lot 73 of said Rolling Hills; thence along said southeasterly boundary, South 340 5543011 West 63.99 feet to an ang.l,o point therein; thence along said southeasterly boundary South 630 43420" West 263.33 feet to an angle point therein; thence along said 1 1 southeasterly boundary, South 690031 « 40West 350.80 feet to the easterly boundary of Lot 89 of said Rolling Hills; thence along the easterly boundary of Lots,- 89 and 90 of said Rolling Hills, South 4000100" West 423.68 feet; thence leaving said easterlg boundary, South 70 49155" gest 542.28 feet to a 2 inch iron pipe; thence North 410 05100" East 650.00 feet; thence North 230 35100" East 217.00 feet; thence North 580 00100" East 420.00 feet; thence South 760 W51" East 287.00 feet; thence North 390 3310011 East 230.09 feet to a point which bears South 360 32157" East 163.44 feet from the point of beginning; thence North 360 32157" West 163.44 feet to the point of beginning. SUBJECT to easements and rights of way of record. (c) The said proposed public improvements for public use are planned and located in a manner which will be most compatible with the greatest public good and the least private injury. Section 2. The City Attorney of the City of Rolling Hills is hereby authorized and requested to bring an action in the name of the City of Rolling Hills in the Superior Court of the State of California, for the purpose of .acquiring by eminent domain the fee. simple title in and to the hereinabove described real property for said public improvements for public use as required by law, and to take all action necessary to complete the acquisition of such title in the name of the City of Rolling Hills, a municipal corporation, provided, however, that the City Council may, by motion duly adopted authorize the taking of the said fee simple title in and to all or portions of said property subject to taxes, easements, conditions, reservations, restrictions, defects, easements, rights of way, liens 'and encumbrances of whatsoever nature, or any thereof.
