A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROLLING HILLS, CALIFORNIA,
OPPOSING PASSAGE OF ASSEMBLY BILL NO. 127
BY THE CALIFORNIA LEGISLATURE.
WHEREAS, the City Council of the City of Rolling
Hills is advised that Assembly Committee on Governmental
Efficiency and Economy will hold hearings on Assembly Bill
No. 127 (Assemblyman Luckel, et al); and
WHEREAS, the City Council of the City of Rolling
Hills has-been informed that this Bill.¢roposes to amend
Sections 54950 to 54958 inclusive ...o,f. "the ---G'ove'rnment =Code
of the State of California, which sections collectively
are commonly referred to as the "Brown Act"3 so as to require
that all meetings of 'local representative bodies must be
open to the, public everf'if such meetings are held solely for
the purpd9'e bf discu9siori'�and_,:study and no action -is intended
to betaken at such meetings; and
WHEREAS, the,City Council of the City of Rolling
Hills has also been.inrformed that said proposed Bill would
also require that meetings of local representative bodies
with their legal counsel to secure advice or discuss pending
or anticipated litigation involving the city must be open
to the public; and

WHEREAS, the City Council of the City of Rolling"
Hills is also informed that said Bill will provide that any
member of a municipal legislative body who attends a meeting
of that body held in violation of said proposed Bill, would
be guilty of a misdemeanor; and
WHEREAS, the City Council of the City of Rolling
Hills, after due and careful consideration, is of the unanimous
opinion that the provisions contained in Assembly Bill No. 127
constitute an absolute, unnecessary and unwarranted extension
of the provisions of the "Brown Act", and constitutes grave
invasion of the city's right to confer with its attorney in
private, and that said Bill would seriously impede the functions
of a municipality in relation to the acquisition of property
without eminent domain proceedings, and would make most difficult
the proper handling and settlement of litigation involving the
municipality; and
WHEREAS, the City Council of the City of Rolling
Hills is of the opinion that the people of the State of
California are adequately protected by the provisions of
Sections -54950 to 54958, inclusive, of the Government Code
of .this State and that the amendment of these Sections as
proposed by Assembly Bill No. 127, and others like it, go
far beyond the scope of the original intent of the "Brown
Act" as set forth in Section 54950 of the Government Code,
and that the enactment of said Bill would reduce substantially
the city's ability to effectively formulate decisions in
those areas where policy and administration are so entwined
that it is difficult to separate one from the other.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Rolling Hills that said Council does go on
record as opposing Assembly Bill No: 127 and the passage
thereof by the'California Legislature for the reasons herein-
above set forth; and,
BE IT FURTHER RESOLVED that the City Clerk is
hereby authorized and directed to forward certified copies
of this Resolution to all members of the Assembly Committee
on Governmental Efficiency and Economy; to State Senator
Richard Richards; and to Assemblymen Charles E. Chapel and
Joseph B. Kennick; and to the Office of the League of
California Cities. -
